Dear Ms. O'Rourke,
On 6 October, 2003, I sent, via FEDEX, 35 separate, individually dated Freedom of
Information Act requests to your office.
Imagine my surprise when I reccived a telephone call from a Canadian citizen in
Massachusetts—David R. Amos--who told me that my confidential information and
requests had been sent to himm!!
Enclosed are copies of my FOIAs, date-stamped when received by your office, and
initialed by Mr. Amos, confirming his receipt of them. Fortunately, Mr. Amos was
honest enough to forward them back to me.
Now, I want to know, what in the world you are doing sending my confidential records to
anyone —let alone a foreigner-and what you are going to do to prevent such unlawful
disclosures of confidential information in the future?
Also, I want to know when I may expect to receive a response to my request for these
records?

Dear Dr, Dean:
We received your letter, dated 12 Novexnber 2003, in which you noted that your requost letters
and personal information had been sent to a third party, Mr. David Amos. You had sent 33
separate FOIA requests to our office in October. I can certainly understand your concern that
‘your personal information had been sent to another person. However, it was not we who did it.
Upon receipt of your requests, we noted that they were all addressed to the IRS FOIA office to
the attention of Ms. Ruby McCoy. Also, the records and information you requested would have
been in the possession of that office, not ours. Therefore, we treated your letters as having been
misdirected to our address and sent them all to the IRS, at the address you gave for them in your
letters. I wouid recommend that you contact that office directly, since they and we are not even
{n the same agency (IRS is a part of the Treasury Department and we are a part of the Justice
Department).

Dear Ms. O'Rourke,
Thank you for your letter of 21 January, 2004 (Incl 1), regarding 35 separate FOIA requests that were
somehow sent from your office to a third party alien, In your leter, you stated, “it was not we who did
iv”
However, despite your protestations to the contrary, I believe that it was, in fact, your office that was
responsible. Please note that although the FOLAs were addressed to Ms. Ruby McCoy, | apparently
sent them to your office by mistake. It is clear that they were received by your office, as each
individual FOIA was date-stamped “EOUSA/FOIA/PA” (Incl 2), which I believe is your office.
In addition, it is clear that Mr. Amos received these, as indicated by his initials atthe bottom (Incl 2),
pursuant to his swom affidavit (Inel 3). A cover letter from your office accompanied my documents
(inel 4) which were received by Mr. Amos. The documents that were returned to me, by Mr. Amos,
date-stamped received by your office, were my original documents.
‘Therefore, your statement that “we treated your letters as having been misdirected to our address and
sent them all to the IRS, at the address you gave for them in your letters” does not comport with the
facts and evidence available to me. While I must take the responsibilty for having misdirected may
FOIAs to your office in the first place, itis clear that these original documents were nat sent to Ms.
‘McCoy, but were instead sent to Mr. Amos, who in tum sent them to me.
Please investigate this gross mishandling of confidential information, and let me know what you find
out, and what actions will be taken in the future to prevent recurrences.
