Use the scenarios in the BUGusa, Inc., link located on the student website to answer the following questions.

1. Scenario: WIRETIME, Inc., Advertisement Has WIRETIME, Inc., committed any torts? If so, explain.

WIRETIME Inc. has committed a tort known as Defamation. A defamatory statement was made toward BUGusa, Inc. attacking their reputation and honesty. When WIRETIME, Inc placed the ad containing statements that BUGusa, Incs electronic recording devices were low quality and did not work longer than a months period, it created harm to BUGusa clients. For this reason, WIRETIME, Inc created a tort by imposing false statements.

2. Scenario: WIRETIME, Inc. (Janet) Has WIRETIME, Inc. committed any torts? If so, explain.

In the scenario of WIRETIME, Inc and Janet, WIRETIME has carried out a Tort known as, Current Contractual Relationship Tort. WIRETIME talked Janet into breaking her current agreement with BUGSusa for their job by offering more money and a sign on bonus. WIRETIME had a clear understanding of the agreement Janet held with BUGSusa because they saw the contract. They definitely interfered with the agreement. For this reason, WIRETIME, Inc created a tort by inducing Janet to break her existing contract.

3. Scenario: WIRETIME, Inc. (Steve and Walter) Discuss any liability BUGusa, Inc., may have for Walters actions.

BUGusa, Inc. would be in violation of the tort false imprisonment. They will also be liable for the actions of their security guard, Walter. Walter did not have the right to detain Steve. Under the merchants privilege, a suspected shoplifter could be detained for a short period to try to obtain the stolen merchandise. In this case, Walter would not have the right to detain Steve to question him about working for another company. Coercion was also violated by Walter, because he tried to obtain a confession and threatened to hurt Steve if he did not give him the information he wanted.

4. Scenario: BUGusa, Inc., Plant Parking Lot What defenses may be available to BUGusa, Inc.? Explain your answer.

According to (Melvin, 2011, p. 208), negligence is an accidental (without willful intent) event that caused harm to another party. In this case, the type of negligence committed is malfeasance. BUGusa and the vendor have what is known as a special Relationship, therefore, BUGusa had a responsibility to make sure the vendor was safe in delivering the packages. The vendor that was robbed can argue that there were recent robberies and vandalisms that have taken place in the area. As a result, BUGusa should have hired proper security to secure the area. BUGusa Inc. can argue that they did not rob the vendor, nor did they know that the vendor would be robbed. BUGusa, Inc. can also argue that there was an assumption of

risk when the vendor walked into the parking lot. The recent crime wave was well known to all the residents of Shady Town, therefore the vendor should have known of the danger involved in his job. The vendor could have also left his wallet in the card to avoid it from getting stolen.

5. Scenario: BUGusa, Inc. (Randy and Brian) What defenses may be available to BUGusa, Inc.? Explain your answer.

According to (Melvin, 2011, p. 208), negligence is an accidental (without willful intent) event that caused harm to another party. Randy can argue that BUGusa was negligent in following the traffic laws. He can also argue that if Brian was not speeding, no collision would have occurred whether or not he failed to yield. BUGusa can argue comparative negligence. If BUGusa can prove that Randy was more negligent than Brian was, BUGusa can prove that Randys own negligence was the primary cause of his harm.
6. Scenario: BUGusa, Inc. (Sally)
Sally may have a successful case against BUGusa, Inc., for what torts? Explain your answer.

According to (Melvin, 2011, p. 208), negligence is an accidental (without willful intent) event that caused harm to another party. The tort Sally should use in her case is Negligence. The equipment Sally was using to monitor a crime bosses hideout shortcircuited and injured her. The original older model did not have an insulator installed, which would have prevented the accident. The insulator was removed from the original design due to production cost.
