This letter is to inform you of the resolution of your official complaint against George
Makatura. The Board did review all aspects of this complaint at our Board meeting on
April 24, 2008.
The Board followed the procedure outlined below from the Bylaws of the ACC:
“The Board shall first consider whether the allegations in the charges, if proven, would
constitute conduct prejudicial to the best interests of the corporation. If the Board
considers that the charges do not allege conduct which would be prejudicial to the best
interests of the corporation, it may refuse to entertain jurisdiction.”
After discussion, the Board did not find conduct prejudicial to the best interests of the
corporation and refused to entertain jurisdiction. The Board also determined that by so
doing and according to the Bylaws (“a deposit of $50 which will be forfeited if such
charges are not sustained by the Board following a hearing”) that your $50 deposit be
returned.
I am extremely sorry for the delay in notification. It had been my understanding that this
letter had been sent to you the day following the Board meeting. The Secretary is still in
possession of your check and I am directing her to return that to you as soon as possible. I
will also send a signed copy of this letter to you by regular mail for your records. Once
again, my apologies for the delay.
