e)er( case is whether the con)e(ance was a bona %i!e transaction or a tric4 an! contri)ance to !e%eat cre!itors, or

Re*uisites before a contract can be rescinded on the +round that it has been entered into in fraud of creditors:

"rece!in$ n#ber there is a "ersonal ri$ht, both o% which !eser)e the "rotection o% the law. The( are si#ilar in the
sense that in both cases the "erson who can a)ail o% the re#e!( o% rescission is a stran$er to the contract

Insolvency ( it re%ers to the %inancial sitation o% the !ebtor b( )irte o% which is is i#"ossible %or hi# to %l%ill his
obli$ations. A 0!icial !eclaration o% insol)enc( is not, there%ore, necessar(.
Accor!in$ to 1anresa, the obli$ations conte#"late! b( this article co#"rehen! not onl( those with a ter# or which are
sb0ect to a ss"ensi)e con!ition, bt e)en )oi! an! natral obli$ations as well as those which are con!one! or which
ha)e "rescribe!.

the cre!itor can ha)e no other re#e!(.

The %irst "ara$ra"h is a""licable onl( to rescissor( actions on the $ron! o% lesion an! not to rescissor( actions on the
$ron! o% %ra!. This is so becase in the latter there can certainl( be no obli$ation on the "art o% the "lainti%%;cre!itor
to restore an(thin$ since he has not recei)e! an(thin$.
Rescission is not "ossible, nless he who !e#an!s it can retrn whate)er he #a( be obli$e! to restore.
i.e. where a $ar!ian alienates the "ro"erties o% a #inor %or P59,333 to a certain "erson, an! sbse'entl(, the #inor
"on reachin$ the a$e o% #a0orit(, brin$s an action %or the rescission o% the contract on the $ron! o% lesion, the e%%ect
i% rescission is $rante! wol! be the restoration o% thin$s to their con!ition "rior to the celebration o% the contract. Bt
