Plaintiffs Ithaca Ventures k.s and Ithaca Development, LLC ("Ithaca") and defendants
Nintendo Co., Ltd. and Nintendo of America Inc. ("Nintendo") (collectively, the "Parties"), by
and through their undersigned counsel of record, hereby stipulate and agree that, subject to the
terms of a Settlement Agreement between the Parties, all claims by Ithaca against Nintendo, and
all counterclaims by Nintendo against Ithaca, related to infringement or non-infringement of the
patent-in-suit or otherwise claimed or counterclaimed are dismissed with prejudice pursuant to
Fed. R. Civ. P. 41(a)(l)(A)(ii). This dismissal is without any award of costs, expenses, and
attorney's fees arising under 35 U.S.C. 285 or otherwise with each Party to bear its own costs,
expenses and attorney's fees, in the manner specified by the Agreement between the Parties
