RESULT OF HEARING
The Court discusses the case with the parties.
Plaintiffs and defendant Sega represent that they are engaged in renewed settlement discussions
in light of the Courts recent order denying class certification as against defendant Gearbox.
Plaintiffs are to file by June 3, 2015, a statement about how they intend to proceed with respect
to Sega. If the parties would like the assistance of a Magistrate Judge for settlement, the
statement should say so.
For defendant Gearbox, the parties agree on the record that plaintiffs will dismiss Gearbox with
prejudice in return for a waiver of costs by Gearbox. The parties are to finalize the necessary
papers documenting the agreement. The Court will conditionally dismiss the action against
Gearbox, with the dismissal becoming final after 60 days if neither party raises an issue before
then.
