Power-Based Personal Violence

A form of violence characterized by a person asserting power, using


control and/or intimidation in order to harm another

This includes:

Sexual Assault
Domestic/Dating Violence
Stalking

Other uses of force, threats, intimidation, or harassment

Also includes the use of alcohol or drugs to commit any of these acts

Includes acts committed by strangers, friends, acquaintances, intimates,


or other persons.

Sexual Assault

Sexual Assault includes the following:


Any form of unwanted or involuntary touching or penetration of
intimate body parts, by the same or opposite sex
Being forced to touch someone else

Unwanted or involuntary sexual contact means:


Without consent, including the use of threats, intimidation, coercion,
or physical force.

With those who are unable to give consent, because of their age or
because they are physically helpless, mentally incapacitated, or
intoxicated.

What is consent?

Based on choice

Active, not passive

Verbal. Legal consent is verbal, when no forms of trickery, manipulation


or intimidation are in place.

Possible only when there is equal power; if you cannot say no


comfortably, then the yes has no meaning.

Given freely, not given because of fear

The influence of drugs and / or alcohol pre-empt a person from having


the ability to give consent.

Domestic/Dating Violence

The actual or threatened physical, sexual, emotional or financial abuse of


an individual by someone with whom they have a current or prior
intimate relationship or shared residence.

Intimate relationship:
Current or past partner or spouse
Family member
Someone with whom a child is shared
Household member or roommate (former or present)
Caretaker

Stalking

Purposefully or knowingly engaging in a course of conduct directed at a


specific person that would cause a reasonable person to fear for her/his
safety or the safety of a third person or suffer other emotional distress.

Course of conduct is two or more acts of maintaining a visual or


physical proximity to a person, directly or indirectly by any action,
method, device, or means.

Identify whether the students health or safety is currently compromised


Do they wish to seek medical attention?

Campus Police can escort a student who has been sexually assaulted to the hospital if the student
prefers no ambulance. They will not ask the student for any reasons for going to the hospital. The
student can also be accompanied by professional staff or a friend if they wish.

Do they fear for personal safety (eg: does the perpetrator know where they live?) if so, a
room change and no contact letter are available immediately.

Let them know that while Conduct and AVI will reach out to them with resources, the
student will be able decide whether to use those resources or participate in a
conduct hearing, if there is one.

Ask them if they would like to be connected to confidential resources CAPS, AVI,
WomanSpace, Health Services. If so, share contact information. WomanSpace serve
as advocates to help students understand their options and make informed decisions.

If it is during business hours, ask the student if he/she would like to speak with Michelle
Gervasi in Anti-Violence Initiatives you can call x2272 to make an appointment

Ask the student if they would like you or someone else (a friend, professional staff, etc.) to
walk over to AVI with them.

Does the student want to report this to the police? If so, contact Campus Police.
Police will bring an advocate from WomanSpace to their office to help the student
understand the process and make decisions.

Report via Symplicity regardless of any of the students responses remember that
you are not a confidential resource, but you will keep the information private.

Contact Professional Staff immediately if any of the following are true:

Student needs medical attention

Student wants to be connected to resources

Student fears for their personal safety

Campus Police is involved

Remember Sexual assault removes control from the victim/survivor.


They have the right to not participate in the conduct process, not pursue
medical help, and deny legal/police intervention. They do not have the
ability to determine it wont be reported once theyve shared the
information with a non-confidential sources.

Additionally recognize your personal limitations and the need to


balance your position with your academic/personal life. You should
attempt to remove yourself from the situations as the survivor is
connected with the appropriate resources and short term follow up has
been made.
