Chapter 5
The Court System
Trial Courts
Trial Courts listen to testimony,
consider evidence, and decide the
facts in disputed situations.
Evidence is provided by witnesses
who are called to testify in the case.
In a trial, there are two parties
(sides) to each case.
Appeals Court
In an appeals court, one party
presents arguments asking the court
to change the decision of the trial
court.
The other party presents arguments
supporting the decision of the trial
court
There are no juries or witnesses, and
no new evidence is presented.
Tribal Courts
Several hundred Indian tribes govern
reservations in the United States
today.
The tribes no longer possess complete
authority over their reservations; they
do, however, retain some of their
original authority.
Including the power to regulate family
relationships, tribal membership, and law
and order on the reservation.
