Rynning and I arrived at 2390 SW 106th Terrace in response to a reported domestic disturbance where an unknown type firearm had been discharged. Upon arrival, Ofe. Rynning and I beyan to walk towards the residence and observed an Hispanic female, later identified 25 III victim) walking towards us HBB ace the statement while walking towards Ofe. Ryaning and I that, "those guns aren't needed." We asked her intially what had hhappened end why she had called police, She advised that she and her boyftiend, later identified as Albertin Chapman had an argument. She intially advised that he had pushed her and the argument had been broken up by family members. Chapman walked outside the residence and [IMMIMMadvised she heard "shotgun" blasts but did not know where they were coming from. She then ran to the south side of the residence to the north of the incident location and had hid behind bushes until she made contact with police. She advised her infant child was also still inside the residence with Chapman. (fe. Rynning, Ofe. Ray, Ofe. Shannon, Ofe. Bart, Ofe. Rabelo and I then approached the residence and observed several persons leaving the residence. As the subjects walked out, there were given instructions to approach officers and were checked for any firearms or involvement in the incident. None of the subjects that left the residence were Chapman. A perimeter was thon established on the residence and attempts were made to contact Chapman and have him exit the residence. Eventually, Chapman exited the front ofthe residence ‘without incident Of, Honore made contact with IM vbo advised she wished to give a sworn recorded statement regarding the incident. fe, Honore then began to take the statement and [tated she got into a verbal altercation with her child's father Alberto Chapman because she found something in bis phon tha she did not ike, She went into the bathroom with his phone and he tk the phone away from her wile they were inside ofthe bathroom. After tat, se followed him tothe bar and told him that she wanted o tlk to him inside ofthe movie cheater. Both parties then walked tothe movi theatar and once inside, she said that he beceme aggravatod and pushed her agains the wall. Chapman advised that earlier ody, while having a party with ends and farily at his house his grfiend started fighting wit him over his cell phone. He advised that he used his index and middle finger he poked his irtiend on the left shovlder and told her not to talk to him ike that. He sad that she fel othe floor end started yelling. Her brother came in and pushed Chapman tothe ground, Friends and family separated the two so that they would aot Bight. Chapmn said he got up and exed the residence. He wanted to drive away but friends would no let him. He got in the passenger seat of his white 2015 Land Rover bearing Fl tag? INEM his rind got inthe driver's seat. He then punched the passenger side window with his left fist from inside the vehicle, cree .a laceration to his left pinky knuckle. He then retrieved his pistol from the glove compartment, exited his vehicle and went locked himselfin the garage alone. He then shot scveral shots inside the garage and threw his pistol away inside the garage. His friends then took him to his room and locked themselves init. When Police arcived they had everyone exit the residence. Chapman refs to give a sworn recorded statement or sign an affidavit of complaint. Chapman did sign ‘consent to search for his exterior garage. 1 then spoke to IIIT regarding the incident. She advised that Chapman had pushed her against the wall near the movie theater room, inside the residence. She then advised she had then exited the room to the bathroom with Chapman's cell phone. I asked her about the witness account of her running towards Chapman and "tackling" him to the ground, She advised she did not know anything about that. She then advised that she was on the ground with Chapman and had then run out ofthe theater room. I asked her how she had fallen to the ‘round and she could not advise. She then sad that he ad pushed her up against the wall and she then fell to the floor. She then advised that Chapman had "choked" her by placing his hands around her neck, but did not prevent her from breathing at any time. I asked her ‘where he grabbed her and she pointed to her neck, but there were no injuries or even redness anywiere on her neck or chest. She then advised she did not want to have any further involvement with the incident and wished to gather her belongings and leave. She was eventually allowed to get her Belongings end leave the residence. She was advised that if she wished to get the rest of her belongings at a later time, she could ask for Davie Police officers to stand by while she does so. She left the residence on her own aecord atthe time of this incident, Photographs of her neck and chest were later placed into Davie Police property control. 1 then spoke to IIMB asked him to retell what he had observed during the incident. IIIEMinen advised that he was not going to make any other statements unless he feels that police officers are not handling the incident to his satisfaction. [Ic was later determined that after CST. Shaw was unable to locate a fitearm inside the garage: NMI had removed the firearm from the garage and placed it inside Chapman's white 2015 Cadillac Escalade. IIEEMEMedvised he had moved the firearm and placed it inside the vehicle to prevent anyone finding the fitearm and hurting themselves. MINN was advised that he had removed evidence from the crime scene IIB tarred hat he ha hindered he investigation by doing so. The reportee, IIE stated that her husband had a shotgun and that she had heard a shot go off. She said that her four month old daughter was stil inside the residence while she had fled outside, I responded as part of the Crisis Response Team, in antipation for potential negotiations. Upon arrival I met with fellow CRT member, Officer Honore, who was in contact with lend was in the process of obtaining information from her. We learned that there was a large party going on inside ofthe residence and there were still approximately 20 subjects inside, including another young child, We obtained a phone number for the suspect, identified as Albertin Chapman, and immediately began to cal in an attempt to each him. Uhad prior knowledge that Albertin does not speak English, so we had Officer Urbaez come over to give instructions to him in Spanish over the phone. Other Davie Officers, who had posted up out front of the residence, began giving verbal commands to the subjects inside to exit. As the subjects exited, they were quickly debriefed to determine if they had witnessed anything or if they had any additional information to give about Albertin Fight attempts were made to call Albertin’s cell phone, all which went fo voicemail, While we were attempting to contact Albertin, he eventually exited the residence along with the last three houseguests. 1 stood by with EEE nti relieved by Officer Honore, who obtained a taped statement from her. She went into the bathroom with his phone and he took the phone away from her while they were inside of the bathroom. After that, she followed him to the bar and told him that she wanted to talk to him inside of the movie theater. While inside of the theater, she said that he became aggravated and pushed her against the wall ‘That is when her brother came in the theater and separated them. After they were separated, she ran outside because she was seared for her and her daughter. She ran to her neighbor's residence and hid outside in the bushes. While she was hiding, she heard one gun shot, but she does not know who it came from. placed the sworn statement into Davie Police Property for transcription. Further investigation revealed that Albertin Aroldis Chapman was hosting a party at his residence for family and friends. During the party he ‘Was involved in a physical altercation with his girlfriend, (EEN over information she obtained from his cell phone. Conflicting stories were given by Mr. Chapman and] long with the witnesses who were family members. While inside the vehicle, Mr. Chapman punched the passenger side window with his left hand then reached inside the glove box and removed hhand gun, Mr. Chapman then exited the vehicle and entered his garage, which at the time of the incident was While inside the garage, Mr. Chapman fired seven rounds into a conerete wall and fired one round that ‘exited the garage through 2 window, the round was believed to have traveled into a large area of vacant land, During the shooting there were no guests present inside or outside of the garage that could have been injured. CST Shaw responded for crime scene investigations and recovered (8) shell casing inside the garage. The gun was turned in by Mr. Chapman's ani, ‘who removed the gun from the garage and held it for safe keeping until the police arrived and conducted the investigation. No arrest was made during the investigation due to conflicting stories and a lack of cooperation from all parties involved. [EEE collected some belongings and left the residence. On 11-03-15 T made contact with IIE s poe who would not provide me with a statement concerning the incident. I then asked him to give me phone number, but he refused to do so. I then mrovided him with my phone number and asked that he give the number to his sister so that she could call me. Mr: BB vies that he would give her my number but stated that she would probably not call. On 11-03-15 I made contact with ASA Marcie Zaccor and discussed the incident, I was advised that due to conflicting stories, no cooperating witnesses, and no physical injuries, there is insufficient evidence to charge Mr. Chapman with simple battery. [ was also told that since Mr. Chapman fired a gun inside of a closed and unoccupied garage there is also insufficient evidence to charge him with a gun violation Due to conflicting stories, lack of cooperation by the victim and witnesses, no physical injuries, and the fact that Mr. Chapman fired his gun in a closed garage with no one present, there is insufficient evidence to charge him with a crime. ‘This case is inactive/open, 1 smpp3 Page 11
