1. We refer to the letter you addressed to the Constitutional Court on 2 February 2016
concerning the above matters.
2. Our instructions are to record the Public Protectors appreciation of the Presidents partial
acceptance of her remedial action and his endeavours to achieve a resolution of the matter.
3. The Public Protector stands by the remedial action taken in paragraph 11.1 of her report
titled Secure in Comfort, save that she agrees that it will no longer be appropriate for the
SAPS to participate in determining the reasonable costs of the non-security related

upgrades implemented at the Presidents private residence, for the reasons set out in your
letter under reply.
4. The Public Protector would welcome a resolution of the issue concerning the Presidents
compliance with her remedial action within these parameters.
5. To the extent that the applicants in both matters may persist in other relief sought, the Public
Protector would wish to present argument on the issue concerning the nature and ambit of
her powers and the legal effect of her remedial action, as set out in her written submissions.
