I visually estimated the vehicle at 7SMPH. J activated mny Stalker Dual DSR (S/N 005793) Front Opposite Ant. and heard a clear audible tone and 2 visual readout of [SMPH. | tumed around on the vehicle and initiated a traffic stop on US 27 N, in front of the Legends Subdivision 1 approached the driver's side of the vehicle and immediately detected the odor of fresh unbumnt marijuana ‘coming from within the vehicle. l asked the defendant (driver and only person in the vehicle) for his license, registration and proof of insurance. The defendant handed me his license and I advised him 1 was stopping bir for speeding, The defendant immediately advised he was speeding because he had to use the restroom. 1 asked where he was coming from and he stated work, which was South of our location. | advised the defendant that he hhad passed a Wawa Gas Station and he advised he did not stop there because he had "to go number 2”. | then asked the defendant to step out of the vehicle at which time he stated no and began stating 1 had to tell him why. 1 then advised the defendant 1 would ask him to step out of the vehicle one more time and if he refused, he would be arrested. At this time, the defendant then again stated no, at which point I attempted to open the defendants door, It was locked and I reached in, in an attempt to unlock the door, The defendant then struck my hand and Quickly reached for the gear shifter on the vehicle. 1 attempted to reach in and push the defendant back so that he could not take off, at which time he was able to put in gear with me still near him and partially in the vehicle. 1 felt the car start to move and pushed away from the vehicle believing I would be struck by the vehicle if} did not take evasive measures. The defendant traveled to the front 3846 Beacon Ridge Way, his residence, where he exited the vehicle, looked at me and proceeded to run towards the front of his residence. 1 advised the defendant to stop running at which time he reached down into his waistband with his right hand. At that time I utilized my department issued X26 Taser, striking the defendant in his middle and upper back with both prongs. I gave the defendant numerous commands to stop moving and place his hands out to his sides. The defendant continuously ignored all commands, stil! attempting to reach into his waistband area. The defendant ‘was subsequently secured by D/S Blanton upon his arrival It should be noted that the defendant threw an unknown item out of his passenger side window near his residence. The item was never located by deputies. In the defendants vehicle, | located "shake" which is the remnants of marijuana, The "shake" was of a small quantity winich led me to believe the item thrown from the vehicle was the fresh unbumt marijuana I had smelled upon initial contact with the defendant. “The defendant was treated on scene by EMS for a bump he received on his head from being Tazed while running, ‘The defendant refused medical attention and was transported to the Lake County Jail. While enroute to the Lake County Jail, the defendant urinated and defecated on himself in the back seat of my patrol car. ‘My assigned patrol car is a marked unit equipped with a light bar that consists of Blue and White lights and has several blue lights on the sides of the vehicle, front grill of the vehicle and rear deck of the vebicle, The patrol car also has an emergency siren which was activated and working during the pursuit. ‘A firearm was also located in the vehicle, Deputies attempted to make contact with someone in the residence with negative results.
