Narrative
While entering the rear parking lot area of the Ballys Fitness Center, I received a dispatched call regarding someone placing a lit
cigarette in the gas cap area of a vehicle.
Upon arrival, I spoke with the owner / victim of the vehicle, Terry Bollea (known as professional wrestler Hulk Hogan). He said his

Narrative - Continued
vehicle was parked in the rear of Ballys. He said he was inside of the Oz nightclub. He said as he drove off onto the frontage road of
US Highway 19 North, he noticed a knocking noise at the rear of his vehicle.
He said initially he suspected he had run over something in the driveway. As he continued onto US 19, the same noise got louder.
He said he pulled over at a turnaround just north of Whitney Road on US 19, where he discovered his gas cap was hanging out of the
gas cap door. He said when he opened the gas cap door to put the gas cap back on, he discovered a lit cigarette inside the nozzle
area of the gas receptacle.
Terry said he immediately took the cigarette out and threw it to the ground, placed the gas cap back on and returned to Oz, where he
notified the manager,

went inside and checked the surveillance video and told
him he saw two white male subjects who had been inside the bar, drinking, prior to this incident.
Terry said one of the subjects had been identified as Seal/Expunged Record 2011 by his Florida drivers license and credit card,
which he provided for paying his tab.
While speaking with Terry, another subject walked up and identified himself as Timothy Jeffers, a Yellow Cab driver. Timothy told
me he had just taken a fare to the US Coast Guard Air Station. He said the two white male passengers were approximately 22 to 23
years old. He said while they were in the back seat of his cab, they were boasting about how they urinated on Terrys car. Timothy
said he questioned them about which vehicle they urinated on because he originally saw them standing near a silver Mustang. They
replied that it was the yellow Dodge Charger they had urinated on. They also boasted about placing a candy bar in the gas tank as
well as putting a cigarette into the gas tank.
Timothy told me he does not know which subject said it; however, one of the subjects said they hoped the vehicle blew up. Timothy
said the subjects stated their reasoning for doing this act was because Terry did not accept their drink and blew them off when they
wanted to converse with him.
Timothy said one of the subjects said he was a big fan. Timothy said the subjects said Terry was all washed up and was a piece of
shit.
Timothy said he told these subjects that the nightclub had surveillance cameras all around it. Their response was that they didnt
care because they were leaving in a couple of days. Timothy told me after dropping these subjects off, he immediately returned to
Oz to inform Terry of this incident. Timothy said upon his arrival, Terry was out front of Oz talking with the manager and that is when
he observed me entering the parking lot.
told me one of the other sailors who had been with the two suspects was still inside. That subject came outside and
identified himself as Carl Caperton. Carl told me he, Seal/Expunged Record 2011, Andrew Marks and another sailor came to Oz
together. He said once inside, Seal/Expunged Record 2011 recognized Terry as Hulk Hogan and began trying to converse with him.
Carl said Seal/Expunged Record 2011 bought Terry a shot of alcohol. When Terry declined the shot, Seal/Expunged Record 2011
became aggravated and actually got somewhat belligerent. Carl said Andrew and Seal/Expunged Record 2011 both went outside of
the club. He said he followed behind them to make sure they were going to get a ride back to the ship. He said once outside,
Seal/Expunged Record 2011 and Andrew told him they were going to take a taxi back to the ship. Carl said he and his other
shipmates decided to stay longer and he went back inside.
Carl said this was the first he had heard about this incident since he had returned outside to make sure Seal/Expunged Record 2011
and Andrew had gotten a ride. Carl did provide me with the information regarding what ship they were assigned to. He informed me
they were assigned to the US Coast Guard cutter Reliance and it was docked at the Coast Guard station in St. Petersburg.
told me he was unable to provide me with a copy of the video at this time. He stated he had to have someone at this
location who knew how to operate the system. I provided
with my business card and this case number and asked him to
contact me immediately once he had a copy of the video.
told me one of the bartenders may have the information on the other subject. I spoke with that bartender, Rena Carideo,
who told me the other subject, later identified as Andrew Marks, had been paying with cash and did not provide any identification to
pay his bill.
Rena did tell me she overheard Andrew and Seal/Expunged Record 2011 using vulgarity regarding Terry after Terry refused the

alcohol. Rena said she overheard the two suspects calling Terry an ass hole. She said they were saying, Who does he think he is,
blowing me off?
She said once they became belligerent, she cut them off and had them close out their tabs. She said after doing so, she watched
them walk toward the entrance of the nightclub and appear to exit. I contacted my supervisor, Sgt. DAndrea. I also had Forensics
Specialist Taylor respond to take photographs and process the vehicle for latent prints.
Terry did state he believes he could point out where he had pulled over and taken the burning cigarette out of the fuel receptacle.
After Forensics Specialist Taylor processed Terrys vehicle, we went up to the location where had stopped; however, once at that
location, there were several cigarette butts on the ground there and we were unable to determine which one came from his vehicle.
We then returned back to the scene, where Terry contacted AAA to have his vehicle towed as a precaution since the perpetrators did
actually put something in his gas tank.
I provided Terry with a Victims Rights Pamphlet and this case number for his reference. I advised him I would contact him later with
he SAO invest information and with the update of my investigation. I also provided the cab driver, Timothy, with my business card
and this case number.
I then responded to the Coast Guard Air Station in Clearwater, where I spoke with the security guards. They informed me two white
male subjects were dropped off by a taxi; however, they thought they had been dropped off at the Coast Guard station in St.
Petersburg and had to take another taxi down to the port.
I then responded to the Coast Guard station in St. Petersburg, where I made contact with a Commander Paul Flynn. Commander
Flynn was the officer in charge on the USC Cutter Reliance.
I informed Commander Flynn of my investigation and that I was looking for Andrew and Seal/Expunged Record 2011. He stated
those were two of his sailors. Commander Flynn brought the subjects out separately so I could interview them.
I spoke with Seal/Expunged Record 2011 first. I advised Seal/Expunged Record 2011 I wanted to speak with him about the incident
that occurred at the Oz nightclub. Seal/Expunged Record 2011 acknowledged he was there. I then advised Seal/Expunged Record
2011 of his Miranda rights via the SAO-issued card. Seal/Expunged Record 2011 acknowledged he understood his rights and agreed
to speak with me. I asked Seal/Expunged Record 2011 what had happened at the Oz nightclub. He indicated he and his friends had
gone out and had a few drinks, got some lap dances and then left.
I informed Seal/Expunged Record 2011 that I had witnesses who said something more happened than that. Seal/Expunged Record
2011 initially said nothing happened. When I asked him if he had met a celebrity at Oz, he then responded by saying, Yes. I talked to
Hulk Hogan.
Seal/Expunged Record 2011 said he and Terry conversed for a few minutes and then after that, he and his friends left. I asked him if
he had a drink with Terry. He stated he and his friends hes not sure which one paid for the shot got a shot for Terry. He said Terry
refused to drink the shot and he and his friend took offense to it.
Seal/Expunged Record 2011 said he was upset because he felt Terry blew him off and wouldn't talk to him. He said after that, he and
his friends left. I asked him what he did once he was outside in the parking lot at Oz. He then said he and his friend, Andrew, got
into a taxi and came back to the Coast Guard station. I then asked Seal/Expunged Record 2011 what he did before he got into the
taxi.
Seal/Expunged Record 2011 then hesitated and said he didnt recall. That is when I informed Seal/Expunged Record 2011 that
someone told me he (Seal/Expunged Record 2011) had gone to Terrys vehicle and urinated on it and someone also had placed a
cigarette inside the gas receptacle. Seal/Expunged Record 2011 then stated, Someone did that?
I then told Seal/Expunged Record 2011 there was a surveillance camera at the nightclub and he and Andrew were captured on video
walking over to Terrys vehicle. That is when Seal/Expunged Record 2011 said, Well, I did take a leak in the parking lot and I might
have peed on his car, also, but I didnt put a cigarette in his gas tank.
Seal/Expunged Record 2011 told me he doesn't even smoke, so he wouldn't have had a cigarette. I asked him if Andrew smoked. He
answered, Yes, Andrew does smoke, but I didnt see him put a cigarette in the gas tank.

At that time, I had Seal/Expunged Record 2011 sit in the back seat of my cruiser. Commander Flynn escorted Andrew down. I spoke
with Andrew, post-Miranda. I explained to him what my investigation was about. I told him I was giving him an opportunity to tell me
his side of the story. I advised Andrew of his Miranda warnings via the SAO-issued card. Andrew said he understood his rights and
did wish to speak with me.
Andrew told me while he and his friends were inside Oz, they saw Hulk Hogan come in. Andrew said Seal/Expunged Record 2011
was a big fan of Hulk Hogan when he was younger and wanted to talk with Terry and get an autograph. Andrew said Seal/Expunged
Record 2011 bought a shot for Terry; however, he declined it and Andrew took offense. He said he also took offense because when
they were trying to talk with Terry, they felt he brushed them off.
Andrew told me he and Seal/Expunged Record 2011 went outside and Carl came outside and asked them if they needed a ride.
Andrew said he told Carl they would go back together and Carl could stay if he wanted. Andrew said he and Seal/Expunged Record
2011 then walked over the yellow Dodge Charger. Andrew said he walked around the back side of the vehicle and Seal/Expunged
Record 2011 went to the drivers side.
Andrew told me he kicked the vehicle several times and walked to the gas cap area and opened the door. He said he took off the gas
cap and placed the lit cigarette inside the gas receptacle while Seal/Expunged Record 2011 urinated on the drivers side door.
Andrew said he then closed the gas door and he and Seal/Expunged Record 2011 got into a taxi to return to the Coast Guard station.
He said they were dropped off at the wrong Coast Guard station and had to take another taxi to the Bayboro Coast Guard station in
St. Petersburg.
I asked Andrew why they would do such a thing. He said he knows it was stupid and he did not realize how serious it would be. At
that time, I placed Andrew under arrest. I placed him in handcuffs and secured him in the back seat of my cruiser. I then had
Seal/Expunged Record 2011 exit the vehicle. I secured him in handcuffs and advised him he was being charged with Accessory After
the Fact of the arson attempt.
I provided their commander, Commander Flynn, with my business card and this case number for his reference. Commander Flynn
advised he would be contacting the Coast Guard investigative bureau this morning, informing them of the arrest of these two sailors.
I transported Andrew and Steven to PCJ, where Andrews bond was set at $20,000 and Seal/Expunged Record 2011 bond was set at
$10,000. An SAO invest was set for Friday, 07-27-07, in Division I at 1300 hours at the Clearwater Police Department.
I contacted Arson Investigator Sgt. Romeo and informed him of this investigation. I provided him with my case number for his
reference.

Narrative
I arrived at the above location, Dep. Martin informed me of the incident. The above vehicle was parked facing west in front of the
above location. I was informed a lit cigarette had been placed in the gas tank. The gas tank is located on the driver side of vehicle
behind the rear door. The victim stated he left the occurred and headed north on US 19 when he heard something banging against
the side of the vehicle, he pulled over and found the gas tank door closed but the gas cap was hanging out, and a lit cigarette was in
the gas receptacle. He removed the cigarette and drove back to the occurred. The gas cap was screwed back on and the door was
closed upon my arrival. There were signs of cigarette ash in the receptacle. I was informed candy was also possibly placed down the
gas tank but did not see any.
I photographed the above areas and items.
Using black/magna powders, I processed the exterior/interior gas tank and surrounding area for latent ridge detail and obtained
positive results on the exterior and interior gas tank door.
I then followed Dep. Martin North on US 19 to the middle median south of Haines Bayshore in an attempt to find the cigarette the
victim took out of his gas receptacle. There were too many cigarettes in the roadway to narrow the search down to the particular one.
Upon return to FSD, the latent lifts were submitted to the AFIS section.
