Motions LS10.

3 A New Vehicle-for-Hire Bylaw to Regulate Toronto's Ground


Transportation Industry
That Licensing & Standards Committee recommend that City Council adopt Item LS10.3 with the
following amendments:
1) Delete recommendation 26. City Council delete the requirement that snow tires be installed each
winter.
Add new clause:
Every vehicle used as a Vehicle-for-Hire shall be equipped with four snow tires every year from
December 1st to March 15th.
2) Amend clause 60) f) by replacing law of the Netherlands with laws of Ontario so that it now
reads:
f. be prohibited from imposing a mandatory arbitration clause on individuals accepting or
making requests for service commencing in Toronto through the PTC or requiring the law of
Ontario be applied in relation to use of the PTC Platform in Toronto.
3) Within the PTC Driver Requirements amend clause 71. City Council require that in advance of
allowing drivers to use the PTC Platform, the PTC must require that drivers:

the drivers must provide the following to Municipal Licensing & Standards Division
4) Replace section 71 c provide confirmation that their personal insurance company has been
advised that they offer or intend to offer transportation through a PTC; with
c. Provide directly to the Municipal Licensing & Standards Division proof of commercial insurance
collision and passenger hazard insurance
5) Replace Clause75. City Council require that all PTC Vehicles pass annual mechanical inspections,
as prescribed by the Ministry of Transportation, including:
a.
PTC vehicle owner to file a valid Safety Standard Certificate issued by a Ministry of
Transportation-licensed garage authorized to undertake such inspections upon application, and
annually thereafter;
b. PTC drivers to carry the original or a copy of the most recent Safety Standards Certificate in
the vehicle at all times; and
c.
PTC drivers to produce the Safety Standards Certificate upon request of a Municipal
Standards Officer or police officer.
With the following;
a) City Council require all Vehicles-for-Hire to attend initial and semi-annual
mechanical and fitness inspections at the City Inspection centre, and attend all other
inspections as necessary, remain.

b) that copies of these inspections must be provided to Municipal Licensing &


Standards as a condition of the Vehicle-for-Hire license.
6) Delete clause 76 City Council require a PTC Vehicle owner or driver to submit their vehicle for
inspection by a licensed mechanic within 24 hours of being directed by ML&S to do so, and
prohibit the PTC driver from providing transportation until a mechanic has provided a Safety
Standards Certificate confirming that the vehicle is fit to be driven.
7) Remove recommendations 31. City Council delete the requirement for command of the English
language as a condition of licensing, effective immediately. And recommendation 53. City
Council delete the requirement for command of the English language as a condition of licensing,
effective immediately.
Amend the report by adding; a requirement for command of the English language to be a
condition of all Vehicle-for-Hire drivers

8) Amend clause 78 to read : City Council require that all Vehicle-for-Hire drivers and vehicles have
Commercial Automobile Liability Insurance with limits of not less than $2,000,000 inclusive per
occurrence for bodily injury, death, and damage to property, and inclusive of such requirements
as set out below in the body of the report.
9) Amend Toronto Municipal Code Chapter 545, Licensing Section 545-142 Emergency lights system;
camera system; global positioning system in order to require that all Vehicle for Hire vehicles have
a camera installed to certain minimum technical standards and that cannot be altered by the
driver but that footage can be reviewed by the noted organization in limited circumstances.
A. As used in this section, the following terms shall have the meanings indicated:
Replace:
CAMERA SYSTEM - A camera system, approved by the Municipal Licensing and Standards
Division, capable of recording images of persons in a taxicab, such that access to the images is
limited to law enforcement personnel authorized by the Executive Director for law enforcement
purposes only.
With the following:
CAMERA SYSTEM - A camera system with minimum specifications approved by the Municipal
Licensing and Standards Division, capable of recording images of persons in a taxicab, such
that access to the images is limited to law enforcement personnel authorized by the Executive
Director, the Executive Director, and the vehicles registered brokerage, for the purposes of
law enforcement, training, or customer service investigations.

10) Amend the Screening Criteria in Attachment 2 referenced in clause 87 with an additional
requirement for a Police Check and to require that the Screening Criteria be administered by
Municipal Licensing & Standards.
11) Delete recommendation 88. City Council remove all existing restrictions on exclusive concession
agreements and permit all licensees governed by the Vehicle-for-Hire bylaw to contract with
property owners to provide exclusive services at particular locations, effective immediately.
12) Replace recommendation 94. City Council amend Chapter 441 by adding a new Vehicle-for-Hire
Drivers licensing class:
a.

Application fee: $290

b.

Annual Renewal fee: $290

with;
City Council amend Chapter 441 by adding a new Vehicle-for-Hire Drivers licensing class:
a.

Application fee: $500

b.

Annual Renewal fee: $300

13) Additional clause City Council direct that a $0.10 levy from all Vehicle-for-Hire faresbe paid
toMunicipal Licensing & Standards, in order to develop anAccessibility Fund to be administered
by Municipal Licensing & Standards. Proceeds from such a Fund to be used to provide a grant to
licensed Vehicle-for-Hire drivers who wish to purchase a wheel-chair accessible vehicle.

14) Additional clause: Replace the word taxicab with Vehicle for Hire in Section
545.130.1Prohibition on dispatch of unlicensed taxicabs. No person shall dispatch or otherwise
communicate requests for taxicab service to a driver in any manner or enter into an arrangement
or agreement with a driver to connect the driver with passengers seeking taxicab service unless
the driver and the owner of the taxicab are licensed as such under this Chapter.
So that it now reads; Prohibition on dispatch of unlicensed Vehicle for Hire. No person shall
dispatch or otherwise communicate requests for Vehicle for Hire service to a driver in any manner
or enter into an arrangement or agreement with a driver to connect the driver with passengers
seeking Vehicle for Hire service unless the driver and the owner of the Vehicle for Hire are
licensed as such under this Chapter.
