1. That accused is currently detained at the Makati City Jail for the
chargeofFrustratedMurderandhasbeenbehindbarssincehisarrest
onDecember16,2015;
2. Thatnobailhasbeenrecommendedforhistemporaryreleaseonthe
assumptionthattheevidenceofguiltisstrong;
3. Thattheprosecution'sevidenceofguiltagainstaccused,however,is
weakasthereisnodirectevidencethatwillpointtotheaccusedto
havecommittedthechargesagainsthim.Therecordswillshowthat
accused was maliciouslyimplicatedin the case through the sworn
statements of MANUEL ROXAS and JEJOMAR BINAY who
subsequentlyrecantedtheirtestimoniesandconfessed,amongothers,
thattheyweremadetosignthe"affidavitsofwitnesses"againsttheir
will.
4. Thatthereisnootherphysicalordocumentaryevidencetoshowthat
accusedisguiltyofthecrimecharged;

5. That the burden of showing that evidence of guilt is strong ison

theprosecution,andsincethisfactisnotsatisfactorilyshown,accused
is entitled to bail as a matter of right during the pendency of the
criminalcase.
WHEREFORE,uponpriornoticeandhearing,itisrespectfullyprayed
ofthisHonorableCourtthataccusedRODRIGODUTERTEbeallowedto
post bail for his temporary liberty pending trial of thecriminal
chargeagainsthim.

Otherjustandequitablereliefsarelikewiseprayedfor.
