Pataki (David N. Hurd, 1:00-cv-322), Van Allen v. Cuomo (Gary L. Sharpe, 1:07-cv-722), and Van Allen v. Walsh (Lawrence E. Kahn, 1:08-cv-876) (N.D.N.Y.) Despite the Supreme Court’s 1973 ruling in Rosario v. Rockefeller that New York’s lockbox procedure for changing party affiliation is constitutional,’ New York voters filed unsuccessful emergency complaints in 2000, 2007, and 2008 seeking a different result. The Supreme Court held that New York could delay the effectiveness of a change in party affiliation until after the following general elec- tion “to inhibit party ‘raiding,’ whereby voters in sympathy with one party desig- nate themselves as voters of another party so as to influence or determine the re- sults of the other party’s primary.” Two weeks in advance of New York’s March 7, 2000, presidential primary, two voters filed a federal complaint in the Northern District of New York chal. lenging New York’s law that allowed new voter registrants to enroll in a political party up to 25 days before a primary election but did not allow a change in party enrollment for already-registered voters to go into effect until after the next gen- eral election.” Two days later, Judge David N. Hurd issued an order to show cause why New York should not give effect to recent party enrollment changes.* Judge Hurd held oral argument in Utica on February 29, one week before the election.” He denied a motion by the Independence Party to intervene as a defend- ant, but permitted the party to participate as an amicus curiae.’ That day, he also dismissed the complaint, finding compelling New York’s interest in providing an incentive for new voters to register.’ ‘An appeal was heard on January 23, 2001; on October 4, the court of appeals determined that the case was moot.’ The court vacated the district court’s ruling,’ 1. 410 US. 752 (1973), 2. 1d at 760. 3.
