AFFIDAVIT
(In Support of Affiants Motion to Litigate as an Indigent)
I, DANILO B. DAYAWON, of legal age, Filipino, married, and a
resident of No. 9 Munsod Compound, Brgy. Calzada, Tipas, Taguig City
(copy of my Barangay Certificate is attached as Annex A hereof), under
oath, hereby state:
1.
I am the Petitioner in the case, entitled DANILO B.
DAYAWON versus NATIONAL LABOR RELATIONS COMMISSION,
PRC COURIER AND MAINTENANCE SERVICES, PNB-ALLIED
BANK, ALEXANDER WANG, MANUEL G. LOT, LUCIO TAN, AND
JOSEPHINE RAMOS, filed before the Honorable Court of Appeals;
2.
I know that I have a meritorious case, and therefore, I feel
aggrieved by the adverse decision of the above-mentioned public respondent
in the above-entitled case;
3.
However, because of my economic status in life, I cannot afford
to pay the docket and other legal fees in filing my Petition for Certiorari
before the Honorable Court of Appeals;
4.
My gross income and that of my immediate family do not
exceed an amount double the monthly minimum wage of an employee and I
do not own real property with a fair market value as stated in the current tax
declaration of more than Three Hundred Thousand Pesos (Php300,000.00).
Hence, I do not have enough resources which I could mobilize to answer for
the expenses needed to pursue my Petition for Certiorari and protect my
rights. Copy of the Tax Declaration of Real Property under my name issued
by the Office of the City Assessor of Taguig City is hereto attached Annex
B;

The filing of my Petition for Certiorari before the Court of
Appeals is my next avenue to even out my grievance and I hope that my
economic status in life will not deprive my admission to courts as
unhampered access to justice by the poor, the underprivileged, and
marginalized is one of the most precious rights shielded, secured and held
sacrosanct under Article III, Section 11 of the 1987 Constitution;

I am therefore praying urgently that the Honorable Court will
allow me to file my Petition as an indigent litigant;

I have executed this affidavit to attest to the truth of the
foregoing and in support of my request for admission as pauper/indigent
litigant and exemption from the payment of docket and other legal fees.
8.
I am attaching hereof, as Annex C, copy of the
Pinagsamang Sinumpaang Salaysay of two disinterested persons in
support of this affidavit.
