• While some of the items in Rule 109, Sec.1


may be considered as interlocutory under
ordinary civil actions, the nature of special
proceedings declares them as appealable and
as exceptions to Rule 41, Sec. 2, [Regalado]
• Since multiple appeals are contemplated
under this provision, appeals in special
proceedings necessitate a record on appeal
as the original record should remain with the
trial court. [Regalado]
• In special proceedings, the period of appeal is
30 days, a notice of appeal and a record on
appeal being required. The appeal period
may be interrupted by the filing of a
MFR/MNT. Once the appeal period expires
without an appeal/MFR/MNT, the order
becomes final. [Testate Estate of Biascan v.

ADVANCE DISTRIBUTION [Rule 109, Sec.


2]

• Notwithstanding a pending
controversy/appeal in estate settlement
proceedings, the court may permit that the
estate’s parts which are not affected by the
controversy/appeal be distributed, upon
compliance with Rule 90.
