COMPLAINT
The Complainant, being duly sworn, makes complaint to the above-named Court and states that there is probable cause to believe that the Defendant committed the following offense(s). The complainant states that the following facts establish PROBABLE CAUSE:

Complainant, Darrin Waletzki, of the Minneapolis Police Department, has investigated the facts and circumstances of this offense and believes the following establishes probable cause: On June 29, 2012, Minneapolis Police Officers were on directed patrol in the area of 19th Street East and Chicago Avenue South, City of Minneapolis, Hennepin County, Minnesota. The area was the site of numerous complaints of narcotics and loitering activity by neighbors. Officers observed a group of four male parties walking northbound. Officers observed one of the male parties, identified as Defendant herein COTIS LEE MACON, looking down at something in his flat hand. The other male parties also appeared to be looking at an object in Defendant MACONs hand. Defendant MACON looked up and observed the squad car and immediately closed his fist. Defendant MACON then opened his fist and dropped something onto the grassy boulevard. Defendant MACON continued walking and discarded another object onto the street. Officers recovered the objects dropped by Defendant MACON and found that they were rocks of suspected crack cocaine. The suspected crack cocaine field-tested positive, weighing 1.0 gram. The Defendant has a prior conviction for controlled substance crime from January 2003.

That on or about June 29, 2012, in Hennepin County, Minnesota, COTIS LEE MACON unlawfully possessed one or more mixtures containing a Schedule I, II, III, or IV controlled substance, to-wit: cocaine, and the DEFENDANT has a prior disposition for a felony-level offense under section 152.18, subd. 1, or felony conviction under chapter 152 or similar statute of another jurisdiction.

NOTICE: You must appear for every court hearing on this charge. A failure to appear for court on this charge is a criminal offense and may be punished as provided in Minn. Stat. 609.49. THEREFORE, Complainant requests that said Defendant, subject to bail or conditions of release be: (1) arrested or that other lawful steps be taken to obtain defendants appearance in court; or (2) detained, if already in custody, pending further proceedings; and that said Defendant otherwise be dealt with according to law.
