Narrative
On 8/12/12, at approximately 1717hrs, I, Ofc. Vest, was dispatched to 3450 22nd St., City/County of Boulder, State of Colorado, on a report of a male passed out in a Porsche in front of this address. The vehicle license plate was reported to be CO 349-TYS. Boulder FD and AMR were also dispatched. According to dispatch, the witness reported that the car was running, and the male was not waking up. While I was still in route, dispatch aired that the male had exited the car, and was walking away from the car. The male was described as wearing a blue shirt. When I arrived on scene, I saw that both BFD and AMR were on scene. I also observed a black Porsche Panamera sedan parked in the 3400 block of 22nd St., on the east side of the road. The license plate matched the one given by dispatch. I saw that the car was parked at an angle, with the passenger side rear wheel and tire completely on the sidewalk, and the remainder of the vehicle at an angle into the street. The front of the vehicle was approximately 18 to 24 inches from the curb.

As I approached the AMR ambulance, I saw that the AMR paramedic and two firefighters were speaking to the male, later identified as George Boedecker, who was wearing a blue shirt. AMR EMT Jessica Bobalek approached me and stated that they were speaking to Boedecker, and stated, "he's drunk as crap." As AMR was still speaking to Boedecker, I walked down to street a bit, and contacted the witness, Sue Richardson. I also called for a cover car, and Ofc. E. Burke responded. I later spoke to Bobalek by phone to gather more information regarding her observations. Bobalek stated that as she and AMR paramedic Jenna Steege pulled up to the scene, they saw Boedecker quickly exit his car, and begin to walk away. Bobalek contacted Boedecker, and asked him what was going on. She stated that Boedecker initially told her that he had just pulled over to take a nap. She stated that he changed his story to her a few times, later claiming that his girlfriend was driving, and described her as "batshit crazy." Richardson stated that she had turned onto 22nd St from Iris, and seen the Porsche parked at the odd angle with the wheel on the sidewalk. As she drove past, Richardson saw Boedecker "passed out," and "slumped over the wheel." Richardson stopped, and approached. She stated that Boedecker's car was running. Richardson began to knock on the driver's side window, and Boedecker initially did not respond. Richardson continued to knock on the window, as an unidentified neighbor called 911. Richardson stated that Boedecker began to rouse, and suddenly pressed the accelerator, causing the engine to race, however, she described him as still not awake. As the AMR ambulance arrived, Boedecker shut the car off and quickly exited the car, and began to walk away. As I was concluding my conversation with Richardson, I saw that Boedecker had moved away from the ambulance, and was beginning to get into his vehicle. I saw that he had his car key in hand. I approached Boedecker. I contacted him, and asked him to come to the rear of the car to speak to me. I also asked him his name. Boedecker responded, "What's your name?" I told him I was Ofc. Vest, with the Boulder Police Department. Boedecker agreed to walk to the back of the car, stating he would just take his "citation or whatever." At this point, I had observed a strong odor of an alcoholic beverage on his breath and person. I also heard him slurring his words. I also observed that Boedecker had unsteady balance. Boedecker appeared to me to be very intoxicated, based on my training and experience. I asked Boedecker for his driver's license, which he removed from a money clip, and handed to me. I saw that he fumbled with his ID and other Credit cards while doing this. I asked Boedecker if the address on the DL, 4450 Arapahoe Ave #100, Boulder, CO, was current. Boedecker stated that this was his office address. I asked him what his home address was. Boedecker told me, "I have 17 fucking homes," and asked which one I wanted. I asked him to tell me his primary home address. He responded, "That's the only one you fucking need," and said I could send the citation there. I asked Boedecker what was going on. Boedecker stated that his girlfriend had driven them to this location, and after an argument, she jumped out of the car, and ran off. He also stated that he had not driven, as he knew that wouldn't be right. I attempted to establish a time frame for this story. Boedecker initially told me that they had been at a benefit, and driven to here at 1130pm, last night. Boedecker later told me that they drove here at 1130am, this morning. I also explained to him that a witness had stated that he was in the driver's seat, with the engine running. Boedecker denied this, and exclaimed that they were wrong. I also began to ask about his girlfriend, and here whereabouts. Boedecker began to tell me that she was "really fucking famous," and a singer. He then asked me if I knew who Taylor Swift was. I asked him where she went. Boedecker gestured casually towards a neighboring yard, and said she was in Nashville. I continued to attempt to clarify the sequence of events, and Boedecker became visibly irritated. He told me he was done with my "fucking questions," and that things were about to become "mid-evil." He then turned, and began to move towards the driver's door of his car. Both Ofc. Burke and I told him to stop, which he complied. I explained to Boedecker my concerns regarding his intoxication and his being behind the wheel of the running vehicle. I asked Boedecker if he were willing to perform Voluntary Roadside Maneuvers. Boedecker looked at me incredulously, and stated, "I'm not doing your fucking maneuvers." I told Boedecker to turn around. He looked at me and asked if I were serious. I again told him to turn around, and after he did not comply, Ofc. Burke and I took hold of his arms, and turned him around. I placed Boedecker into cuffs, and double locked them. I also ensured they were not too tight, as I could insert my finger between the cuff and his wrist. Boedecker began to immediately complain that this was ridiculous, and couldn't believe we were doing this after

all he had done for this city. Boedecker remained verbally antagonistic. After I had him sit in the rear of my patrol car, I explained that he was under arrest for suspicion of DUI, and I needed to read him Colorado Expressed consent. As I read from my Expressed Consent card, Boedecker continually interrupted me, telling me he knew his "fucking rights." After I was eventually able to finish reading, Boedecker chose the Blood test. Boedecker remained verbally abusive, telling Ofc. Burke and I to "Go fuck yourselves in the ass." Ofc. Burke impounded Boedecker's car, which went to Marv's. I began to transport Boedecker to the Boulder County Jail, and asked for AMR to respond for the Blood Draw. During the drive, Boedecker constantly complained, and began to complain that the handcuffs were too uncomfortable. He told me repeatedly to loosen them and that the cuffs were ridiculous, as he had never done anything wrong in his life. I explained several times that the cuffs had been applied as per department training and guidelines. He continued to complain, and stated that every bump in the road was hurting him. He then began to cry out, after a short delay, each time a bump in the road was encountered. After arriving at the jail, Boedecker's attitude towards the arrest failed to improve. AMR medic Catherine Direen arrived at the jail to perform the blood draw. I began to speak to Direen, and exchange necessary information. Boedecker became very upset, and told me that I couldn't share his name with them. He stated that he knew his constitutional rights, and I could only share his ID number and Social Security number. I briefly attempted to explain that he was wrong, however, Boedecker began to speak louder and louder, just short of shouting at me regarding this. I was able to quiet Boedecker long enough to ask questions regarding the blood draw paperwork. Boedecker then signed the form, giving Direen consent to draw blood. Direen introduced herself, and suddenly, Boedecker began to speak to her extremely politely. Direen began to blood draw at 1816hrs, using Blood Kit with seal/control number 70128. After sealing the two vials of blood, she transferred custody of the kit to me. Once the draw was complete, Boedecker returned to being antagonistic. I returned to completing some paperwork. At one point, he began to argue with a BCSO deputy. I missed the beginning of the argument, but overheard Boedecker state "If you didn't have that fucking gun, I would!" Boedecker then returned his focus towards me, and referred to me as an "asshole," and informed me that I was now his "enemy for life," and stated that he hoped I would "fucking die." BCSO deputies promptly placed Boedecker in a private holding cell. Boedecker remained upset, and shouted at the deputies from the door. He, at one point, informed them that he was going to have their badges as well as mine. Several times while I was completing this report, I saw several deputies as well as a Sgt. talk to Boedecker, attempting to calm him. Each time, Boedecker would sit down, and keep his voice down for several minutes, but then return to his prior behaviors. I learned that the jail deputies were documenting Boedecker's behavior in greater detail. I jailed Boedecker, and issued Boulder County Summons #TS112953, charging him with CRS42-4-1301(1)(a) DUI, and CRS42-4-1301(2)(a) DUI per se. This case is cleared by arrest.
