After an exhausting jury trial at the Pomona Superior Court, Attorney Sergio J. Lopez was acquitted of six felony charges including Assault with a Firearm, Criminal Threats, False Imprisonment, Domestic Violence, Gross Negligent Discharge of a Firearm and Attempting to Dissuade a Victim. The multi-count criminal complaint was filed after Los Angeles Sheriff Deputies responded to a 911 call from a friend of Mr. Lopez' ex-girlfriend who alleged Mr. Lopez had shot at her friend over 24 hours prior to her calling police. Despite the fact that the alleged victim admitted to plotting with her friend against Mr. Lopez in order to blackmail him, Los Angeles Deputy District Attorney Lauren Guber, who has a history of concealing evidence and other questionable behavior, insisted on prosecuting Lopez. Mr. Lopez, who was represented by prominent defense attorney, Mr. John Barnett, said, "I was just in complete shock when I learned of what the accusations against me were. It felt like something out of a horror movie being on this side of the fence is truly a scary thing." Lopez was arrested on September 16, 2011 after surrendering himself to authorities upon learning of the allegations. He was released on bail the following Tuesday but was re-arrested and subsequently charged with dissuading a witness on October 4, 2011 for violating the courts protective order which resulted from the alleged victim contacting Lopez. Lopez, 36 years old, has been practicing law since 2008 and is known for his advocacy in domestic violence cases. He donates his time to an Orange County based, non-profit organization which provides education and resources in an effort to bring awareness to the Hispanic Community regarding Domestic Violence. "Mr. Lopez has been an invaluable resource and source of strength to our organization and our community we have always believed in his innocence and we are so pleased that justice was served," said Veronica Diaz, founder and director of the Heart 2 Heart foundation. Lopez was acquitted by a jury of four of the six felony counts and Superior Court Judge, Tia Fisher, dismissed the remaining two counts citing a lack of evidence. Lopez was convicted of one misdemeanor count of Violating a Court Order. "I just couldn't understand why no one would believe me. It was clear that I never fired a gun at anyone nor did I do any of the things I was being accused ofit was almost as if Ms. Guber had a personal issue with me," said Lopez after spending over four month in an L.A. County Jail. Lopez, a former police officer turned criminal defense attorney said he was just glad to put this behind him and is eager to see his two young daughters again and to begin rebuilding his life. Lopez has resumed practicing law in Santa Ana and believes that his personal experience with the justice system has given him a rare, firsthand look at how it is to be accused of committing a crime.
