ASSUMPTION OF RISK, VOLUNTARY RELEASE, AND INDEMNITY AGREEMENT

In consideration for being permitted to participate in activities of Elevate Life Churchs (the Church) obstacle course on stage at 8500 Teel Parkway, Frisco, Texas (hereafter referred to as the Obstacle Course), the undersigned, ____________________________ (herein referred to as the Participant), agrees as follows: 1. ASSUMPTION OF RISK. The Participant is aware of, understands, and assumes all risks inherent in participating in the Obstacle Course. This activity will require physical motion and exertion in, around, under, and over obstacles, which present risks including, but not limited to, minor injuries such as strains or sprains, serious bodily injury, or even death. RELEASE, WAIVER, DISCHARGE AND COVENANT NOT TO SUE. The Participant and/or his or her personal representatives, assignees, insurer, heirs, executors, administrators, spouse and next of kin, hereby releases, waives, discharges and covenants not to sue the Church, and its directors, officers, employees, agents, volunteers as well as its successors, assigns, affiliates, subordinates, and subsidiaries; and releases, waives and discharges all of the above from any and all liability to its assigns, insurers, heirs, executors, administrators, spouses and next of kin for any and all loss, damage or cost on account of injury to the Participant or his or her property, whether caused by negligence, or otherwise, while the Participant is participating in the Obstacle Course, and any other activities in connection therewith. INDEMNITY. The Participant agrees to indemnify the Church from any liability, loss, damage or cost that may incur due to the participation by the Participant in the Obstacle Course whether caused by the negligence of the Church or otherwise. The Participant assumes full responsibility for and risk of bodily injury, death or property damage due to the negligence of other participants in the Obstacle Course, or otherwise, while participating in the Obstacle Course. MANDATORY ARBITRATION. The parties agree that any claim or dispute arising from or related to this Agreement shall be settled by biblically based mediation and, if necessary, legally binding arbitration in accordance with the Rules of Procedure for Christian Conciliation of the Institute for Christian Conciliation, a division of Peacemaker Ministries (complete text of the Rules are available at www.HisPeace.org). Judgment upon an arbitration decision may be entered in any court otherwise having jurisdiction. The parties understand that these methods shall be the sole remedy for any controversy or claim arising out of this Agreement and expressly waive their right to file a lawsuit in any civil court against one another for such disputes, except to enforce an arbitration decision.

The Participant expressly agrees that this Assumption of Risk, Voluntary Release, and Indemnity Agreement (herein referred to as the Agreement), is intended to be as broad and inclusive as permitted by the laws of the State of Texas and that, if any portion of this Agreement is held invalid, it is agreed that the balance, notwithstanding, shall continue in full legal force and effect. I HAVE CAREFULLY READ THIS AGREEMENT. I UNDERSTAND THAT I ASSUME ALL RISKS INHERENT IN THE OBSTACLE COURSE, AS WELL AS THOSE RISKS SET FORTH IN THIS AGREEMENT AND THOSE RISKS WHICH ARE UNFORESEEN. I UNDERSTAND THAT THIS AGREEMENT IS A RELEASE OF ALL CLAIMS, INCLUDING THOSE GENERATED BY THE NEGLIGENCE OF THE CHURCH. I UNDERSTAND THAT I AM INDEMNIFYING THE CHURCH. I CERTIFY THAT I AM EITHER: [1] AT LEAST EIGHTEEN (18) YEARS OLD, OR [2] THE LEGAL GUARDIAN ACTING ON BEHALF OF THE PARTICIPANT WHO IS UNDER THE AGE OF EIGHTEEN (18) YEARS OLD.

I VOLUNTAIRLY SIGN MY NAME EVIDENCING MY UNDERSTANDING AND ACCEPTANCE OF THE PROVISIONS OF THIS AGREEMENT.
