On 09/21/2012 at approximately 0045 hours I, Officer DeBough, was assisting Officer Brad Kithcart on a criminal mischief to a business that occurred at 1222 Pearl Street. Officer Kithcart and I were talking with bystanders when I observed a male (later identified as Benjamin Douglas Szycher) walking with an unknown male and an unknown female, approach us from eastbound Pearl Street. As the group approached, Szycher made eye contact with me and yelled loudly, "Did you guys hear about the Boulder Cop who raped that chick? That's fucked up, dude. You guys need to get that shit under control." I observed that Szycher speech was slurred as he spoke. Szycher walked past and I asked him to keep his voice down and he responded, "Fuck off." A group of females attempted to walk Eastbound Pearl Street, past Szycher when I observed him yell aggressively towards them, "Mind your fucking business." Szycher continued to walk westbound Pearl Street towards Broadway. Officer Kithcart and I followed Szycher and verbally instructed him to stop and sit down on the brick wall. Szycher did not comply with my verbal instructions and stated, "You can't do shit, you nigger pig." I grasped Szycher's left wrist and verbally instructed him to sit down. Szycher responded by violently attempting to pull from my grasp. I pulled Szycher towards the wall and secured him momentarily against it. Officer Kithcart attempted to secure Szycher's right arm; Szycher responded by attempting to punch Officer Kithcart in his face (approximately 6 inches away from his face) with a closed right fist. I lost my footing and Szycher responded by punching me in the left side of my neck (causing pain) with a closed, right fist (pain rated a 5 on a scale of 1-10). Szycher slipped from my grasp and ran westbound Pearl Street and westbound across Broadway into traffic. Officer Kithcart and I ran behind Szycher but had to stop as to avoid being struck by northbound traffic on Broadway. I observed Szycher run onto Northbound Broadway into an alley located on the west side of Broadway, just north of Pearl Street. Officer Kithcart and I lost visual of Szycher momentarily. Officer Kithcart and I approached the alley and tactically searched it for Szycher. While conducting the search, I had my handgun drawn and Officer Kithcart had his Taser (Electronic Control Device) drawn. I located Szycher hiding behind a wooden partition, behind a group of dumpsters located on the north side of the alley. Officer Kithcart and I verbally instructed Szycher to place his hands in the air and walk towards us. Szycher placed his hands into the air as instructed but appeared as if he was going to attempt to run again. I secured my handgun, and grasped Szycher's right arm and utilized a straight armbar takedown to assist Szycher to the ground. I verbally instructed Szycher to place his left hand behind his back. He did not comply with my instructions and resisted arrest by attempted to stand to his feet. Szycher yelled, "You fucking twat, Mother Fuckers. You are arresting me for freedom of speech. Break my fucking arm you cock." I verbally instructed Szycher a second time to place his left hand behind his back; He did not comply with my instructions and continued to attempt to stand to his feet. Officer Kithcart secured Szycher's left hand and placed it behind Szycher's lower back. I placed Szycher into handcuffs and Officer Kithcart and I flipped him on his right side so that his breathing would not be impaired.

Szycher continued to resist arrest by kicking his feet and violently thrashing his entire body. Szycher continued to yell, "Come on, you fucking little Queef. You nigger Bitch. Ram my face into the fucking dirt. You are little Bitches. It took two of you to take me down." At approximately 0047 hours, Szycher was placed into a hobble to prevent him from hurting himself and Officers on scene. I secured Szycher's head to prevent him from striking it against the ground. Szycher responded by attempting to bite me and began to spit saliva from his mouth towards Officer Kithcart. Officer Kithcart placed a spit sock over Szycher's head to prevent him from spitting on Officers. Szycher continued to be verbally abusive and resistant towards Officers. At approximately 0103 hours, Szycher was transported via American Medical Response (AMR) Ambulance to the Boulder County Jail. Szycher continued to yell on the ambulance, "Hey faggot. How old are you? You are like fifteen right. I've been to jail before. This ain't nothin but a paycheck. You just made me money, you fucking Twat. We'll see what happens when I'm outa jail and suing your ass. You nigger fuck." Note: AMR EMT, David Kabal medically cleared Szycher. Upon arrival at the Jail, Szycher was verbally abusive towards the jail staff and would not comply with instructions. Szycher was immediately placed into four point restraints and placed into disciplinary. At approximately 0130 hours, I arrived at Boulder Community Hospital (BCH) and was treated for a possible neck injury and superficial scratches to my neck. Emergency Room Physician, Jason Rozeski medically cleared me for an abrasion to the left, lateral portion of my neck. Note: Szycher has an extensive criminal history which includes but is not limited to: Third Degree Assault on 03/01/2005 - Louisville Police Department Resisting Arrest/Interfering with a Peace Officer/Disorderly Conduct on 08/16/2009 - Broomfield Police Department At approximately 0520 hours, Officer Erin Starks took photographs of my face and neck (refer to photograph log for details). On 092112 at approximately 0046 hours I, Officer Kithcart and Officer Debough were working on a criminal mischief to the Go Lite store at 1222 Pearl St. in the City and County of Boulder, Colorado. Officer Debough and I were speaking with an unidentified male and female when another male, later identified as Benjamin Szycher approached us from the east. Szycher was walking with another unidentified male and female. When Szycher reached where Officer Debough and I were standing he yelled loudly "Did you guys hear about the Boulder Cop who raped that chick? That's fucked up, dude. You guys need to get that shit under control." Szycher continued to walk westbound on Pearl St. Officer Debough asked Szycher to keep his voice down. Szycher responded "Fuck off," to Officer Debough's request. As Szycher continued to walk westbound on Pearl St. a group of females was walking eastbound. Szycher yelled "Mind your fucking business," directly at these females as he walked westbound. Officer Debough and I followed Szycher as he walked on Pearl St. and Officer Debough told him to stop and sit down. Szycher stated that we could not stop him because he was excercising freedom of speech and continued to walk away from us. Officer Debough, using his hands grasped Szycher's left wrist, and again told him to sit down. Szycher immediately started to attempt to pull away from Officer Debough. Officer Debough guided Szycher back against a pay phone located just east of Broadway on Pearl St. Szycher continued to struggle with Officer Debough. I attempted to gain control of Szycher right arm which he was flailing violently. Szycher attempted to punch me with a closed fist. Szycher's right hand was approximately six inches from my face when he did this. Immediately after Szycher attempted to punch me I observed him punch Officer Debough in the neck with a closed fist. After Szycher struck Officer Debough he was able to get away and flee westbound on Pearl St. towards Broadway. Officer Debough and I followed Szycher across Broadway, having to stop momentarily to avoid being struck by crossing traffic. A southbound Subaru also had to come to a stop to avoid Szycher as he crossed Broadway.

Officer Debough and I followed Szycher into an alley north of Pearl St. and west of Broadway. I observed Szycher run south in this alley. Officer Debough and I started to search the alley. Officer Debough had his handgun drawn, and I had my Taser (Electronic Control Device) drawn. Officer Debough observed Szycher hiding in a corner of the alley behind a wooden partition. Officer Debough and I gave loud verbal commands for Szycher to put his hands up and walk towards us. Officer Debough and I still had our handgun, and Taser drawn at this time. When Szycher was approximately five feet in front of us Officer Debough and I gave loud verbal and repeated commands for Szycher to get on the ground. Szycher did not comply with this and appeared as though he was going to attempt to flee again. Officer Debough holstered his handgun and used a straight arm bar takedown to guide Szycher to the ground. I holstered my taser and assisted Officer Debough with handcuffing Szycher. On the ground Officer Debough instructed Szycher to remove his left hand from under his body and place it behind his back. Szycher did not comply with this and attempted to stand up. Officer Debough told Szycher again to place his left hand behind his back. Szycher still did not comply and continued to try to stand up. I removed Szycher's left hand from under his body and Officer Debough and I secured him in handcuffs. Officer Debough and I rolled Szycher onto his right side to assist with his breathing. Officer Starks and Sgt. Byfield arrived on scene. On his right side Szycher continued to resist arrest and started to kick his feet violently and attempt to stand up. Szycher yelled "Come on, you fucking little Queef. You nigger Bitch. Ram my face into the fucking dirt. You are little Bitches. It took two of you to take me down." Officer Debough secured Szychers head, and I secured Szychers legs with Officer Starks. Szycher started to spit in the direction of my left leg. I placed a spit sock over Szychers head to prevent him from spitting at Officers any further. Officers Debough, Starks and I secured Szycher's legs and feet using a hobble restraint that was secured around his ankles and belt. Szycher continued to be resistive and attempted to lift his head up off of the ground. Szycher started to laugh and stated "This is gonna be so funny when I fucking sue you. You nigger fuck." AMR responded and transported Szycher to the Boulder County Jail. This is a supplemental report only.
