OCCUPANCY AGREEMENT This agreement made as of ______________________________ between: __________________________________________, of legal age, Filipino citizen, married to _________________________, and

resident of _______________________________________, Philippines, herein referred to as the Occupant -and__________________________________________, of legal age, Filipino citizen, single, and presently residing at _______________________________________, herein referred to as the Provider WHEREAS: A. By virtue of Affidavit of Waiver of Rights executed on ______________________, denominated as Doc No. ____, Page No.____, Book No._____, Series of 2009, before the notary public in the Province of Albay, Atty. Leandro M. Millano, the Provider is the owner of the premises in ____________________________ including the building/house constructed thereon; B. Occupant desires to occupy and use of such premises more particularly described as __________________________ with Lot area of ______ square meter, herein referred to as the Premises; NOW THEREFORE in consideration of the mutual covenants and agreements hereinafter contained, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: 1. Provider hereby grants to Occupant, the exclusive use of the Premises, together with non-exclusive use of all common areas currently occupied by Provider. 2. Provider also agrees to provide the following additional resources to Occupant: (a) Use of the existing furniture located on the Premises; (b) Use of the existing: (1) One toilet/bath room (2) One bedroom (3) Kitchen area/Lavatory (4) Utensils at hand (5) Plants and bearing-fruit trees planted on the Premises 3. Occupant will, at its own expense, allowed to arrange, organize, and beautify on the Premises, but not allowed to construct any building/extension within the Premises; 4. Occupant is prohibited to sell or lease, and collect any sum of money to/from the third party arising from the use of Premises with or without knowledge of the Provider; 5. In consideration of the above-statements, Occupant agrees to pay to Provider a monthly fee of TWO HUNDRED PESOS, Philippine Currency (PhP200.00), payable in advance on the first day of each month. 6. In case the Occupant neglects to pay on the first day of each month, a surcharge of five percent (5%) will be collected and added to the standard monthly fee of Php200.00 until fully paid; 7. The term of this Agreement shall be for an initial period of 12 months commencing ___________________________________________, 2012 to _____________________________________, 2013. And

thereafter shall be deemed to automatically extend on a month to month basis with either party being entitled to terminate this Agreement on sixty (60) days prior written notice to other. 8. This Agreement shall not be construed or interpreted as a lease or sublease of the Premises.
