In consideration of the monies received and the mutual promises contained herein, the owner of the property, through

Pismo On the Beach Vacation Rentals, the Agent, does hereby lease and rent to Tenant that certain property described on this form under the terms and conditions stated herein. Pismo On the Beach Vacation Rentals, Agent for the Owner and Tenant agree as follows: The Premises will not be held for Occupant until both the reservation fee and security deposit have actually been received. Once paid, the booking fee is for services rendered in entering into this Agreement and is NONREFUNDABLE.

Full payment & signed Rental Agreement are due thirty days prior to reservation date. If not received, reservation will be cancelled. TENANT INITIAL:

2. OCCUPANCY: The unit is rented to (

) persons which includes the above named tenant, who is an adult and will be an occupant of the unit during the entire reserved period. Maximum occupancy for this unit is ( ). Guests in excess of the reserved number may result in immediate termination of the occupancy of the property, loss of entire rent and security deposit. A starter supply of paper towels, toilet paper, bath soap, dish & dishwasher detergent and laundry detergent is provided.

3.SECURITY DEPOSIT: Security deposit will be returned within 14 days of checkout MINUS any
amounts necessary to cover any damages, excessive cleaning, or any problem created by Tenant or Tenants Guests to the unit, its contents (including carpet) & grounds during the period of tenancy. If there are no problems, the entire deposit will be returned within 14 days following checkout.

4. PETS: NO pets allowed in any uit, or on or about the premises, without prior approval. Violation of
the NO pet policy is grounds for immediate eviction without refund, and loss of security dposit. Tenant is liable for all costs to replace furnishings or flooring damaged by pet.

5. SMOKING:No smoking in any unit, violation of the NO smoking policy is grounds for immediate
eviction without refund and LOSS of security deposit. Tenant is liable for all costs to remove odor or replace furnishings or flooring damaged by smoking.

6. KEYS and GARAGE OPENERS: Keys and garage door remote controls are picked up at our office or
drop box and returned there when departing. If you become locked out of your unit after office hours, a $ 30.00 charge will be deducted from your deposit. Charges for lost keys $ 25.00, lost garage remote is $ 50.00. Tenant will receive upon check in: (2) Door keys, (1)Garage opener & (1)Parking pass.

7. ENTRY: Upon 24 hours notice, tenants shall make the premises available during normal business
hours to Agent or representative for the purpose of entering to make necessary repairs or supply

necessary services. In an emergency Agent or representative may enter premises at any time without prior permission.

8. USE: Tenants shall not disturb, annoy, endanger, or interfere with neighbors nor use the premises for
any unlawful purpose nor violate any law or ordinance nor commit waste or nuisance upon or about the premises. All of our units are located in residential areas and may not be used for weddings, receptions, parties, or other large group functions without prior approval. Many units are located in homeowner associations where failure to comply with regulations concerning parking or any of the above may result in loss of your security deposit. Unit may not be used for any activity in violation of local, state, federal laws, or insurance rules and regulations. Page 2

9. TENANT RESPONSIBILITIES: Tenant shall properly use and operate all furnishings, electrical, gas
and plumbing fixtures and keep them as clean and sanitary as their condition permits. Excluding ordinary wear and tear, tenants shall notify Agent and pay for all repairs or replacements caused by Tenants or their guests, due to negligence or misuse. If anything fails to operate during tenancy, Agent will pursue repair with diligence but will not be held responsible for any inconvenience. Owner or Agent does not insure Tenants personal property. Neither Owner nor Agent shall be liable for any damages to, or loss of such property. Tenant shall pay for repair of drain blockages or stoppages, unless caused by defective plumbing parts or tree roots invading sewer lines. Tenant will be responsible for the cost of any unnecessary maintenance service call charges.

10. AGENT/TENANT INDEMNIFICATION: Agent is a booking and reservation service for the property
and its responsibility and liability is limited to providing habitable premises in a clean condition for use by tenant. Tenant and (all guests, and occupants) agree to use the property at his/her own risk and that of his/her guests. Tenant and (all guests and occupants) hereby indemnifies Agent and Owner and agrees to hold harmless from any and all liability, cost, expense whatsoever including reasonable attorneys fees in regard to Tenant and (Guests and occupants) use of the property. Tenant, and all guests and occupants fully release and discharges Owner/Agent from any and all claims , demands, and causes of action by reason of any injury which has or have or may occur to undersigned and any or all guests or occupants in connection with the occupancy of the premises. If Tenant or any member of his group violates any of the terms of this lease agreement, the Agent may ,at Agents sole discretion, immediately terminate this lease with no refund of the unused portion of the rents and may enter the premises without suit, court order, or notice to Tenant, and remove Tenant, the members of his group and their belongings. 11. LIABILITY: Agent and /or Owner shall not be liable for circumstances beyond their control, including
but not limited to appliance or air conditioning/heating failure, other mechanical failure, unfavorable weather, disruption of utility services including cable TV, etc. There shall be no relocation, rental rate proration, or refund in the event of such circumstances. In event Agent/Owner is unable to deliver said

property to Tenant under this agreement because of property sale, fire, eminent domain or act of nature, or if property is unavailable because of construction delays, or lack of utilities, Tenant agrees that Agent/Owners sole liability as a result of any of these conditions, is full refund of all payments tendered by Tenant. Tenant and Agent agree that in case of double booking or occupancy by owner, Tenant will be entitled to full refund of all monies previously tendered by Tenant. If Agent is able to relocate Tenant, Tenant agrees to pay a difference in rental amount, if any, should Tenant accept alternate accommodations.

12. DATA BASE DISCLOSURE: The Data Base is available through the California Department of Justice
and local law enforcement agencies per Section 290.4 of the Penal Code. Individual inquires may be made through the Department of Justice Sex Offender Identification Line. Page 3

13. PHONE: Telephone is for local calls only. Long distance, directory assistance, and incoming collect
calls are not permitted, except by phone calling card.

14. CHECKS: Fees for checks returned by Tenants bank are $ 25.00 15. CLEANING: Fees will not be waived, and will not cover excessive cleaning, damage or returning any
furniture that has been moved, washing dishes or removing trash.

16. CANCELLATION POLICY: We cancel your reservation if your payment is not received when due.
Should you wish to cancel this reservation, notice of cancellation must be received more than 30 days prior to arrival date. We will refund the sums you have paid less $100 cancellation fee and the $30.00 booking fee. Less than 30 days more than 14 prior to arrival-loss of deposit and booking fee. Less than 14 days prior to arrival-loss of rent and booking fee.

17. ATTORNEY FEES:


In any action or proceeding which concerns the rights, duties, or liabilities of the parties to this agreement, their principals, agents, successors, or assigns the prevailing party shall be entitled to recover reasonable attorney fees and costs. Pismo On The Beach Vacation Rentals reserves the right to substitute comparable accommodations without notice or liability should the unit be out of order or unavailable due to sale, lawsuit, death or similar circumstance. When comparable accommodations are not available, Tenant will have the option of selecting from available properties at the published rate or receiving a complete refund. Agent shall not be liable for changes in unit furnishings or equipment from time of reservation to occupancy date. THE UNDERSIGNED has read the foregoing prior to execution and acknowledges the receipt of a copy of this agreement.

Lock box is located at the rental site. The address of the units is 117 Ocean View, Pismo Beach, Ca. 93449. the envelope inside with your name, will contain your keys, etc. Sign envelope and leave it in lock box, return the key to the key lock, so the next person will be able to obtain their keys.

Check Out Procedures

Empty all trash to outside trash bins. Blue bin is recycle only. Green is yard waste, use only as designated. Turn off thermostat for heater, gas fireplace, oven and lights. Close and lock all doors and windows. Empty refrigerator of all your items. Leave the dishes in the dishwasher, or dish drainer clean, regardless of quantity. Leave the beds unmade, we take care of the linens and towels. Be sure all remotes for TV/VCR/DVD are on counter or next to the equipment, to avoid a charge to your security deposit. Please be careful to take all your belongings. There will be a Minimum charge of $25 to retrieve and send them to you. NOTE: SMOKING IN UNIT IS AUTOMATIC LOSS OF SECURITY DEPOSIT NOTE: Leaving trash and /or dirty dishes will incur an additional cleaning charge. KEYS, GARAGE OPENERS, and PARKING PASSES MUST be returned to our office, if office is closed, put in the drop box. It is not necessary to check out with the office, the returns constitute your check-out. A TRIP CHARGE of $25.00 to retrieve keys left at unit will be deducted from your Security Deposit. Vacation Rental Information


RATES: Summer rates are effective Memorial Weekend thru the day after Labor Day in September. PETS: Pets are allowed only in certain units, and requires a non-refundable deposit for flea spray and the additional cleaning for hair removal. Cleaning of soiled carpet, furniture, or yard area will be deducted from security. SMOKING: We do not have smoking units. Please use the patio and deck areas to smoke. Smoking in the unit is automatic forfeiture of security deposit. Cost to remove smoke odor will be charged to tenant. CLEANING FEES: Non-refundable cleaning fees are charged for each unit and vary according to size, number of bedrooms etc. You should expect a clean, stocked unit upon your arrival. If anything is amiss, please call the office immediately. Tenant will be responsible for repair of blockage, or stoppage unless caused by defective plumbing. RESERVATIONS: Tentative reservations may be made on the phone and require a deposit to hold to the due date, the full amount of the rent plus cleaning, the Transient Occupancy tax and non-refundable booking fee is due 30 days prior to arrival date, unless the reservation is made within 30 days of arrival, in that event the total amount is due on booking, or upon arrival, whichever is sooner. The security/damage deposit is retained as a deposit and is not credited toward the rent, and is refunded less any damage, excessive cleaning (not covered by the

cleaning fee), no later than 21 days in accordance with Calif. Civil Code .We accept Visa, MasterCard and Discover. CANCELLATION FEES: The booking fee is for services rendered in booking a reservation and is NONREFUNDABLE. 30 or more days prior to arrival $ 100.00 cancellation fee & booking fee. Less than 30 days more than 14 prior to arrival-LOSS of deposit & booking fee. Less than 14 days prior to arrival-LOSS of rent and booking fee. CHECK IN: Check in time is between 3:00 PM and 5:00 PM, in our office. If check in will be later than 5:00 please follow the lock box instructions on page 3 of your rental agreement. Page 7 CHECK OUT: Keys are to be returned to the office by 11:00 AM, if the office is closed please drop keys in the drop box. A TRIP CHARGE to retrieve keys left at unit will be deducted from your Security Deposit. FURNISHINGS: All our properties are fully furnished and equipped. Cable TV, VCRs and/or DVDs are supplied in most units. Please bring your own beach towels and blankets and sand chairs. House inventory and linens are NOT to be taken to the beach. Please do not remove furnishings, linens or kitchen items to another unit. Your deposit is subject to charge to return those items to their proper location. OCCUPANCY: NO guests in excess of the number specified on the rental agreement shall occupy the property. Guests in excess to the number may result in: 1) Immediate eviction with loss of entire rent & deposit. 2) Additional charge of $ 100.00 per day per person. Note: Please be careful to take all your belongings-there will be a Minimum charge of $25 to retrieve and send them to you.
