Verma Committee Report - laudable & an eye opener!


T

he UPA government had


announced the formation of the
Justice Verma Committee and asked
to look into crimes against women and
also to suggest legal reforms necessary
to deal with sexual assault cases, in
the wake of the public outrage
following horrific gangrape of a 23
year old in Delhi on 16th December
2012. The Committee was headed by
the former Chief Justice of India,
Justice Verma with former Chief
Justice of Himachal Pradesh and
retired Supreme court Justice, Justice
Leila Seth and former Solicitor General
of India, Gopal Subramaniam as its
members.
Eventhough the term of reference
for the committee was limited, the
panel interpreted expansively over
600 pages which comprises
comprehensive path-breaking, an
insightful and laudable report. They
submitted it in an historical period of
29 days spending almost 18 hours a
day, despite given a time limit of 2
months period, ending February 21st.
which is to be commendable. The
committee felt and assailed the
government that women remain unsafe
because of poor governance which is
the rootcause of all crimes against
women, not dearth of laws, pointing
out serious lapses committed by the
Delhi police in the instant case. The
report also lambasted for the lack of
accoutability of public servants, the
importance of making derliction of
duty as a cognizable offence. The
prime recommendations of the report
suggests rejection of death penalty for
rape even in the rarest of rare cases,
the convict may be released after 14
years at governments discretion, at
present being maximum 7 years. If
rape causes death and leaves the victim
in a vegetative state, the imprisonment
should be 20 years to rest of convicts
natural life. Same for gangrape and
repeat offenders. If minor, minimum
10 years jail upto life sentence, if the
victime dies or reduced to a vegetative
state, sentence should be for 20 years.
Against reducing the age of a
juvenile from 18 to 16 years saying
the jails lack reformatory and
rehabilitative processes. No to
chemical castration since mutilation
of body is not permitted by
constitution. Not registering sexual
offences by the police is an offence.
The panel recommended
sentences for new offences like
disrobing a women, trafficking,
stalking, intentional touching,
constitute an offence of sexual assault
with a minimum penalty of 5 years.
Calls for immediate review of The
Armed Forces Special Powers Act
(AFSPA) and similar protocols for
application to areas of conflict should
be revoked calling for stringent
punishment under the normal criminal
law. There should be no need for any
prior sanction to prosecute army
personnel or para-military personnel
when an accusation is of sexual offence
committing a rape or sexual harassing
of a woman, is not part of an official
duty. The committee calls for
appointment of special commission
in conflict zones to monitor womens
safety and security. Other important
recommendation is exempt disabled,
physically and mentally challenged
women from coming to police station
for registering a complaint. A woman
police officer should go to her
residence and record her statement in
the presence of an interpretor and can

be videographed under section 154
of the criminal Penal Code.
Marriage is not a valid defence
against sexual crimes. They came
heavily on khap panchayats and
they should not interfere in
marriages that sometimes lead to
deaths which have no legal sanctity.
The committee felt the urgent
need for empowerment of women
namely enactment of a bill for rights
of women since it is a stigma against
society. Suggested external tribunals
be set-up for harassment at work
places rather than internal
committees of the organisation. In
a painful note, Justice Verma
remarked that in 1997, as Chief
Justice of India , I have issued orders
to the Chief Secretary, Transport
Secretary and the Police
Commissioner where there was
school accident in Wazirabad. Had
those 15 years old orders have been
followed and from the day of the
committee was formed in Delhi,
police started to take steps , remove
tinted glasses from buses and
impounded such buses in violation
of permits. The said bus in Delhi
was penalised many times. Why
did not they act earlier? That could
have been saved the girl.
The committee felt that the
government has to choose between
politics and the constitution.
Politics is not about defeating the
constitution and hoodwinking the
constitution. The panel has
recommened changes and
amendments in the electoral laws
to enable disqualification of tainted
MPs and MLAs upon a court
taking cognizance of certain offences
against them or if an elected
representative furnished false
affidavit at the time of filing his
nomination. They wanted action
under prevention of corruption act
also. As for the assets and liabilities
declared by the candidate, they
suggested that these be verified by
the CAG , if found false, report it
to Election commission and move
to President for his disqualification.
They should be punished for a
minimum of 5 years imprisonment
and wanted disqualification from
the date of his conviction to 6 years
after his release. There should be
de-criminalisation of politics. It is
sore, when 31% of the electoral
college has either been charged or
convicted , destortion of morality
which is inherent to discharge public
function, stands seriously impaired
or eroded.The panel remarked that
the lathi charge done on the
protestors at India Gate will always
be an indelible scar on our
democracy when the protestors
were simply demonstrating
peacefully.
While defending the proposal
for desistance of death sentence for
the crime of rapes, generally there
is a talk globally for abolition of

death sentence against crimes. Over


150 countries in the world have
abolished death penalty. Moreover
womens organisations, educationists
and elites in India felt death sentence
should not be there for rapes.
They had also received about
80,000 suggestions which is so
voluminous from Indians and abroad
which has created a record for the sad
happenings. The panel felt that
introduction of death penalty is not a
deterrent effect and infact could be
regressive step. The womens group
also felt against chemical castration.
Having given value to these
suggestions, the committee
recommended imprisonment for the
whole of remaining life as the
maximum
punishments
for
aggrevated cases of rape. If rape
followed by a murder, there is already
the provision for capital punishment.
Justice
Verma
commended
particularly the youth forces for their
peaceful and mature protests that
paved way for the constitution of
committee on amendments to the
criminal law and also forced to take a
hard re-look at gender issues in the
country. The report also takes into
account critical issues that plague the
country such as food security and
malnutrition that force the women
across the country, sexual
harassments on a daily basis, arising
out of their economical conditions
leading to the class and caste aspects.
Overall, the rural people are much
affected and the cases are never
reported to the police.
Eventhough most of the
recommendations of the committee
are comprehensive, far-sighted and
must be congratulated for the big leap
forward in the struggle for womens
rights for its multi-dimensional report,
there is no mention for setting up a
timebound procedure for rape cases
or for setting up of fast courts. Now
the victim has to wait for a long 10
years time for the judgement, leading
to gross injustices , it is advisable for
a 3 months time-frame for the
completion of the case. There is no
mention of compensation to the
victims if proved other than medical
reimbursement. This is more
disappointing. Both costs should be
borne only by the perpetrator of the
offence. The juvenile law should be
amended from the present 18 years
to 16 years atleast since most of the
crimes are committed offlate by the
minors, going by records. Even
hardened criminals employ the
minors for committing crimes. Now
United Kingdom, Australia and USA
the minors can be sentenced right from
10 years as to the enormity of crimes.
Hence the punishments should be
equal owing to the magnitude of the
crime.
It is imperative that the panels
recommendations should be
considered by the parliament in its
ensuing budget session itself and
contemplate for a stronger criminal
law with stringent provisions for the
protection of women in safeguarding
their rights as enshrined in the
constitution, thereby make womens
empowerment strong. It requires
governments will and firm resolve to
respect the report and work for its
speedy
implementation
for
enactment of a strong law, thus
making necessary amendments in the
criminal justice system.

What is the watchword for all ethical codes ? Not I but


thou thus, I is the outcome of the infinite beyond trying to
manifest itself on the outside world. This little I is the consequence and have to go back and join the infinite, its own nature.
Every time you say not I but thou and you take the false step of
trying to manifest the infinite through the sensual world. That
brings the struggle and evils into the world but after a time, renunciation must come, total eternal renunciation. The little I is dead
and gone.
All these vain desires of living and enjoying this life here are in
some other place, bring death we have been degraded down to the
animal and are now growing up emerging out of this bondage.
We shall struggle hard but there will come a time when we shall
find that it is impossible to be perfect here while we are bound by
the senses. And then the march back to our original state of infinity, will be sounded. This is renunciation. We shall have to get out
of the difficulty by reversing the process by which we got it and
then morality and charity will begin.
Through creation there are 2 forces. One is selfishness and
the other is unselfishness. The one is aquisition and other is renunciation. The one takes and the other gives. From the lowest of the
worms to the highest, the whole universe is the playground of this
two forces. It does not require any demonstration but obvious to
all. The process of love is competition, the real genesis of competition is in love. The motive power of the whole universe whether
it manifests itself is that one wonderful thing unselfishness, renunciation, love , the real, the only living force in existance.

Gout is a disorder characterised by sudden recurring attacks of painful arthritis


caused by deposits of monosodium urate
crystals which accumulate in joints because
of an abnormally high uric acid level in the
blood. Joint inflammation can become
chronic and deforming after repeated attack.
Most of the people who have this attack
develop kidney stone.
In Ayurvedic, this condition looks like
Vatarakta. Vatarakta also starts at feet. Gout
also involves the metatarso phalangeal joint
of the big toe. Pathogenesis of gout through the deposit of uric acid
crystals and the influence of rakta dhatu has got similarity.
Symptoms : Articular features are characterised in both the conditions. In Vatarakta janu, amsa and padasula and southam will be present.
Redness (raga), warmth (usna), fever(jvara), fatigue(klama), cutaneous
manifestation (tvakdushti), cutaneous modules (arbuda upadrava) are
also mentioned. This disease is produced as a result of marga rodha of
vata by rakta. Here an equal importance is given to vata and rakta.
Diagnosis : Fasting uric acid level which is less 5 to 6 mg/dl is
normal.
Treatment:
1. Amapachana with Trikatu Choornam.
2. Snehapana is done with maha jiktaka grutham
3. Virechana with Eranda Thailam with milk.
4. Satva of guduchi.
Diet : To take: 1.2 o 4 litres of water every day. 2. Green gram,
wheat. 3. bitter gourd, drumstick, onion and dates.
To avoid : Smoking and alcohol. Spicy, salty, deep fried, fatty and
protein rich diet.

GOBI MASALA
Ingredients: 1 large Cauliflower, cut into florets, Oil for deep frying, 2 onions, 2 green chilies, 8-9 cloves of garlic, 1 inch piece of ginger,
2 tomatoes made into a puree, 1 tsp red chili
powder (lal mirch powder), 1 tsp coriander powder (dhania powder), 1 tsp garam masala powder, 1/2 tsp turmeric powder (haldi), 1 tsp
kasoori methi ,Salt to taste.
How to make Gobi Masala: First deep fry the washed cauliflower
flowerets and keep aside. Now heat 2 tblsp oil in a wok. Make a paste of
onions, green chilies, ginger and garlic and put it in the wok.
Saute till it changes color and add the tomato puree to it. Now add
all the spices, salt and kasoori methi and saute till oil separates. You can
now add the flowerets, add cup of water and mix well. Garnish with
chopped fresh coriander and serve with rotis.
