P E T I T I O N PETITIONER JEREMIAS V. BARIZO, represented by JULIO FAJARDO as Attorney-in-Fact, thru the undersigned counsel, to this Honorable Court, most respectfully states:

That Petitioner is of legal age, married, Filipino citizen, and a resident of Barangay Tigbinan, Labo, Camarines Norte; That he is the registered owner of a certain parcel of land covered by Transfer Certificate of Title No. T-14926 situated at Brgy. Tigbinan, Labo, Camarines Norte, more particularly described as follows: A parcel of land (Lot 4, of the consolidation subdivision plan (LRC) Pcs-13078, being a portion of the consolidation of Lots 1 & 2 Psu-176481 L.R.C. Record No F. Pat. 164112, situated in the Barrio of Tigbinan, Municipality of Labo, Province of Camarines Norte, Island of Luzon. Bounded on the E., points 1-2 by Lot 5 of the consolidation-subdivision plan; on the S., points 2 to 3 by property of Augorio Ibias, (now) Teofilo V. Barizo; on the SW., points 3 to 4 by Lot 11; on the W., points 4 to 5 by Lot 3, all of the consolidation subdivision plan; and on the NW., points 5 to 1 by Manila South Road (60.00 m. wide). Beginning at a point marked 1 on plan, being S. 88 deg. 36W., 15862.00 m. from B.B.M. No. 74, Labo Cad. 238. thence S. 3 deg. 04E., 338.75 m. to point 2; thence N. 73 deg. 43W., 22.50 m. to point 3; thence N. 81 deg. 10W., 96.60 m. to point 4, thence N. 7 deg. 10E., 242.41 m. to point 5; thence N. 41 deg. 52E., 102.85 m. to the point of beginning; containing an area of TWENTY SIX THOUSAND FIVE HUNDRED FIFTY NINE (26,559) SQUARE METERS, more or less.

That sometime on June 21, 2007, said owners copy of Transfer Certificate of Title No. T-14926 was inadvertently left on a tricycle which I boarded on my way to the Municipal Treasurers Office of Labo,

Camarines Norte to pay for its land taxes and diligent efforts to locate and recover said owners copy of TCT No. T-14926 proved futile;

That petitioner has not encumbered or mortgaged the abovedescribed parcel of land and that said copy of Transfer Certificate of Title No. T-14926 was not delivered to any person or entity to secure payment or in performance of any obligation whatsoever; 5. That there is no pending transaction or document relating to said title that has been presented or pending registration with the Register of Deeds of Camarines Norte;

That attached herewith is a certified Xerox copy of Transfer Certificate of Title No. T-14926 with a certification at the back thereof by the Register of Deeds of Camarines Norte showing that the title of the above parcel of land is intact and on file in said registry without any encumbrance; WHEREFORE, premises considered, it is most respectfully prayed that after due notice and hearing, an order be issued by this Honorable Court declaring the owners copy of Transfer Certificate of Title No. T-14926 which was lost, as null and void and of no force and effect and that the Register of Deeds of Camarines Norte be ordered to issue a new owners copy of Transfer Certificate of Title No. T-14926 in lieu of the lost one with the same faith and credit upon payment of the required fees. VERIFICATION / CERTIFICATION I, JULIO FAJARDO, after having been duly sworn to on oath, hereby depose and say: That I am the Attorney-in-Fact in the above-captioned petition for issuance of a new owners copy of Transfer Certificate of Title No. T-14926; that I caused the foregoing petition to be prepared; that I have read the contents thereof and the allegations therein are true and correct of my own personal knowledge and on the documents in my possession; That I have not heretofore commenced any action or proceeding involving the same issue in the Supreme Court, Court of Appeals, or any other tribunal or agency; That to my knowledge, no such action or proceeding is pending in the Supreme Court, Court of Appeals, or other tribunal or agency; and That if I should learn that similar action or proceeding has been filed or is pending before the Supreme Court, Court of Appeals, or any other
