ORDINANCE AUTHORIZING THE LEASE OF A

PORTION OF NEILSON PARKING FACILITY AND THE


TRANSPORTATION AND COMMERCE CENTER
PARKING FACILITY UNDER N.J.S.A. 40A:12-14.(a)
AND THE SALE OF COMMUTER BUS TICKETS

WHEREAS, the Local Lands and Buildings Law, N.J.S.A. 40A:12-1 et. seq. provides
that a municipality may lease real property as set forth by ordinance authorizing said lease; and

WHEREAS, the Township of East Brunswick owns two parking facilities referred to as
the Neilson Parking Facility “Neilson” and the Transportation and Commerce Center “TCC” and
wishes to lease a portion of the facility for a ticket office and a lobby area for utilization by a
private bus company to provide commuter bus services with conditions spelled out in the
Specifications.

NOW, THEREFORE, BE IT ORDAINED by the Township Council, Township of


East Brunswick, County of Middlesex, State of New Jersey according to the following:

SECTION 1. The Township is the owner of property identified as Neilson and TCC and
space identified in the Specifications to be advertised may be leased to a private person(s) in
accordance with N.J.S.A. 40A:12-14.(a).

SECTION 2. Detailed Specifications delineating the area to be leased and the conditions
associated with the lease are to be prepared and advertised in accordance with the Local Lands
and Buildings Law and said advertisement shall consider two insertions at least one week during
two consecutive weeks with bids not being received prior to seven days before the last
publication.

SECTION 3. The Specifications to lease the space to the bidder providing the lowest
cost commuter bus tickets shall set forth the conditions, restrictions and limitations for the term
of the lease which will be five years with an option for an extension of two years.

SECTION 4. A minimum price shall be established for the leasing of said space at
Neilson and TCC as delineated in the Specifications.

SECTION 5. The successful bidder shall be recognized by Resolution of the Governing


Body awarding the contract for leasing said space in accordance with the Specifications.
SECTION 6. If any section, paragraph, subdivision, clause or provision of this
Ordinance shall be adjudged invalid, such adjudication shall apply only to the section, paragraph,
subdivision, clause or provision so adjudged and the remainder of the Ordinance shall be deemed
valid and effective.

SECTION 7. All ordinances or parts of ordinances inconsistent with or in conflict with


the ordinance are hereby repealed to the extent of such inconsistency.

SECTION 8. This ordinance shall take effect 20 days after final passage, adoption and
publication according to law.
