SPECIAL CONDITIONS AGAINST TENDER SPECIFICATION NO.

The special conditions shall be read and construed with the annexed General Conditions in Form B as modified by the provisions contained herein. If there is any conflict or inconsistency, between the provisions of special conditions stipulated below, and these mentioned in the General Conditions Contained in Form B the provisions contained in the Special Conditions shall prevail. (1) (2) NAME OF SUPPLY: The material as per detailed specification given in the enclosed sheet against tender nay be supplied. RATES : The tender should quote the rates only in the annexed proforma for rate schedule and the rates should be quoted in words and figures. The rates quoted should be F.O.R. Sambhal and firm in all respect. All the cuttings and overwriting should be duly signed. In case the rates are found illegible or cutting not being signed, the tender shall be rejected. SECURITY: The successful tenderers will be required to deposit security @ ---- % of the total value of the supply for faithfully execution of the order. The security shall be require to be deposit in form of FDR/TDR/Bank Draft, duly pledged in favour of the Superintending Engineer, Electy. Distribution Circle Sambhal which will be returned after completion of supply. PAYMENT : The payment shall be made as early as possible after the receipt of supply and check at site. The supplier shall furnish the bills in duplicate duly pre-receipted at the time of supply. TRADE TAX : Trade tax shall be paid extra as legally applicable against Form-3D or form C which shall be issued by purchaser. EXCISE DUTY : Excise duty or any Govt. levy on finished material shall be paid extra on production of necessary Excise Gate pass or any other document in proof of having paid the amount claimed. DELIVERY : The material supplied shall have to be supplied within 30 days from the date of supply order or as per instructions given in the supply order. GURANTEE : The material supplied shall be guaranteed for satisfaction/ satisfactory performance as per clause30 of Form B. The material to be supplied can be inspected before dispatch as desired by purchaser by any offer authorised by the S.E. EDC, Sambhal or the undersigned . The supplier shall intimate the purchaser that the material is ready for inspection. DESPATCH : The material to be supplied can be delivered to the person authorized by the S.E. ,EDC, Sambhal at the time of placing of order for supply. PENALTY : Penalty for late delivery of material from the stipulated time shall be charged % per week on the value of unsupplied material subject to a maximum of 10% . The amount of penalty shall be deducted from the bills of the supplier. ARBITRATION : The contractor shall be governed by the conditions as mentioned above and the General Condition as mentioned above the General Conditions as specified in Form B . Any dispute arising out of or related to the subject matter of the agreement shall be subject to the jurisdiction of the District Court of the Sambhal/Moradabad District and the High Court of Judicature as Allahabad.

1. The Tenderers should carefully read and study the specification and should submit the tender documents accordingly. Figures should be given both in words and figures. All the cuttings and overwriting should be duly signed and attested. 2. All the General conditions specified in form A/'B' of UP Power Corp. Ltd. and special conditions given in the specifications shall be binding on the tenderers. 3. The tender shall be accepted only in the proforma being given with the tender documents. Any render in form other than the proforma supplied with the tender documents shall be liable to be rejected. 4. Tender shall be submitted in two parts. viz. part-1 and part-II . Each part as to be submitted in separate sealed cover envelopes and both the envelopes be submitted in the sealed cover . In case of the successful bidder, the earnest money will be adjusted towards the security deposit required for the supply of material/works 7. The tenders without sufficient earnest money or with insufficient earnest money shall be rejected summarily and the seond part of such bidders shall not be opened. 8. No relaxation in deposit of earnest money shall be allowed. The supplier registered with the DGS&D or Director of Industries UP shall also have to deposit the required earnest money. Any such registration will not entitle the bidders for exemption from the deposit of the earnest money. 9.
