SERVICE CONTRACT AGREEMENT


(For Information-cum-Office-cum-Library Managers (IOLMs) and other officials working under Rashtriya Madhyamik Shiksha Abhiyan, Haryana School Shiksha Pariyojna Parishad)

this__________ day of ______________________________, 2013 (Two Thousand Thirteen) between Sh./Ms. ____________________________ S/D/W/o Sh../Ms. __________________________ resident of ______________________________________________________________________(being referred to for the ____________________ which expression shall, unless excluded by or repugnant to the subject or context, include successors and assigns) hereinafter referred to as the first party) and Haryana School Shiksha Pariyojna Parishad and having its office at Shiksha Sadan, Sector-5, Panchkula (being referred to for the HSSPP which term shall, unless repugnant to the subject or context include its successors and assigns) hereinafter referred to as the second party) And whereas Sh./Ms.____________________________, the first party and HSSPP, the second party are willing to enter into Service Contract Agreement on the following terms and conditions as mutually agreed and binding upon them.

IT IS THUS MUTUALLY AGREED TO THE FOLLOWING EFFECT:1. That Sh./Ms.____________________________________, first party will be paid a consolidated Contract Amount/ Remuneration/Consolidated emoluments maximum of Rs. 18,800/-(Eighteen thousand eight hundred rupees only) per month based on certain performance parameters. This will be assessed through following formula and calculation:-

Remuneration (Maximum) in Rs. = (No. of DPRs sent*2000/Total no. of working days) + (No. of places visited*2000/10) + (No. of libraries being operational*2000/Total no. of libraries to be maintained) + (Information compilation of schools with latest updates*1000/Total no. of schools) + (No. of students profile developed for child tracking system*3000/50) + (Regular updation of photos & other information on facebook page*800/1) + (No. of other miscellaneous tasks completed by the HSSPP or DPC*6000/No. of other miscellaneous tasks given by the HSSPP or DPC) + (Frequent use of receiving, sending, opening & forwarding e-mails*1000/1) + (Capacity to type in Hindi*500/1) + (Ability to use camera & upload the photos on various media*500/1) Besides the aforesaid amount/remuneration/emoluments, the first party shall not be entitled to any other benefit (except dress allowance) in any form whatsoever except annual increment awarded on the basis of successful performance and other financial benefits passed by the Executive Council from time to time. That Sh./Ms. ___________________________,the first party has been engaged as Information-cum-Office-cum-Library Manager (IOLM) with the second party for a period of one year i.e. from ________________ to _______________, which period may be reduced due to the cessation of the above job earlier or unsatisfactory performance of the first party i.e. Sh./Ms. __________________________________. (Note: The post/assignment is under Rashtriya Madhyamik Shiksha Abhiyan on emoluments/remuneration basis which doesnt carry any regular pay scale of the Government. The State Government and HSSPP will be free from any responsibilities pertaining to financial, personnel and administrative matters in future at the time of the closure of the project. This fact must be understood by the candidate who is going to execute this agreement with the HSSPP) 2. That the second party shall have the right to fill up this post by taking a suitable person from any State or Central Government service or from public

sector undertakings or autonomous bodies on deputation/foreign service and in that case the contractual services of the first party shall be terminated by giving one months notice even before the completion of one year period of this contract. 3. That Sh./Ms.____________________________________, first party will not work and hold any other post or office of profit in any Government, SemiGovernment and Private establishments while working in the Parishad. 4. That the services of Sh./Ms.____________________________________, first party shall come to an end on the expiry of contractual period of one year unless extended further by the competent authority. No claim for extension shall be binding on the second party. No right to hold the post shall be conferred upon first party on account of first partys continuance on the post/assignment without any extension by the second party and the first party can be relived from duties at any time thereafter, without giving any prior notice. 5. That the contract of appointment can be terminated by the second party by giving a notice of one month without assigning any reason thereof or by giving one months contractual emoluments in lieu of the notice period. However, if the term of the first party is left short of one month, then the services of the first party for that short period, furthermore, if at any stage the first party desires to resign from the post, the first party will be required to give one months clear notice or on deposit of one months salary for the period by which the notice falls short of one month. 6. That or in the case first the party is work first found and party of guilty conduct is not of found

Sh./Ms.____________________________________, satisfactory

insubordination,

intemperance or any other misconduct, the services of the first party can be terminated without giving any prior notice. 7. Sh./Ms. _____________________________, the first party in case fails to

perform the job work, as approved by the Executive Council, assigned to

him/her and commits mistakes, the second party shall have right to deduct the remuneration/emolument of the first party. 8. That In case of any misconduct or dereliction of duty on the part of Sh./Ms.____________________________________, first party, the State Project Director or Additional Deputy Commissioner-cum-Chairman of the district where the first party is working will be the competent authority to impose fine upon the first party and the amount of fine will depend upon the gravity of mistake/dereliction in duty. 9. That Sh./Ms.____________________________________, first party shall furnish a declaration to the effect that:(a) The first party has not more than one living spouse, in case the first party is married. (b) The first party will be required to take the prescribed oath of allegiance to the Constitution of India. (c) The first party will have to abide by the Services Regulations of the Parishad, specifically approved for Rashtriya Madhyamik Shiksha Abhiyan, as amended from time to time. (d) The first party will not seek dowry if he/she gets married during the execution of this agreement. (e) The first party will not be the party directly or indirectly in carrying out female feticide in any manner. 10. That the appointment of Sh./Ms.____________________________________, first party is subject to his/her character and antecedents being certified to be good by two Gazetted officers of the Government, who are not related to him/her and are known to the first party at least for the last two years. 11. That Sh./Ms.____________________________________, first party shall furnish attested copies of certificate in support of date and of birth, academic/professional qualification/experience Scheduled

Caste/Backward Class/ESM certificate etc, if applicable, before joining the post or assignment. If it is revealed later on that the first party doesnt possess prescribed qualifications, experience etc., and/or the certificates of

the first party are found to be fake or bogus at any later stage, the services of the first party shall be terminated forthwith and the first party may also be liable for legal action. 12. That Sh./Ms.____________________________________, first party will have to produce medical certificate of his/her fitness from the Civil Surgeon before joining. 13. That after the expiry of Service Contract Agreement/ work of the project, this bilateral agreement shall automatically come to an end without any requirement of notice or compensation etc. to Sh./Ms. _______________________________________, the first party. 14. That the second party first can party deploy at Sh./Ms any

______________________________,the

place/position/office/concern etc during the currency of this agreement. 15. That Sh./Ms._________________________, the first party shall participate in training programmes, workshops, seminars, meetings and group discussions as organized by the second party. 16. That Sh./Ms.___________________________, the first party shall be imparted job linked training of three months as per the terms and conditions mentioned in the advertisement. 17. That Sh./Ms.___________________________, the first party shall make at least ten visits per month to schools falling under his or her jurisdiction and send reports (ssarmsa2@gmail.com) of the visit through e-mail on the same day or the day after. 18. That Sh./Ms.___________________________, the first party shall learn various applications of computer machine including working on MS Office (Word, Power Point, Excel, Access etc), use of Internet, typing skills in Hindi & English, proper use of printer & scanner, operate a digital camera and upload the photos on computer. There shall be efficiency tests on a monthly

or bi-monthly basis for making assessment of the learning level of the first party. If he/she underperforms in these tests, the services of the first party will be discontinued. 19. That Sh./Ms.___________________________, the first party shall participate in physical activities, yoga & meditation sessions as and when organized by the second party so as to maintain good physical and mental health. 20. That Sh./Ms.___________________________, the first party shall be entitled for ESI benefits under the Employees State Insurance Act, 1948 over and above the consolidated contract amount/remuneration. In case the first party is not entitled to the benefits under this Act, in that eventuality, the first party shall be paid Rs.500/- per month as fixed medical allowance over and above the consolidated contract amount/remuneration. 21. That Sh./Ms._____________________________, the first party shall be reimbursed the payment of TA/DA wherever required to undertake journeys for performance of service contract Agreement as approved by State Government as per entitlement from time to time. 22. That the present engagement of Sh./Ms.__________________________, the first party, for this work in terms of this Service Contract Agreement, shall in no case and circumstances confer any vested right in the first party to continue beyond the aforesaid date nor would confer any vested right to seek any employment in the office of the second party. 23. That Sh./Ms._________________________________, the first party shall follow the dress code as prescribed by the second party failing which Rs. 50/- (Fifty rupees only) per case/instance shall be imposed on him/her. The first party shall get dress allowance of Rs. 300/- (Three hundred rupees only) per month so as to maintain the dress code. 24. That Sh./Ms._________________________________, the first party shall compulsorily send Daily Progress Report consisting the details about work done each day in an elaborative manner. The first party shall send the

above reports on a daily basis through mail to his immediate superior with a copy to State HQ also at ssarmsa2@gmail.com. In case the first party doesnt have the official facility of internet, the reports may be written on the desktop and sent through mail whenever he/she gets the connectivity. In exceptional case of not having both above facilities i.e. internet and desktop, the first party shall write the DPR on a register in his/her own hand writing and sent thorough mail after scanning the same. That Sh./Ms._______________________________________, the first party shall keep the record of Daily Progress Report with him/her and submit at the time of his/her application for the renewal of this Service Contract Agreement in case the project continues. Assessment of Daily Progress Reports shall be one of the main criteria for extension. 25. That Sh./Ms._____________________________________, the first party shall abide by any other provision which is the part of the offer letter and which is not mentioned in this agreement. 26. That all differences and disputes between the parties hereto on any clause or matter herein contained or regarding their respective rights, claims liabilities hereunder, or howsoever, in relation to, incidental to or arising out of this Agreement, shall be subject to, governed and adjudicated under the Arbitration and Conciliation Act, 1996 (26 of 1996) as amended up to date by referring the same to the sole arbitration of the Principal Secretary School Education Department or his nominee, acting as such at the time of reference, whose award shall be final and binding on both parties. IN WITNESS WHEREOF Sh./Ms. ___________________________________________, the first party and HSSPP the second party, after understanding all the terms and conditions of this agreement have signed this service contract agreement at ____________ on this _______ day of ________ in the presence of the following witnesses.
