Plaintiff BCBG Max Azria Group, Inc. (BCBG) respectfully submits this notice to inform the Court that, consistent with the Mediation Report submitted by the mediator (see Dkt. No. 40) and BCBGs counsels call to the Court on April 2, 2013 pursuant to Civil LR 16-15.7, the parties have reached a settlement of this matter and are in the process of finalizing a long-form settlement agreement. The parties anticipate having the final agreement completed and the matter completely resolved by May 15, 2013. Accordingly, BCBG respectfully requests that the status conference currently set for April 22, 2013 be taken off calendar.
