10 years later, another Supreme wait

A decade after two pro-gay

By CHRIS JOHNSON

Expectations are high as the wait

what amounted to landmark rulings in
two other cases.

Anti-gay lawmaker guilty

of drunken boating

Blade to host town

hall with mayor

An anti-gay Maryland lawmaker on

Tuesday pleaded guilty to operating a
boat while under the influence of alcohol.
Del. Don Dwyer (R-Anne Arundel)
entered the plea in connection with
the August 2012 crash on the Magothy
River in Anne Arundel County that
left him, two other adults and four
children injured. He had faced charges
of operating a vehicle while under
the influence of alcohol, reckless and
negligent operation of a vessel, failing
to register his boat and a rules-of-theroad violation.
WBAL Radio reported Anne Arundel
District Court Judge Robert Wilcox
rejected the plea deal Dwyer had
reached with prosecutors that would
have given him probation. He sentenced
him to 30 days in jail and ordered him to
pay a $1,000 fine.
Dwyer, 55, has been among Marylands
most outspoken same-sex marriage
opponents. Dwyer, who separated from
his wife of 31 years in late 2011, told the
Maryland Gazette in January that thenDel Tiffany Alston (D-Prince Georges
County) and two Republican delegates
who voted for the same-sex marriage
bill contributed to his alcohol abuse.
That betrayal really affected me,
he said. I was physically ill. You pour
your heart into an issue like that and its
devastating.
Dwyer, who remains in an alcohol
abuse treatment program, will not have
to resign under Maryland law because
the crime to which he pleaded guilty
was unrelated to his legislative duties.
He will remain free pending the
outcome of an appeal of Wilcoxs
sentence his attorney filed after he
received his sentence.

D.C. Mayor Vincent Gray will meet

with the local LGBT community
later this month at a town hall forum
sponsored by the Washington Blade. In
the third annual event, Mayor Gray will
be interviewed by Blade reporter Lou
Chibbaro Jr. in front of a live audience.
Attendees will be able to ask their own
questions of the mayor, as well.
The event is open to the public
and scheduled for May 31 at 7 p.m. in
room G-9 of the Wilson Building (1350
Pennsylvania Ave., N.W.).

Will land swap displace

LGBT Center again?
As the D.C. LGBT Community Center
gets ready to move into its new home in the
Reeves Center municipal building at 14th
and U Street, N.W. unconfirmed reports
have surfaced that the city is considering
turning the building over to a developer as
part of a high stakes land swap.
According to an article in the local
blog Greater Greater Washington, the
Akridge development company would
demolish the Reeves building under
the terms of the land swap to make
way for an upscale condominium and
retail development project in the highly
desirable U Street, N.W. corridor.
The city, in return, would obtain from
Akridge vacant land it owns in the
Buzzards Point section of Southwest
Washington near the Anacostia River,
which would become the site for a new
stadium for the D.C. United Soccer team.
I dont know anything about it so
Im not going to comment at this time,
said LGBT Center President Michael
Sessa, who earlier this year signed a

15-year lease for the Centers rental of

space in the Reeves building.
Although the city would most likely
provide some compensation to the
Center for the early termination of its
lease, the Center would be forced to
undergo another search for a home at
a time when property values are rising
sharply in the city.
Greater Greater Washington and
other news outlets have reported
that a land swap involving the Reeves
Center and other older city buildings
to facilitate the building of a soccer
stadium was under discussion between
city officials, Akridge, and D.C. United.
But the news outlets have not identified
their sources for the reports.
We do not comment on anonymously
sourced articles, said Darrell Pressley, a
spokesperson for the D.C. Department
of General Services, which oversees city
properties.
But Pressley added, We are
continuing our discussions with D.C.
United about a stadium and were
hopeful about their future in the District.
Commenting beyond that is premature
at this point.

Gray holds LGBT

Youth Summit
About 80 people turned out on
May 11, for D.C. Mayor Vincent Grays
LGBT Youth Summit, which was held at
the Eastern Markets meeting hall on
Capitol Hill.
Those attending the event appeared
to be equally divided between high
school age youth and adults, including
city officials, teachers and school
administrators.
Gray served as moderator of the
event, presenting opening remarks
outlining the citys policies and laws
that support LGBT equality and fielding
questions from the youth.
We had modest goals that is to
give the youth a chance to be able to
express who they are and to talk about
some of the challenges of what it means
to be gay, bisexual, transgender, and
lesbian in our city, Gray told the Blade
after the summit ended.
And the second goal was to be able to
communicate that the mayors office, the
highest office in this government, is not
going to tolerate any kind of discrimination
and bias in the city, he said.
Among the city officials that spoke
at the event were Sterling Washington,
director of the Mayors Office of GLBT
Affairs; Elliot Imse, an official with
the Office of Human Rights; and Sgt.
Matthew Mahl, acting supervisor of the
D.C. police Gay and Lesbian Liaison Unit.
Imse said the Office of Human Rights
has launched an anti-bullying program
that allows youth, including students, to file

complaints against people who bully them.

Also speaking at the event was
Andrew Barnett, executive director
of the D.C. LGBT youth advocacy and
services group SMYAL.
DeQuan Barclift, a 10th grade student
at Richard Wright Public Charter School
for Journalism and Media Arts, said he
experienced bullying beginning in the
third grade.
Ive been called the famous F word
for faggot, he said. Im used to the
word. It doesnt affect me.
Barclift added, If anyone here has
been bullied my advice to you would be
hold your head up.
He said hes had a more positive
experience in high school, noting that
he recently wrote a letter to his school
newsletter telling about his coming out.
I got more positive feedback than
negative feedback, he said.

Trans birth certificate

bill set for hearing
Two D.C. Council committees were
scheduled to hold a joint hearing
Thursday on a bill that would enable
transgender people to obtain a new
rather than amended birth certificate to
reflect their new gender.
The JaParker Deoni Jones Birth
Certificate Equality Amendment Act of
2013 was co-introduced by seven Council
members, including Council Chair Phil
Mendelson (D-At-Large) and Council
member David Catania (I-At-Large).
Another five Council members,
including Jim Graham (D-Ward 1) signed
on as co-sponsors of the bill, leaving
Council member Marion Barry (D-Ward
8) as the only one on the 13-member
Council not to either introduce or cosponsor the bill.
The bill calls for amending the citys
Vital Records Act of 1981 to require
the Registrar to issue a new certificate
of birth designating a new gender for
any individual who provides a written
request and signed affidavit from a
licensed health-care provider that the
individual has undergone a gender
transition, to require that an original
an original certificate be sealed when a
new certificate is issued.
The bill also exempts an individual
from an existing city law requiring that a
name change application be published
in a local newspaper if the name change
is requested in conjunction with a
request to change the individuals
gender designation.
Representatives of the D.C. Trans
Coalition, which has taken the lead role
in lobbying for the bill, and the Gay and
Lesbian Activists Alliance, were expected
to testify at the hearing and to call for
some changes in the bills wording.

Prosecutor offers reduced charge in murder case

D.C. detective says 72-year-old
victim paid roommate for sex
By LOU CHIBBARO JR.
lchibbaro@washblade.com
Prosecutors have offered to lower
the murder charge against a 21-yearold D.C. man arrested in February
for allegedly stabbing his 72-year-old
former roommate, Howard Venable, to
death in exchange for a guilty plea.
At a May 8 status hearing in D.C.
Superior Court, Assistant U.S. Attorney
Holly Schick, the lead prosecutor in the
case, said the government would lower
the charge against David Jamal Wilson
from second-degree murder while
armed to voluntary manslaughter while
armed if Wilson agrees to a guilty plea
by May 31.
Judge Herbert B. Dixon Jr. scheduled
another hearing for May 31, at which time
Wilson is expected to disclose through
his attorney whether he accepts the offer.
A D.C. police homicide detective
testified at a Feb. 20 preliminary hearing
that the murder took place a few days

after Wilson moved out of the apartment

and on the same day Wilson and Venable
exchanged text messages arranging
for Wilson to return to the apartment to
engage in sex with Venable.
According to Det. King Watts, the two
men had a longstanding arrangement in
which Venable paid Wilson for sex every
two weeks. Watts testified that Wilson
and another witness whom police
havent identified told police about the
sex for money arrangement.
The Feb. 20 hearing took a dramatic
turn when Wilsons court-appointed
attorney, Jacqueline Cadman, told the
court that Venable and Wilson had been
in a longstanding abusive sexual
relationship since Wilson was a child.
Cadman introduced a motion calling
for the charge against Wilson to be
lowered to manslaughter because of
the alleged abuse. But Judge Stuart
Nash, who presided over the case at
that time, denied the motion, court
records show.
Court records show that on April
25 Wilson dismissed Cadman as his
attorney and retained a new attorney,
James W. Beane, who represented him

D.C.
Mayor
Vincent
Gray
acknowledged that tax liens filed against
Transgender Health Empowerment by
the IRS has forced the city to discontinue
its funding for the organization, even
though it has provided important
services for the transgender community.
In an interview with the Washington
Blade this week, Gray said he was aware of
ongoing financial problems at THE, the citys
oldest and most prominent transgender
advocacy and services organization.
Among other things, the group has
provided HIV and housing-related
services for transgender clients through
funding from city grants.
I dont know the details of how much
and that sort of thing, Gray said in
referring to how much money THE owes
the IRS.
But any organization that has a
grant from the government is going to
have to comply with the basic rules of
conformance with the requirements of
the government, including paying your

taxes, he said.
So while they certainly have been
helpful and I have a lot of admiration
for that organization, they are going
to have to straighten this out, Gray
said. It wouldnt be fair if organization

at the May 10 hearing.

A D.C. police affidavit filed in court at
the time of Wilsons arrest in February
says Venables body was found lying
face down in a pool of blood on the
floor of his one-bedroom apartment
at 1630 Fuller St., N.W., in a building
known as the Mozart.
The affidavit says an autopsy found
multiple slashing wounds on Venables
neck, minor cuts on both hands
consistent with defensive wounds, and
two stab wounds to his upper torso, one
of which struck his aorta.
According to the affidavit, police
discovered Wilson used bank cards
he allegedly stole from Venables
apartment to withdraw more than $600
in cash from ATMs in District Heights,
Md., on the night of the murder.
Detectives found Wilson at a residence
in District Heights on Feb. 3, and Wilson
agreed to go with the detectives to the
homicide branch offices in Southwest
D.C. to undergo questioning about the
case, the affidavit says.
It says he gave numerous inconsistent
accounts of his involvement in the
murder, including an account that

unknown intruders stabbed Venable.

In one version, Wilson said Venable
threatened him with a kitchen knife and
the two argued and he and Venable
struggled over the knife. Wilson told
detectives Venable fell on the knife
during the struggle and stabbed
himself, the affidavit says.
The autopsy, however, found that the
nature of Venables multiple wounds
confirms that he could not have
stabbed himself and that the manor of
death was murder.
Court records show that Wilson had
at least two encounters with police
and the courts prior to his arrest for
Venables murder.
In August 2012 he and two other men
were charged with armed robbery for
allegedly stealing a bicycle from another
man at knifepoint in Meridian Hill Park.
The charge was dropped after the
victim, who was to be the lead witness,
failed to show up at the trial.
In July 2011, court records show Wilsons
wife filed papers seeking a civil protection
order against him after he allegedly
assaulted her in the apartment where the
two lived with their two children.

X is absolved of responsibility
and organization Y would be held
accountable for this.
Added Gray, So well work with them to
try to get this resolved. But theyre going to
have to pay the taxes. Theres no question
about that. Its a basic, fundamental rule
that any organization that has a grant or
contract with the government they have
to take care of these basic administrative
responsibilities.
Grays comments came at a time when
transgender activists have expressed
concern that the D.C. Department
of Health, which is responsible for
monitoring THE grants, has not said
whether its taking steps to redirect the
groups clients to other service providers.
Transgender Health Empowerment
(THE) has had to dramatically curtail their
services due to financial difficulties,
said the D.C. Trans Coalition in a
statement on May 9.
This reduction happened very
suddenly, and services trans community
members depend on have been
abruptly cut off, the statement says.
Immediate action must be taken to
ensure THE clients get services they
need to ensure continuity of care.
The statement says D.C. Trans
Coalition stands with THEs clients and

calls on the D.C. government, as THEs

primary funder, to act quickly to make
sure that necessary services continue.
A spokesperson for the Department
of Health, as well as its gay interim
director, Dr. Saul Levin, and the gay head
of the departments HIV/AIDS office, Dr.
Gregory Pappas, have not responded
to requests for comment and requests
for information on the THE situation
from the Blade.
THEs executive director, Anthony
Hall, has also declined to comment.
Brian Devine, THEs finance manager,
told the Blade the groups board of
directors, which met recently, decided
the organization would not issue a
statement at the present time.
Transgender activist Ruby Corado,
director of Casa Ruby, an LGBT
community center in Columbia Heights
that reaches out to the Latino and
transgender communities, said THE
clients have approached Casa Ruby for
assistance after discovering that services
at THE were no longer available to them.
Public records at the D.C. Office of
the Recorder of Deeds show that the
IRS filed at least 10 liens against THE
since early 2010. Most are due to THEs
failure to pay employee payroll taxes,
the records show.

Anti-gay attacks spark concern in NYC

NEW YORK A series of attacks against LGBT New Yorkers in Manhattan
over the last two weeks has sparked concern among local advocates.
The Anti-Violence Project said four men shouted anti-gay slurs as they attacked
Nick Porto and Kevin Atkins near Madison Square Garden on May 5. The agency
said the New York Police Department has arrested a suspect in connection with a
second anti-gay attack that took place in Union Square on May 7.
Two men reportedly shouted anti-gay slurs as they attacked a man who
was leaving a West Village bar on May 8. The NYPD arrested two men who
allegedly attacked two gay men near a PATH station in Herald Square around
5 a.m. on May 9.
I am outraged by this string of assaults, New York City Council Speaker
Christine Quinn, a lesbian, said in a statement issued May 10. These vicious
assaults are not reflective of the diversity that defines New York City.

Poll shows Arizonans support marriage

PHOENIX A Behavior Research Center poll released on Tuesday
indicates a majority of Arizona residents support same-sex marriage.
Fifty-five percent of 700 people who responded to the survey between April
3-16 said they back nuptials for gays and lesbians. This support jumps to 70
percent among Democrats, while only 36 percent of Republican respondents
support same-sex marriage.
Arizona voters in 2008 approved a constitutional amendment that defines
marriage as between a man and a woman.

Nevada lawmakers approve trans bill

CARSON CITY, Nev. The Nevada Assembly on Tuesday gave final
approval to a bill that would add gender identity and expression to the states
hate crimes law.
This does not afford victims special rights, said gay Assemblyman
Andrew Martin (D-Las Vegas) before the measure passed by a 30-11 vote,
according to the Associated Press. This is a statement of what our society is,
and that we will not tolerate the systematic targeting of individuals who are
historically disadvantaged groups.
The state Senate has already approved the bill. A spokesperson for
Republican Gov. Brian Sandoval told the Associated Press the governor
supports the measure.

Puerto Rico mayor signs LGBT orders

SAN JUAN, Puerto Rico The mayor of Puerto Ricos capital on Monday
signed two executive orders designed to end discrimination against her citys
LGBT residents.
San Juan Mayor Carmen Yuln Cruz ordered her citys police department to
apply the islands current domestic violence laws with what the Primera Hora
newspaper described as the highest degree of respect regardless of the
reported victims sexual orientation. She also banned discrimination against
San Juan municipal employees based on their sexual orientation or gender
identity and expression.
Primera Hora reported gay boxer Orlando Fenmeno Cruz was among
those who attended the press conference during which Yuln signed the orders.

All eyes will be on the Boy Scouts of

partially lift a ban that LGBT advocates
have sought to remove for at least a
decade.
On May 23, 1,400 members of the
National Council will gather at the
National Annual Meeting in Dallas and
take action on the pending resolution,
which would allow all youths to
participate in the Boy Scouts regardless
of sexual orientation.
However, the resolution leaves in
place the rule prohibiting openly gay
adults from participating as leaders in
the Boy Scouts. Further, the proposal
maintains youth adhere to a duty to
God and behavior consistent with the
highest level of good conduct.
Zach Wahls, a 21-year-old activist and
Eagle Scout who gained notoriety
for speaking on behalf of his lesbian
parents before the Iowa Legislature
is the leading voice for a group called
Scouts for Equality that is urging the
organization to adopt the change.
The resolution that the Scouts are
voting on clearly is not fully adequate,
Wahls said. It still sends, I think,
potentially harmful messages to the
youth both gay and straight
about discrimination being OK. That
being said, I think its absolutely a step
in the right direction, which is going to
get started going down their path of
evolution, as it were. And we all kind of
know where evolution goes.
Wahls said Scouts for Equality for
the last two-and-a-half months has
been mobilizing grassroots supporters
across the country to talk with parents,
scout leaders and scout masters about
support for changing the gay ban.
That really can only happen within
the scouting community, Wahls said.
It was through those conversations our
incredible grassroots volunteers on the
ground that we were able to identify
and have conversations indirectly with
huge amounts of voting members.
In February, amid heightened calls for
the organization to end its gay ban, the
Boy Scouts started a review process to
consider the impact of a change. Part of
the review consisted of a questionnaire
sent to members asking them if theyre

OK with certain hypothetical scenarios

involving gay scouts and whether they
support or oppose lifting the ban.
The decision to partially lift the gay
ban in the Boy Scouts may be an attempt
to mollify religious groups affiliated
with the Boy Scouts. According to the
organizations website, seven in 10 units
in the Boy Scouts are chartered to faithbased organizations.
In response to a request for comment
from the Washington Blade, the Boy
Scouts provided an organizational
statement maintaining the issue of
allowing openly gay scouts to participate
in the organization is a complex one.
Scoutings review confirmed that
this remains among the most complex
and challenging issues facing the BSA
and society today, the response reads.
Even with the wide range of input,
it is extremely difficult to accurately
quantify the potential impact of
maintaining or changing the current
policy. While perspectives and opinions
vary significantly, parents, adults in the
Scouting community, and teens alike
tend to agree that youth should not be
denied the benefits of Scouting.
According to recent polls, a majority
of the American public wants the Boy
Scouts to lift its gay ban. A Washington
Post/ABC News poll published on May
9 found that 63 percent back the idea of
allowing gay youth to participate while
56 percent oppose the continued ban
on participation from gay adults.
Asked whether hes confident the
resolution will be approved, Wahls
replied, As a Boy Scout, our motto is
Be Prepared. So were prepared for
any kind of outcome, but we are feeling
really, really good about where we are.
But anti-gay activists are also at work
urging the Boy Scouts to maintain its
policy prohibiting out youths from
participating. An organization called
On My Honor is leading these efforts.
It didnt respond to the Washington
Blades request for comment.

The House rejected state Rep.

amendment that would have converted
all Minnesota marriages to civil unions.
We are being asked to redefine
marriage, state Rep. Kelby Woodard
(R-Belle Plaine) said. We are redefining
today in this bill the definition of
marriage that has been the bedrock of
society for thousands of years.
Neighboring Iowa is among the
nine states and D.C. in which gays and
lesbians can currently marry.

will take effect on July 1, while gays and
lesbians can begin to tie the knot in
Rhode Island on Aug. 1.
Minnesota voters last November
rejected a proposed constitutional
amendment that would have defined
marriage in the state as between a man
and a woman.
We never guessed two years ago
when we had that horrible constitutional
amendment proposed that we would
be here today, Clark said after the
governor signed HF 1054 into law. We
are very blessed to be here.

New AIDS group debuts as NAPWA successor

Pozitively Healthy to be
volunteer arm of HealthHIV
By LOU CHIBBARO JR.
lchibbaro@washblade.com
A newly created national coalition
called Pozitively Healthy will advocate
for people with HIV and AIDS following
the closing in February of the 30-yearold National Association of People
With AIDS (NAPWA), according to the
coalitions organizers.
In a May 10 statement, organizers said
the new coalition will be an arm of the
Washington, D.C.-based national AIDS
group HealthHIV, which will manage the
coalitions finances and infrastructure.
Pozitively Healthys mission is to
ensure the strong independent voice
of the 1.2 million people living with
HIV/AIDS in the United States, the
statement says.
It says the coalition will advocate for
access to quality health care and the
most impactful prevention, care and
treatment services in this era of health
reform implementation.
The statement says organizations,
including the Names Project Foundation
associated with the national AIDS Quilt,
and AIDS-related publications will be a part
of the coalition in addition to individuals.

WASHINGTON BLADE FILE PHOTO BY MICHAEL KEY

Headquartered in Washington,
D.C., the Pozitively Healthy coalition
will develop and drive an advocacy and
education agenda to address issues
impacting People Living With HIV/
AIDS, with special attention to African-

American MSM [men who have sex

with men], women, and transgender
populations, the statement says.
Brian Hujdich, executive director
of HealthHIV, said HealthHIV and
organizers of Pozitively Healthy
are inviting AIDS activists and their
supporters from throughout the country
to apply for membership on a national
steering committee created to set the
coalitions agenda and mission.
He said organizers are also inviting
activists and others supportive of the
coalitions efforts to become members
of the coalition. He said membership
is free. Information about Pozitively
Healthy and a sign-up form to become
a member is available at HealthHIV.org.
Five members of the steering committee,
which had 16 members as of early this
week, are former officials at NAPWA,
including NAPWAs former executive
director and CEO Frank Oldham.
Veteran Washington State AIDS activist
Judi Billings, a former NAPWA board chair,
has been named co-chair of the Pozitively
Healthy steering committee.
David Waggoner, founder and
publisher of the Albany, N.Y.-based
national AIDS magazine A&U, has been
named as the other co-chair.
The prominent role being played by
former NAPWA officials and staffers
prompted AIDS activists and bloggers

Michael Petrelis of San Francisco and

Greg Milward of Wisconsin to raise
concern, saying events leading up
to NAPWAs financial collapse and
bankruptcy took place under their watch.
With creditors owed more than $750,000,
NAPWA filed for Chapter 7 bankruptcy at
the time it announced it was shutting its
doors permanently in February.
Oldham announced his resignation
from his post as NAPWAs executive
director and CEO in October and left
the organization in November before
news of the impending bankruptcy
surfaced. A document filed with the
U.S. Bankruptcy Court in Maryland lists
Oldham as owing NAPWA more than
$80,000 in accounts payable.
Oldham and all other former officials
at NAPWA have declined to comment
on any of the details that surfaced in
the public records associated with the
bankruptcy filing.
Stephen Bailous, NAPWAs former
deputy executive director and a current
member of Pozitively Healthys steering
committee, told the Blade shortly after
the bankruptcy filing that NAPWAs
financial problems stemmed from the
organizations difficulty in raising funds
during the downturn in the economy,
which he said led to a mounting debt.

Gay API leaders meet with Obama

Officials support
inclusive immigration bill
By LOU CHIBBARO JR.
lchibbaro@washblade.com
Two gay men and a lesbian were
among 15 leaders of Asian American
and Pacific Islander organizations that
met with President Obama at the White
House on May 8 to discuss immigration
reform legislation pending in Congress.
The groups headed by the gay male
and lesbian participants at the White
House meeting support including
language in the legislation that would
provide equal immigration rights to
foreign born same-sex partners of
American citizens.
I was proud to share with President
Obama that I was gay and one of many
LGBT Americans who supported him,
said Gregory Cendana, executive
director of the Asian Pacific American
Labor Alliance of the AFL-CIO.
APALA members and coalition

partnerswill continue to mobilize

so Congress passes a comprehensive
immigration reform bill that includes a fair,
just and affordable roadmap to citizenship,
reunites families, including siblings and
same-sex partners, as well as provides
worker protections for all regardless of
status, Cendana said in a statement.
But Cendana and Tom Hayashi,
executive director of the Asian
American group OCA National Center,
were cautious about disclosing whether
their respective groups would agree to
drop the bi-national same-sex couple
provision if they thought it would
prevent the bill from passing.
Miriam Yeung, executive director of
the National Asian Pacific American
Womens Forum, who also participated
in the meeting with Obama, couldnt
immediately be reached for comment.
All three are identified as gay or
lesbian on their respective organizations
websites. Yeung is identified in her staff
biography has having worked for 10
years in various positions at the New
York City Lesbian, Gay, Bisexual &

Transgender Community Center.

I share President Obamas commitment
of keeping commonsense immigration
reform a legislative priority, and he
reaffirmed this during our meeting,
Cendana told the Blade in an email.
We must remind ourselves that we are
at the beginning of a longer legislative
process where we have opportunities
to fight for improvements that reflect
the values and principles of family unity,
inclusion and fairness, he said.
Hayashi told the Blade in a separate
email that while he and the organization
he heads support a gay-inclusive
immigration bill he understands that a
significant political challenge may be
involved in the effort to pass such a bill.
The personal and organizational view
on immigration and other social justice
issues is that we must be ready for a
fight in the long haul and to leverage
from the incremental gains by building
momentum to achieve change, he said.
Chances for passage of a gay-inclusive
immigration bill came under question
earlier this week when Republican

senators threatened to drop their

support for a compromise immigration
measure if Democrats added two
proposed amendments that allow gay
Americans to sponsor their same-sex
partners for residency in the U.S.
Obama has expressed support for
including a same-sex couple provision
in the immigration bill but has hinted
that it may not be possible to obtain the
provision in the current legislation.
[A]s is true with every bill, if there
are things that end up being left out
in this bill, or things that I want to take
out of a bill, but I if its meeting those
core criteria around a comprehensive
immigration bill that Im looking for,
then we go back at it and we fix whats
not there and we continually improve
whats been presented, he said at a
news conference during his May 3 trip
to Costa Rica.
Steve Ralls, a spokesperson for the
LGBT advocacy group Immigration
Equality, said a vote on the bill in the full
Senate was not expected to take place
until the end of June.

Eyes on Schumer in immigration push

GOP says gay inclusion
will kill reform bill
By CHRIS JOHNSON
cjohnson@washblade.com
Sen. Charles Schumer (D-N.Y.) has
become the new focus for LGBT rights
supporters
seeking
gay-inclusive
immigration reform in the wake of
comments he made suggesting he may
not support amendments to include binational same-sex couples in the bill.
The senior senator from New York
is seen as the only uncertain vote
among the 10 Democrats on the
Senate Judiciary Committee for two
amendments that would enable gay
Americans to sponsor their partners for
residency in the United States.
Steve Ralls, a spokesperson for the
LGBT group Immigration Equality,
said late last week that it has become
crystal clear that the fate of these
amendments proposed by Senate
Judiciary Committee Chair Patrick
Leahy (D-Vt.) now rests entirely with
Schumer because his vote is needed to
have majority support in committee.
Sen. Schumer will determine if our
families have the 10th vote they need,
Ralls said. If he fails to offer that vote to
Senator Leahy, and the chairman in turn
cannot offer the amendment, it will be
his fault, and his fault alone, that LGBT
families are left behind.

Schumer
wouldnt
commit
to
supporting gay inclusion in immigration
reform when speaking with reporters on
Capitol Hill last week even though hes
a co-sponsor of the Uniting American
Families Act on the basis that he
thought their inclusion would derail the
larger legislation. His office didnt respond
to the Blades request for comment on his
position on the Leahy amendments.
According to Buzzfeed, Schumer said,

Im not going get into speculatives.

I would very much like to see it in the
bill. But we have to have a bill that has
support to get [the language] passed.
Thats the conundrum.
A member of the Gang of Eight
that produced the base immigration
bill, Schumer appears to be wavering
amid threats from Republican members
of the gang including Sens. Jeff
Flake (R-Ariz.) and Marco Rubio (R-Fla.)
who threatened to kill reform if the
amendments are included.
Ralls noted that Schumer voted
in 1996 for the Defense of Marriage
Act, and said a vote in favor of the
amendments would make up for that
anti-gay action.
In 1996, Senator Schumer cast a vote
in favor of DOMA, Ralls said. Now,
he has the option of cleaning up the
disastrous mess he helped make. He
has so far chosen, instead, to deliver our
oppositions talking points for them.
Leahy filed two amendments earlier
this week that would incorporate samesex couples as part of immigration
reform. One is along the lines of the
Uniting American Families Act, which
would enable gay Americans to sponsor
their foreign partners for residency
in the country, while the other would
be restricted to bi-national same-sex
couples who are married. The two
amendments are among the more than
300 that are on the table.
Fred Sainz, vice president of

communications for the Human

Rights Campaign, was more confident
Schumer would cast a vote in favor of
gay-inclusion if the amendments were
brought to a vote.
If Chairman Leahy offers either
amendment he filed, and given Sen.
Schumers long record of supporting
LGBT equality, we would expect the
senator to support either of them,
Sainz said.
Meanwhile, Senate Republicans in the
committee seem united in suggesting
that including the amendments as part
of comprehensive immigration reform
would be unacceptable.
Sen. Orrin Hatch (R-Utah), a member
of the Senate Judiciary Committee, said
on Thursday during a brief interview
with the Washington Blade on Capitol
Hill their inclusion would kill the bill.
Youve got to have a bipartisan,
heavy majority in the Senate to be able
to get this bill, and that would make it
very difficult, Hatch said.
Asked whether hed vote no on
the amendments, Hatch replied he
hopes Leahy doesnt bring up the
amendments.
If we can change the bill effectively,
so that it will work, I would like the bill
to go through, Hatch said. I dont
want to stop it. I have amendments
that would stop the bill, too, but Im not
going to bring them up.

company Flair! with his partner of more

than 23 years, Eric Engelhart, noted he
saw an increase in inquiries from gay
and lesbian couples in the months after
Delawares civil unions bill took effect
in January 2012. He told the Blade he
expects the same interest in weddings
once the states same-sex marriage law
takes effect.
I suspect we will see more in the next
few months, Beagle said. Im certain
there is a segment of the population
that feels more strongly about marriage
than a civil union.
Gov. Jack Markell on May 7 signed his
states same-sex marriage bill into law
after the state Senate approved it by a
12-9 vote margin.
Gays and lesbians can currently marry
in neighboring Maryland and eight
other states and in D.C.

Same-sex marriage laws in Minnesota

and Rhode Island will take effect on
Aug. 1 after Govs. Mark Dayton and
Lincoln Chafee signed their respective
states bills into law. The Illinois House
of Representatives in the coming weeks
is expected to consider a measure
that would allow nuptials for gays and
lesbians in the Land of Lincoln.
Same-sex
marriage
opponents
continue to highlight several cases
of business owners who have faced
lawsuits because they refused to
provide services to same-sex couples
who seek to tie the knot. These include
Barronelle Stutzman, a Richland, Wash.,
florist whom state Attorney General
Bob Ferguson sued last month after she
would not sell flowers to a gay couple
for their wedding.
The Alliance Defending Freedom
continues

Elaine
Huguenin, a New Mexico photographer

against whom a lesbian couple filed

a complaint with the states Human
Rights Commission after she refused
to photograph their commitment
ceremony based on what she described
as her religious beliefs. The Arizonabased organization also defended
owners of the Wildflower Inn in
Lyndonville, Vt., whom two New York
women sued after they refused to host
their wedding reception.
The innkeepers last August paid $10,000
to the Vermont Human Rights Commission
and placed $20,000 in a charitable trust to
settle the couples lawsuit.
The Williams Institute said after Markell
signed his states same-sex marriage
bill into law that nuptials for gays and
lesbians could generate an additional $7
million for Delawares economy. It added
same-sex marriage could generate an
estimated 36 jobs in the state.
Those states that have approved

same-sex marriage are already seeing

positive economic benefits, Williams
Institute Research Director M.V. Lee
Badgett said. As Delaware becomes
the 11th state to extend marriage to
same-sex couples, they will begin to see
the economic benefits that other states
are experiencing.
Carol Everhart, president of the
Rehoboth Beach-Dewey Beach Chamber
of Commerce, said she has not seen an
increase in wedding-related inquiries
since Markell signed the same-sex
marriage bill, but stressed it is possible.
Beagle
noted
the
growing
momentum in support of nuptials for
gays and lesbians across the country
has become increasingly difficult for
wedding-related businesses to ignore.
Three states have passed it in
10 days, he said. I think forwardthinking businesses are seeing it as an

Expectations high as Supreme wait continues

CONTIN U ED FRO M PAGE 01

lawsuit that resulted in a change only

in Massachusetts. Still, theyre similar in
terms of their potential significance.
Two attorneys who made arguments
before the courts in the decades-old
lawsuits in the Goodridge case, Mary
Bonauto, civil rights director for Gay &
Lesbian Advocates & Defenders, and, in
the Lawrence case, Paul Smith, a partner
at Jenner & Block acknowledged the
magnitude of the cases both then and now,
but said its hard to compare the significance
of the older ones to the newer ones.
Smith said we wont know the
significance of the DOMA and Prop 8
cases until the Supreme Court rules on
them, but touted the Lawrence decision
striking down sodomy bans across the
country as significant in any event.
It provided the foundation for all the
progress that has been made on marriage
and other forms of discrimination over the
past 10 years, Smith said. It did that by
establishing that our relationships are just
as important and valuable as differentsex relationships and by saying that
the government cant use morality as a
justification for interfering with individual
choices about who to love and how. With
those principles in place its very hard for
anyone to come up with a legitimate and
persuasive justification for discrimination
based on sexual orientation.
Similarly, Bonauto said its not really
easy to compare the significance of
the Goodridge case to the Perry and
Windsor lawsuits, recalling the different
cultural climate 10 years ago in which
the Massachusetts case was argued.
In 2003, these waters were largely
uncharted, Bonauto said. There
were zero marriage states, a civil
union system in Vermont, and 36 states
with discriminatory statutes and four
states with amendments. But then, as now,
we were right; right on the constitutional
principles and the utter absence of legal
justifications for this discrimination.
Those court rulings in particular
the Goodridge decision because it was
the first successful case for full marriage
equality in the United States paved the
way for 11 more states to approve samesex marriage over the course of 10 years,
including the legalization of marriage
equality in Minnesota just this week.
Just as observers are parsing
statements from justices now in an
attempt to determine what the court
may rule on Prop 8 and DOMA, followers
of the court cases a decade ago were
also trying to predict the future based
on what was said during oral arguments.
In Lawrence, Smith said moderate justices
at the time Associate Justice Anthony
Kennedy and then-Associate Justice Sandra

Day OConnor were uncharacteristically

quiet, making it difficult to predict how the
court would rule.
But we took hope from the fact that
they didnt say anything negative,
Smith added. We were relatively
optimistic that the court would strike
down the sodomy laws once the court
decided to take the case.
For Goodridge, Bonauto said the wait
was different from now in two regards:
first because same-sex marriage wasnt
legalized anywhere in the country at the
time, and second because there was no
set timeline for when the Massachusetts
Supreme Court had to make a decision.
We thought and hoped we were right
on the timing, Bonauto said. There
were a lot of nerves and uncertainty
while we waited. The fact that we didnt
know when the decision would come
no clue at all added to the nerves
and fueled the rumor factory. In the end,
the decision turned out to be beautifully
written and world-changing.

In the present, many observers believe

that the Supreme Court will issue a
decision that will strike down DOMA on its
merits either based on equal protection
or federalism grounds although issues
of standing were examined.
For Prop 8, much attention has been
given to justices interest in the standing
of Prop 8 proponents to defend the
measure in court. A determination that
they lack standing would leave in place a
lower court ruling and likely invalidate the
ban on same-sex marriage in California.
The standing issues before the
Supreme Court, as Bonauto noted, also
means the wait for Goodrige was different
because the Massachusetts Supreme
Court couldnt rule on this basis.
There were no outs, Bonauto said.
They had to decide whether denying
marriage to gay couples violates the
Constitution of the Commonwealth or
not. And I was asked very specifically
in oral arguments about Vermont civil
unions and a remedy that would provide
those protections, and I said, That was
not what the plaintiffs were seeking; they
were seeking access to marriage itself.
Notably, the oral arguments in
Lawrence v. Texas took place on March
26, 2003, which is exactly 10 years to
the day that oral arguments took place
in the Prop 8 case on March 26, 2013.
A ruling was issued in the Lawrence
case on June 26, 2003 just as a ruling
is expected in the Prop 8 and DOMA
cases in June 2013.
In the Goodridge case, oral arguments
took place before the Massachusetts
Supreme Court on March 3, 2003, but a
decision wasnt rendered until Nov. 18, 2003.
It remains to be seen whether the
wording of rulings from the Supreme
Court will have the same power as the
language that justices handed down
a decade ago. The 4-3 ruling in the
Goodridge case affirmed that samesex couples had the right to marry with
never before seen language.
The question before us is whether,
consistent with the Massachusetts
Constitution, the Commonwealth may
deny the protections, benefits, and
obligations conferred by civil marriage
to two individuals of the same sex who
wish to marry, the decision states.
We conclude that it may not. The
Massachusetts Constitution affirms the
dignity and equality of all individuals.
In the Lawrence case, the 6-3 opinion
written by Associate Justice Anthony
Kennedy determined that the framers
intended language in the U.S. Constitution
to be reinterpreted by later generations in
accordance with their vision of liberty.
They knew times can blind us to
certain truths and later generations

can see that laws once thought

necessary and proper in fact serve only
to oppress, Kennedy wrote As the
Constitution endures, persons in every
generation can invoke its principles in
their own search for greater freedom.
Also unknown is how the public
might react if the Supreme Court issues
affirmative rulings for marriage equality
in the Prop 8 and DOMA cases.
In 2003, the court ruling in
Massachusetts combined with thenSan Francisco Mayor Gavin Newsoms
decision to issue marriage licenses to gay
couples sparked a national backlash
that led in the next year to 11 states
passing constitutional amendments
banning same-sex marriage. Former
President George W. Bush ran a
successful re-election campaign in
which he advocated for passage of a
Federal Marriage Amendment.
But Bonauto was skeptical that the
legalization of same-sex marriage led
to the passage of state constitutional
amendments and Bushs re-election
saying the religious right wanted to enact
the amendments anyway and analysis
shows the marriage issue wasnt as much
a boon to Bush as it may seem on its face.
By the time we had filed Goodridge,
there were already 36 state statutes
and four amendments, Bonauto said.
So, for a lot of these states, they didnt
have anything else to do but to pass an
amendment because they already had
statutes barring marriage. So I really view
this as political opportunism both with
elected officials and also the organized
right-wing. It was trying to cut us off and
change the facts on the ground, so that
they could isolate this debate and isolate
this issue in certain states.
Given the growing acceptance of
marriage equality one widely noted
recent poll shows it enjoys support
from 58 percent of the American public,
compared to 30 percent support in 2003
the negative reaction to any pro-gay
rulings will likely be more restrained.
In the event the Supreme Court
in June renders similarly favorable
decisions in support of rights for gay
couples, Bonauto predicted some
would speak out in opposition, but the
reaction generally would be favorable.
There are going to be people who
are going to say things, and some of
them have echo chambers and bully
pulpits and their blogs, Bonauto said.
I dont think we should equate that
to a backlash. I just think that is what
public discourse is like in 2013. I really
believe that the overwhelming majority
of Americans are at a point where they
accept and embrace the freedom to
marry for same-sex couples.

Ride for the Feast raises $522,000

The just completed two-day, 140-mile bike ride from Ocean City to
Baltimore on May 11-12 raised $522,651 and counting for Moveable Feast.
Since 2003, the event has been one of the principal fundraising sources for
the organization.
About two-dozen teams solicit donations and participate in the ride whose
length of 140 miles coincides with the distance a Moveable Feast driver must
deliver to the farthest client. A record 235 registered riders, 110 volunteers
and thousands of donors participated in this years event.
Moveable Feast is a longstanding Baltimore nonprofit organization that
provides nutritious food for low-income Marylanders living with HIV/AIDS,
breast cancer and other life-threatening conditions at no cost.
I am incredibly proud of my team all 17 riders and four support and gear
and medical staff, David Sackett, team leader for the Shirley Temples, told
the Blade. They slogged through alternating thunderstorms and sunshine
and happily made it safely to complete 140 miles of biking for a great cause.
He said the Shirley Temples raised $50,000, nearly 10 percent of the total.

Baltimore OUTloud celebrates 10 years

Today marks the 10th anniversary of Baltimore OUTloud, one of two
Baltimore-based LGBT newspapers. Mike Chase left his position as editor
of Gay Life, the publication under the auspices of the GLCCB, and along
with other partners formed a group, Pride Media, Ltd., which is the parent
company of Baltimore OUTloud. Several writers and staff who had previously
worked for Gay Life joined the new paper.
We attribute OUTlouds success for the past 10 years to the support from
the communities we serve, our advertisers and talented writers, said Jim
Williams, co-publisher.
The commemorative issue contains a nostalgic look at the past 10 years,
and several of the original writers will be returning.
We are so proud and honored to have reached this milestone, said Jim
Becker, also a co-publisher. It could not have happened without our loyal
advertisers and the incredible hard work and dedication of our staff and
volunteer writers.

An HIV vaccine trial was called off after it was found that 41 of the 1,250 people who received the vaccine
contracted HIV.

HIV vaccination trial

unsuccessful, halted
ATLANTA A national HIV vaccine trial dubbed HVTN-505 (known as Life
Forward in the Atlanta region) has been stopped as an oversight committee has
determined in preliminary results that people were being infected with the virus
despite being vaccinated, Georgia Voice and other media outlets reported. Many
were known to have participated in the Washington area as well.
Participants were notified in late April. Human trials began in 2009. The trial was
being conducted in 19 cities and had more than 2,500 volunteers. All participants
had to be HIV negative, sexually active and circumcised, Georgia Voice reported.
The HIV vaccine trial was funded with $77 million from the National Institute of
Allergy & Infectious Diseases (NIAID), part of the National Institutes of Health. In
March, the trial had just finished enrolling the necessary 2,504 men who have sex
with men and transgender people who have sex with men. Just weeks later the trial
was called off after it was found that 41 of the 1,250 people who received the vaccine
contracted HIV while just 30 of the 1,244 who received a placebo tested positive.
The volunteers are now finding out if they received the placebo or the vaccine.
All will be followed for five years, the Voice reported. Those who received the
placebo are eligible to participate in future HIV vaccine trials.
And there are many future HIV vaccine trials in the works. The Hope Clinic is
currently enrolling in an early phase of a HIV vaccine trial named HVTN 092. So far,
two people are enrolled.

Miami Beach will reimburse insurance tax fees

MIAMI The Miami Beach city commission passed an ordinance that city employees
in domestic partnerships can be reimbursed for taxes paid federally on their partners
health insurance benefits, the South Florida Business Journal reported last week.
In 2004, the Miami Beach commission adopted legislation that affords certain rights
and benefits to qualified long-term, committed couples that have registered with the city.
The bill also applies to straight couples in domestic partnerships. Often in a domestic
partnership situation, only the single persons premium is tax deductible and not the domestic
partner. Married couples are not taxed on benefits for their partner, the Journal reported.

Gays being considered for Obamacare

HOBOKEN, N.J. The U.S. Health and Human Services Office for Civil Rights is
working on details of a plan to show how LGBT Americans will have equal access to
benefits outlined in the Patient Protection and Affordable Care Act (Obamacare), the
Credit Union Times and one of its sister sites Benefits Pro, reported last week.
The Act promises health care regardless of race, color, national origin, disability, age
or gender.
Based on available numbers, the National Academy of Sciences, in a report released
in 2011, agreed that gay and transgender people often face barriers to equitable health
care and receive substandard care when they seek it.
One big variable already identified clearly: While many of those with HIV live in the
nearly 30 states that have either already opted for Medicaid expansion under PPACA or
are in the process of doing so, there are many more who live in states still sitting on the
sidelines, Benefits Pro reported.
Other possible impediments to proper care are being explored, the article said.

Parental notice bill sent back to committee in N.C.

RALEIGH, N.C. A bill restricting teenagers access to medical and mental health care
initially scheduled for a vote in the North Carolina last week was taken off the calendar
and sent back to the Judiciary Committee, LGBTQ Nation reported.
The bill would prohibit youth under 18 from receiving prevention, diagnosis and
treatment information on pregnancy and abortion, STDs, HIV/AIDS, mental health and
substance abuse without the express written and notarized consent of their parent or
guardian, the site reported.
Some LGBT North Carolina activists said the bill would have especially bad ramifications
for gay and trans teens who may be estranged from their parents, the article said.

Gay couples wanting babies flock to Portland

PORTLAND Gay and lesbian couples who want babies are going to Portland from
as far away as France, Israel and more to try to conceive using donor eggs, sperm and
surrogates not allowed in their own countries, USA Today reported last weekend.
A non-profit support network called Men Having Babies says at least 40 percent of the
1,000 couples in the group are European.
The article said the solid reputation of Oregon Reproductive Medicine (known for its
high success rates on egg and sperm donation), Portlands overall gay friendly vibe and
the slightly more reasonable rates for such services (about $90,000 vs. up to $170,000 in
larger cities like New York and Los Angeles) contribute to its destination status.

BUCKY MITCHELL grew up in Pennsylvanias

Amish country and says many of the exercises in
his regimen are derived from the kinds of movement Amish men and women use in their daily
chores. Mitchell, whos gay, believes in a fun,
challenging workout that results in weight loss,
more muscle and a stable core. Find him online
at theamishtrainer.com.

Whether youre doing bicep curls,

squats or crunches, the direction your
body moves in is essential to how much
muscle you can potentially gain or how
much fat you can potentially lose. Its
important to recognize and incorporate
all the bodys planes of motion into your
fitness routine.
Breaking down the three planes:
1. The front to back plane, also referred
to as the sagittal plane, includes exercises
like jogging, chest press and rowing.
2. The side-to-side plane, also
referred to as the frontal plane, includes
exercises like jumping jacks, side lunges
and lateral raises.
3. The twisting plane of motion,
also known as the transverse plane
of motion, included exercises such as
medicine ball wood chops, Russian
twists or rotating cable pulls.
When Im training at the gym, I often
notice people who consistently repeat
the same exercises in the same plane.
Unfortunately for them, moving in the
same plane is not helping them reach
their fitness goals as effectively as they
could if they were moving in all three
planes of motion. Heres why.

The body adapts very quickly to

the movements we create for it and
therefore, it doesnt have to do as much
work or exert as much energy to the rip
the muscle (tearing the muscle fiber) or
to burn the fat during exercise.
For instance, do you do traditional
dumbbell bicep curls in the front to
back motion every time you come to the
gym? If so, youre probably not working
the muscle as effectively as you could be.
After a few weeks your body will adapt
to this pattern and your muscle will stop
growing as quickly. Therefore, you should
mix up your bicep curls by doing them
from the side or by rotating your wrist
outward at the top of your bicep motion.
In addition, you could mix up your cardio
and burn more fat and calories by adding
in some jumping jacks at a fast tempo for
two minutes without stopping.
A great way to get yourself out of your
comfort zone and to get yourself moving
in these different planes of motion is by
writing down your exercises before your
workout and labeling each exercise with
the planes of motion listed above. For
instance, bicep curls would be labeled
with front to back plane, while jumping
jacks would be labeled with side-to-side
plane and medicine ball wood chops
would be labeled with twisting plane.
The visual of you having to write it down
will help you increase your likelihood of
trying and integrating new movements
into your workout.
Ive included a great set of sample
exercises for you try in all three planes:

Know the facts

about Hepatitis
Gay, bi men should
seek vaccinations

Dr. RAY MARTINS is chief medical officer of

Whitman-Walker Health. Reach him via wwc.org.

May is Hepatitis Awareness Month.

And the LGBT community, particularly
gay and bisexual men, can be at greater
risk for infection with viral hepatitis.
The good news is that there are simple
steps to take to prevent yourself from
acquiring viral hepatitis.
First, a few facts: Hepatitis refers
to an inflammation of the liver, often
caused by a virus. In the U.S., the most
common types are Hepatitis A, B and
C, all caused by different viruses and all
with different modes of transmission.
Hepatitis A is an acute infection and
usually lasts no more than six months.
Hepatitis B and C can begin as acute
infections and then develop into chronic
infections. About 15-25 percent of people
with chronic Hepatitis develop serious
liver conditions, including cirrhosis, liver
failure and liver cancer.
According to the CDC [e]ach year,
about 70,000 Americans become infected
with one type of acute viral hepatitis. In
addition, an estimated 1.2 million people
have chronic Hepatitis B, and 3.2 million
people have chronic Hepatitis C. Of those
living with chronic hepatitis, many do not
know they are infected.
Gay and bisexual men account for 10
percent of new Hepatitis A cases and 20
percent of Hepatitis B cases each year
and are at increased risk for Hepatitis C
if they engage in high-risk behaviors.
Hepatitis A is spread through
ingestion of fecal matter. Direct oralanal sexual contact or contact with
fingers or objects that have been in or
near the anus of an infected person.
Hepatitis B infection can occur when
the body fluids of an infected person,

Hepatitis C is a blood-borne infection.
Sharing needles or other injection drug

person to the virus. Hepatitis C can also be
transmitted sexually, although no one is

Homophobia lives on but

those who express it out loud are
bullied into apologizing,
their very careers dependent upon
pretending they really like us.

KEVIN NAFF is editor of Washington Blade and

can be reached at knaff@washblade.com.

When the NBAs Jason Collins came out

last month in a Sports Illustrated column,
he found cheery public support from nearly all quarters. Everyone from Bill Clinton
to Steve Nash tripped over themselves to
congratulate Collins on becoming the first
openly gay active (male) player in one of
the big four American team sports.
But the happy, politically correct mainstream reaction to the momentous news
barely concealed what was happening just
beneath the surface of George Stephanopoulos and Oprahs giddy coverage.
Anyone who tuned into talk radio or
Twitter that day heard a very different
take on Collins brave announcement.
Miami Dolphins wide receiver Mike
Wallace Tweeted, All these beautiful
women in the world and guys wanna mess
with other guys SMH.
Mark Jackson, head coach of the
Golden State Warriors, said: As a Christian man I have beliefs of whats right
and whats wrong, that being said, I know
Jason Collins, I know his family And

V O L U M E 4 4 I S S U E 2 0

certainly praying for them at this time.

Sportscaster Chris Broussard denounced
Collins as a sinner.
CBS Mike Francesa said, It means less
than nothing to me that there is a gay player now out if the NBA. SI going to reveal
this this week in I dont know why I
guess a dramatic attempt to sell a magazine, I guess. I have the story here and Im
not compelled to run and talk about it or
read it. I really dont care. I cant be any
more honest. I dont care.
This was the most typical sports talk radio take on the news. While most callers
wanted only to talk about Collins and the
specter of gays sharing the shower and
locker room with straight jocks, the talk
radio hosts wanted to change the subject.
Monitoring sports radio in the Baltimore
and D.C. markets that day, I was amused
as the hosts desperately tried to change
the subject away from the biggest sports
story of the week, no doubt fearing for
their jobs if they publicly agreed with their
callers homophobic fears. Weve arrived

/",

at a strange new place in the movement

for LGBT equality where homophobia lives
on but those who express it out loud are
bullied into apologizing, their very careers
dependent upon pretending they really
like us.
No one typifies this strange new world
better than Kobe Bryant, who chimed in
with a supportive Tweet, Proud of @jasoncollins34. Dont suffocate who u r because
of the ignorance of others. Just two years
ago, Bryant was fined $100,000 by the NBA
for calling a referee a faggot during a
game. His team, the Los Angeles Lakers,
promptly announced a partnership with
the Gay & Lesbian Alliance Against Defamation to combat bullying. GLAAD said
at the time it would advocate for zero tolerance policies for anti-gay slurs at home
games. Its not clear what that means but
it sounds like a dubious mission for a national LGBT advocacy group.
Pretending that homophobia died because a dozen states enacted marriage
equality ignores the facts and the reality
of a nation still deeply divided over LGBT
issues. Remember that there are no laws
prohibiting workplace discrimination on
the basis of sexual orientation in 29 states
(and in 34 states based on gender identity); we account for only about 4-5 percent
of the population but 20 percent of hate
crimes target LGBT people; 40 percent of
homeless youth identify as LGBT; 63 percent of all new HIV infections are among
men who have sex with men, up 22 percent since 2008; sodomy laws remain on
the books in 17 states, including Maryland
and Massachusetts; the FDA still bans gay
men from donating blood; immigration
law ignores our relationships; DOMA and
Prop 8 remain on the books; an estimated
28 percent of black trans people are unemployed. And on and on.
The support for marriage equality and
the public embrace of gay celebrities
masks the reality of a nation in which too
many LGBT people continue to suffer because of old-fashioned bigotry and prejudice. Dont believe the pro-gay hype.

Time for D.C. to extend bar hours year-round

Experiment on limited
dates proves successful,
tax revenue swells

MARK LEE is a long-time entrepreneur and

community business advocate. Follow on Twitter: @
MarkLeeDC. Reach him at OurBusinessMatters@
gmail.com.

Its now time for the D.C. Council to

review the results of the decision a year
ago to extend operating hours and alcohol service at hospitality establishments
by one hour, limited to specific holiday
dates to mollify the objections of some.
The partial extension was undertaken
with the understanding that the policy
would be evaluated for possible expansion after an initial trial.
The results of that self-identified experiment are now known and discussion of the Districts budget for the fiscal
year beginning Oct. 1 has begun. Based
on the benefits, the Council should
move forward to approve a year-round

expansion of the law.

A vocal minority opposing Mayor
Vincent Grays original proposal were
most vociferously represented by Council member Jim Graham. Graham was
also the lone vote against a compromise to initially restrict the policy to the
night before all 11 federal and D.C. holidays as well as Friday through Sunday
preceding Memorial Day and Labor Day
and when New Years Eve and July 4th
fall on a Monday.
Theres a lesson to be learned from
the introduction last week by Council
member Mary Cheh of legislation to impose a whopping 40 percent increase in
sidewalk caf public space rental fees.
The measure, publicly endorsed by Graham, was in stark contrast to the widely
held notion that tax and fee increases
are inappropriate in a city with some of
the very highest rates nationwide. D.C.
Mayor Vincent Gray, through a spokesperson, opposed Chehs proposal, emphasizing that it violated his popular
pledge of no new taxes, fees or fines.
Following overnight pushback from
hospitality businesses, Cheh withdrew
the provision the next day. Since she
hadnt even discussed in advance her
proposed fee increase with those affected, as is her signature tactic, the quick
smack down was as delicious as any meal

enjoyed al fresco on a restaurant patio.

Setting aside Chehs propensity for
ever-larger extraction of monies from
local businesses combined with her
ceaseless creation of costly new mandates, a simple question emerged.
Why would she and Graham promote
an additional hospitality industry burden generating only a few hundredsof-thousands in city fees when a much
larger goldmine of money lies sitting
on the table for the taking?
In early April, D.C. CFO Natwar Gandhi
reported that revenue from alcohol sales
had climbed by seven percent during the
first half of the fiscal year. A spokesperson
for the bean-counter-in-chief advised that
the increase was primarily attributable to
limited longer bar hours.
During Council debate last spring regarding the modest one-hour proposed
extension in the maximum service period at District bars, restaurants, nightclubs and hotels, Metropolitan Police
Department Chief Cathy Lanier testified
there were no public safety or police
performance obstacles recommending
against adoption. That assertion has
proved true with trouble-free results.
Perhaps most compelling are nightlife venue operators urging an all-thetime implementation of extended
hours until 3 a.m. Sunday through

Thursday and 4 a.m. on weekends

motivated by an indirect benefit.
Ask nightlife entrepreneurs in entertainment districts what single policy
change would most improve their
ability to provide problem-solving operational management to discover the
universal response uniform extension
in the allowable service period.
Despite Grahams refusal to embrace
experiences elsewhere utilizing extended operating hours as a proven strategy
to reduce the inherent pressures of simultaneous forced egress of thousands
of patrons in popular nightlife areas, it
works in the intuitive real-world ways
expected. In fact, hospitality businesses
often close earlier than permitted on
current later-hour dates due to patrons
having progressively departed in a manner similar to how they arrived. Venues
are less concerned on those nights
about post-event crowd control issues
occurring on city streets and affecting
surrounding areas.
Washington can enhance local entertainment amenities and cement the
citys growing status as a dynamic worldclass locale while also securing its financial footing.
The D.C. Council should act to approve a consistent and commonsense
year-round policy.

After 30 years, still summering in Rehoboth

Resort town teeming with
gay-friendly businesses

PETER ROSENSTEIN is a D.C.-based LGBT rights

and Democratic Party activist. He writes regularly for
the Blade.

Memorial Day is the official start of summer and that means crowds in Rehoboth
Beach, Del. This will be one of the busiest
years ever at the Delaware beaches because
of the havoc created by Hurricane Sandy on
the Jersey and New York shoreline. All of us
want those communities to rebuild but in
the meantime Rehoboth can expect a new
crowd of summer tourists.
For more than 30 years, Rehoboth has

been my choice for summer vacation and

for the last 15, Ive owned a small home
there. The town has grown up in that time
and is now a year-round place to live. But
summer is still the time when business owners have to make their year. This will be a
good year for them.
Like many, I spend a great deal of my
time in Rehoboth on Baltimore Avenue, the
gayest block in town. You can eat breakfast,
lunch and dinner; do your shopping; and go
to happy hour and late night dancing all on
the same block.
As always there are new places opening and one of note this year is Frank and
Louies Italian Specialties at 58 Baltimore
Ave. Frank and Louie are known to many
as the nice guys from Touch of Italy but they
are now on their own. Their shop is welcoming and their secret weapon is mom who is
a fantastic chef and baker. I recently tasted
her lasagna at a small dinner party and it
was delicious. I recommend you stop in and
try their full range of Italian specialty items

including great sandwiches, cheeses and

baked goods and then call them to cater
your parties.
The Blue Moon (35 Baltimore Ave.) is
all spruced up for its fourth decade. They
have a new bar and newly tiled floors and a
sound system in the bar and chef extraordinaire Lion Gardner is still at the helm in the
dining room. The bartending staff includes
Chandler and Matt, who always remember what youre drinking. Pamala Stanley
will again be ensconced there Sundays
through Thursdays. There is the always fun
Aqua Grille (57 Baltimore Ave.) and everyone always waits for the unveiling of their
new bar staff. Bill Shields never disappoints
with his hires. There is nothing as nice as
happy hour on the Aqua deck on a mild
Rehoboth evening and after a few drinks
being lazy and staying for a casual, good
and very reasonably priced dinner. This
year you should also try the newly expanded and upgraded Maggio and Shields
Caf on the mezzanine (70 Rehoboth Ave.).

They have great new comfortable seating

and the chef and some staff from the now
closed Cloud 9.
One of the fun places to shop on Baltimore Avenue is Universal Gear, owned by
David Franco. The Universal Gear stores just
celebrated their 20th anniversary. Part of the
fun of shopping at Universal Gear is chatting
with manager Denis Dmitriev. Denis spent
the winter working at VIDA in D.C. building
both his body and modeling portfolio.
Other places not to miss are on Rehoboth Avenue. The Purple Parrot for a
good meal and happy hour, the back beach
bar and karaoke make it fun any time day or
evening. Look into Gidgets Gadgets for fun
retro toys and games and stop at the Coffee
Mill for a good cup of coffee or a pound of
your favorite beans.
If you have been to Rehoboth Beach
you know how great it is and if you havent
make sure that the summer of 2013 will
be your first trip there. You will return time
and time again.

Poetry makes connections between cultures

Gay inaugural poet to
speak at Split This Rock

Kathi Wolfe is a writer, poet and regular

contributor to the Blade. She can be reached
through this publication.

Mention poetry, and, unless youre a

poet, memories of dull high school English
classes (think only God can make a tree
from Trees by Joyce Kilmer) or images of
recluses reciting their poems while floating
in the clouds will likely come to mind. W.
H. Auden, a gay, great, non-reclusive poet,
famously said that poetry doesnt legislate.
No matter how good, a poem, by itself,
wont end poverty or bigotry.
Yet, despite its limitations and negative
cultural baggage, poetry rocks today! On
Sunday, Split This Rock (SplitThisRock.org),
a D.C.-based, national poetry organization

that works for social change will celebrate

its fifth anniversary at a gala featuring Richard Blanco, the poet of Obamas 2013 inauguration. At the event, Blanco, the first
openly gay man and Latino, to be a presidential poet, and Grace Cavalieri, host of
the public radio show The Poet and the
Poem, will discuss what it was like behind
the scenes at the inauguration. Blanco, a
son of Cuban immigrants and the author of
three poetry collections including Looking for the Gulf Motel, who lives with his
partner Mark in Bethel, Maine, will read
from his work and the DC Youth Slam team
will perform at the gala.
Since its founding, Split This Rock has
been a haven for progressive poets
from youth to elders to people of color to
LGBT folk to people with disabilities. Trying to do what you can to enhance social
change is seldom easy. Embracing differences can be difficult. Yet, as a legally blind,
queer poet, Im one of many (from straight
men to teens) who have found STR to be
one of the most LGBT friendly, genuinely
diverse communities in which to do the
hard work of making poetry and fighting
for social justice.

When we founded Split This Rock,

we were deeply honored when the brilliant lesbian feminist poet and activist
Adrienne Rich wrote to us, Thank you
for your belief in the freeing power of
language and action, Split This Rock
director Sarah Browning e-mailed the
Blade. LGBT poets like Richard Blanco
create freedom by... telling the truth
about their lives.
Queer courage lights the way within the
progressive poetry movement, guiding all
of us to a new world based on justice and
beauty, Browning said.
You dont have to live in the clouds,
teach or even have an M.F.A. degree to be
a poet, but you need to be talented and
brave. Anyone can use language, Cavalieri,
a poet and playwright, e-mailed the Blade,
but to become a poet, language must
use courage.
Blanco, who earned an M.F.A. degree in
creative writing from Florida International
University and received the Beyond Margins Award from the Pen American Center
for his collection Directions to the Beach
of the Dead, is a talented and courageous
poet. At the barricades of society, Blanco

didnt set out to become an inaugural

poet, Cavalieri said. He just began writing to tell his truth with as much detail and
invention as the heart could hold.
In his youth, Blanco was discouraged
from being queer. Stop eyeing your
mothers Avon catalog/ and the mens underwear in those Sears flyers, he writes in
his poem Queer Theory: According to my
Grandmother, ...Avoid hugging men,
but if you must/pat them real hard on the
back, even/if its your father.
Poetry has the power to galvanize people because it brings out our humanity in
ways that other genres dont, Blanco said
in a telephone interview with the Blade. I
see poetry as a kind of mirror in which everyone can see themselves.
Why is there a disconnect between
poetry and many who arent poets? Because ... people arent taught enough contemporary poetry, Blanco said. I went all
through college without reading contemporary poetry.
Poetry makes connections between cultures, Blanco said.
Dare to see yourself in the mirror of poetry. Check out Split This Rock.

Spared Sandys wrath, beach resort expected to draw more visitors

By PETER SCHOTT
Virtually unscathed by the effects of Hurricane Sandy, all indications are this
summer will be a busy one in Rehoboth Beach, Del. And with the arrival of marriage
equality in the state, locals are also expecting a busy summer of beach weddings.
Beach replenishment and flood control projects should be concluded by Memorial
Day. The Chamber of Commerce reports that summer rentals to date are running at
least 30 percent above last year and businesses are preparing for an influx of new
visitors headed farther south this year following the damage to some New York and
New Jersey-area beaches.
John Glenstrup, an owner of the gay bar Rigbys on Rehoboth Avenue, said that
in addition to visitors coming here from the New Jersey and New York beaches,
people feel more secure about the economy as gas prices fall, employment is up,
and the housing market is improving.
With an increase in visitors and traffic, gay City Commissioner Patrick Gossett
noted that the ParkMobile system, which was introduced last year, will be used again
this year. Pre-register at parkmobile.com or by calling 877-727-5758.
Gossett also said that this year the city will experiment with providing 180 parking
spaces for scooters at several locations around the city. Permits for scooter use
and parking passes are available at the Parking Meter Division located behind the
Convention Center.
The Blue Moon (35 Baltimore Ave.) begins its 32nd summer with a remodeled
front bar and Pamala Stanley returns Memorial Day weekend through the summer,
Sundays through Thursdays 6-8:30 p.m. Cloud Nine closed in 2012 and was set to
be demolished, but the Cape Gazette reported that it has been spared the wrecking
ball for now and has been rented for the summer. Aqua (57 Baltimore Ave.), with
its scantily attired servers, returns for another season this weekend. The L Bar (622
Rehoboth Ave.), Rigbys (404 Rehoboth Ave.) and Big Sissies (715 Rehoboth Ave.)
are all thriving. The gay-owned Purple Parrot (134 Rehoboth Ave.) is celebrating its
15th anniversary and the outdoor Biergarten has reopened.
The Frogg Pond (First and Rehoboth Avenue) has been renamed The Pond.

Lesbian-owned establishments include Loris Caf (39 Baltimore Ave.), now in its
17th season, Rehoboth Ale House (15 Wilmington Ave.), Seafood Shack (42
Baltimore Ave.), and Charcoal Grill, located in the Food Lion Shopping Center on
Route 1. Gelato Gal has moved and now also serves barbeque. It is located on
Route 1 at Bay Vista Road.
Just before Memorial Day last year, Modern Mixture (62A Rehoboth Ave.) was
opened by Leo Cabrera, popular server formerly at Mariachis. Its food is a fusion of
Mexican, Mediterranean and Asian selections and it just got its liquor license this year.
The owners of Aqua have opened a caf, Maggio and Shields, on the second
level of First Street Station located at the corner of Rehoboth Avenue and First
Street, and the owners of the Pond have MIXX (26 Baltimore Ave.). The new Lingos
Market is scheduled to open Saturday in the Village by the Sea Mall. Gay-owned
Universal Gear (46 Baltimore Ave.) has already opened for the season. If you like
Italian food, check out the new Frank & Louies Italian Specialties (58 Baltimore
Ave.) and a new Touch of Italy is rumored to (finally) be opening on Route 1 near
Nage by Memorial Day.
Of course, Rehoboth is not only about eating and drinking. There are lots of other
activities and many businesses throughout the city that are LGBT owned or friendly
to the community.
There will be numerous events throughout the area all summer, including a
monthly Art Walk, shows at Clear Space Theatre on Baltimore Avenue and readings
at Proud Bookstore (Baltimore Avenue at the Village by the Sea Mall).
As Rehoboth Beach has become a more popular place to live, play and shop,
not all of the activities are restricted to downtown. You can find plenty of outlet
shops, restaurants, the Midway movie theater and specialty stores along Route 1,
also known as Coastal Highway.
Several events will be sponsored by CAMP Rehoboth, the local gay and lesbian
community center. They now have a theater attached to the Center (37 Baltimore
Ave.). The popular Rehoboth Foodie blogger now has an app Rehoboth in my
Pocket for your iPhone or Android devices.
The main two beaches that attract an LGBT crowd are Carpenters Beach (better
known as Poodle Beach) at the south end of the Boardwalk or Gordons Pond in
Cape Henlopen State Park, north of the city.

Holly Goldmann says she cant stay serious for more than a few minutes

While she likes being a board member at The Center, she says the
meetings can be tedious.
After an hour, yeah, Im like OK, lets wrap it up here, she says with
a laugh.
Her work with Capital TransPride over the past three years got her
noticed by The Center, whose staff was looking for trans representation
on its board. Shes happy to serve but says shes really bad at being

Gay music legend noted

for remixes, production
and innovation
By JOEY DiGUGLIELMO
joeyd@washblade.com
Angelo Russo knew something was
wrong in March when several days went
by without hearing back from his friend
and client, legendary producer/DJ/
remixer Peter Rauhofer.
We sometimes talked five or six
times a day so when I didnt hear back
from him, yeah, it sent up the red flags,
Russo says. The only time I didnt hear
from him was if we were fighting and of
course we fought. The closer you are,
the more you fight with someone. But
yeah, back in March, we were fine. I was
speaking to him one day, then a couple
days went by and eventually we had 911
break into his apartment.
Russo says Rauhofer, whom hed
met at a music conference in 2000 and
had managed since 2006, was barely
conscious having suffered a seizure.
Hospitalized at St. Lukes-Roosevelt
Hospital Center in New York, the
prognosis was grim. Rauhofer, who was
gay, had a malignant brain tumor that
had gone undiagnosed long enough to
have grown significantly. Russo (also gay)
says doctors said its position on the brain
made it inoperable. They tried a round
of chemotherapy that was unsuccessful.
On April 29, Rauhofer turned 48 in the
hospital. He died May 7.
Russo says it may have been a bit of a
blessing in disguise. Had the Grammywinning music legend, who remixed hits
for Cher (Believe), Madonna (Nothing
Fails, 4 Minutes et. al.), Janet Jackson
(Throb), Britney Spears (Toxic) and
scores of other artists, responded well
to chemo, it may have left him with
diminished mental faculties.
There was a possibility at one point
that if it had worked, he may only have
had the mental capacity of a 5 year old,
Russo says. He would have been so
unhappy but how can you tell his mom not
to try. So they tried but it didnt work.
When they came back and said there was
nothing more they could do, I was hoping
he wouldnt have to lay there and suffer
too long. He was not about suffering. He
was about being able to be happy and
bring joy to people. Thats what his career
was all about parties and music. If he
wasnt able to do that, then Im happy it
didnt go another route.
Rauhofers mother Helga, who visited
from their native Austria for her sons
final days, is executrix of his estate. He
will be interred in Austria. A candlelight

PETER RAUHOFER`i`>ii i9>Vi>iLiiiLii`vi`}iV>`L`iVi>

vigil was held last weekend in Miami. A

public memorial is planned for New York
Pride next month. Friends in New York
are also planning a private memorial
service there, where hed lived since
about 1996. Check Rauhofers Facebook
page for details on public events.
The gay club/music world responded
with shock and sadness at Rauhofers
untimely death.
I dont use this term loosely, but he was
a musical genius, says gay DJ/remixer
Joe Gauthreaux. He never got stuck in
one sound and stayed there, thats why his
mixes always resonated. He was always
doing something different and trying to
grow. He never did the same remix twice.
He was always trying different sounds.
There really was nobody like him.
Gauthreax also says he was a huge
Peter fan, huge.
He was one of the remixers that,
from a DJ standpoint, I would always
be so excited about. It was usually his
mix that was quote-unquote the one. So
from that standpoint, this is very hard to
take just knowing that theres not going
to ever be another Peter Rauhofer mix
to come in and save the day.
Tori Amos, who had a No. 1 Billboard
dance hit in February with Rauhofers
remix of her song Flavor, said in
a statement that he truly captured
the spirit of the song and that shell
always hold a very special place in my
heart for Peter.
Local gay nightclub impresario Ed
Bailey, who hosted Rauhofer twice at

Velvet Nation in the early 00s, says

Rauhofers work epitomized the era.
His music, his production and his
remixes, were kind of not exclusively but
almost like the overwhelming soundtrack
of the big clubs and circuit parties for the
whole decade from about 2000 to 2010,
Bailey says. Hes widely revered as that
amazing one of all the amazing people
who helped shape an entire kind of era in
club land that for most people, they feel it
was one of the best eras ever. We were very
proud to be able to have him at Nation
and I remember just being mesmerized by
his set.
During a lengthy phone interview
this week, Russo, who started as an
intern at Rauhofers Star 69 label in
2001, shares several memories of their
years working together.
Russo says Rauhofer:
U>`Lii>>i}`i>
prior to the March seizure. He says he
doesnt know of Rauhofer ignoring any
warning signs earlier though he admits
Rauhofer was usually not one to go to
the doctor. He hadnt complained of
headaches or anything, Russo says.
This kind of blindsided me.
U>>`vVVi
his final days. He was able to squeeze
hands of those by his bedside at times.
We dont know how much he heard,
but we gave him an earful. And
although sad, Russo says it was a joy
to share with Rauhofers mother details
of his life in New York, of which shed
previously known little.

some semi-long term boyfriends, but
made it clear work came first for him.
A lot of people just dont have the
patience for that, Russo says. Rauhofer
had not been dating in recent months,
Russo says.
U>`i>vi>i
hits he remixed. Although most of
the remixing work was done without
the artist, Russo remembers Rauhofer
meeting Madonna, for instance, on
multiple occasions. He says Rauhofer
wasnt especially star struck though he
had an obsession with Grace Jones
and always wanted to work with her
but never got the chance. If she had
walked in the room, he might have
gasped, Russo says.
Rumors that Rauhofer could be tough
Bailey says, I dont think its a secret
in the industry that he had a reputation
for being difficult to work with were
mostly a matter of Rauhofers being,
never a diva, but a perfectionist, as
Russo puts it.

Playwright switcheroo subject

of provocative Submission
By PATRICK FOLLIARD
Its as if the play wrote itself. An admittedly
clich thing to say, acknowledges Danny
Larson, a young gay playwright and the
protagonist of Jeff Talbotts new comic
drama The Submission (now at the
Olney Theatre Center).
But after a disturbing exchange with
some African-American kids on the
New York City subway, Danny says he
returned to his apartment and the words
just seemed to flow. The result was an
astonishingly authentic play about an
alcoholic black mother and her young
card shark son trying to get out of the
projects a story totally opposite
from Dannys own comfortable,
white upbringing. But despite the
improbability of his ability to inform the
work, its the best thing hes ever written.
And thats when things start to get tricky.
Despite sensible protestations from
his financial adviser boyfriend Pete (Ari
Butler) and best friend Trevor (Craig
Dolezel), Danny (Frank DeJulio) sends
his new play out under the pen name
Shaleeha Gntamobi. His thought is
a play about ghetto life titled Call
A Spade will do better if its author is
perceived to be a black woman. When
the play is selected for production
by the important Humana Festival in
Louisville, Ky., Danny perilously takes
his risky stratagem to a higher level. He
hires underemployed African-American
actress Emilie (Kellee Knighten Hough)
to pose as Shaleeha.
Touted as the new Lorraine Hansberry,
Shaleeha is a rising star and energetic
Emilie loves the attention and heady
process of collaborating on the play
with a top notch team. She also sincerely
loves Dannys play and is mystified how
this guy who describes himself as really
white and really gay wrote it. Along the
way there are funny moments like when
Danny loiters outside the audition room

texting opinions on entering and exiting

actors to Emilie whos inside making
choices with the director. But mostly
Dannys frustration palpably mounts as
hes kept away from rehearsals.
From the start, the cockamamie plan
feels doomed. During Danny and Emilies
initial meeting, he asserts that theyre
both oppressed people. Emilie resents
the comparison, insisting that gay white
men have no idea what it feels like to be
a black woman in America. Issues of use
of words and ownership of experience
become increasingly discussed. Danny
vulgarly describes African-American
plays and theatrical performances as
substandard decreeing all black
theatrical achievement the result of
affirmative action. Danny is not only white
and gay, hes a racist too. And Emilie isnt
super fond of the gays.
Not surprisingly, Danny and Emilie
come to verbal blows. Its a great fight
one of those blindingly angry bouts
when each combatant is hell-bent on
having the last word no matter how
hurtful it might be, and the actors give
it all theyve got.
And while some things about Talbotts
play are likable, theres too much that
isnt. So much of the race discussion
feels like retread. And the idea that a
jerk like Danny could have written such
an authentic and inspiringly insightful
piece is wholly doubtful.
Snappily
staged
David
Elliott
and performed by an appealing
and committed young cast, Olneys
production is mostly good, however
Dannys relationship with boyfriend Pete
comes off way too precious. On the other
hand theres chemistry to spare bubbling
between DeJulios Danny and Dolezel as
his endearingly dopey straight pal Trevor.
But alas, thats for yet another play.

RIS (2275 L Street NW) dubs itself as an

upscale neighborhood caf and features
an eclectic menu with savory and sweet
options to please a wide array of diners.
Head Chef Ris Lacoste is one of the most
respected and dedicated chefs in the
District and the restaurant recently added
famous gay pastry chef Sean Sasser to
the roster making RIS a must try for this
restaurant columnist. I was excited to see
what sweets Sasser would be serving up.
While the main reason for the visit was
to experience what Sasser would deliver,
we figured we might as well try out all
that RIS has to offer, especially since it
had been almost a year since Id been
there. My meal started off incredibly
strong with the addictive scallop
margarita appetizer, which consisted
of lime-marinated scallops with chilies,
orange, avocado and tequila ice. Much
like a regular margarita, I could have
indulged in five or six of these; they
were light, refreshing and luscious.
Unfortunately, my entre did not live up
to the high standards set by the appetizer;
the overwhelming flavor that my rabbit
pappardelle possessed was salty. Overall,
the reviews on the entrees and appetizers
were mixed with some strong items being
the beet salad, the sea scallops and the
quiche, and some not-so-successful items
being my rabbit and the hangar steak. But
the main event was still ahead of us and to
prepare for the onslaught of sweetness, I
ordered a Balvenie 15 year, to accompany
me on this journey, neat of course.
Sasser, whom many know from
MTVs Real World San Francisco as
Pedro Zamoras partner, is the new
pastry chef at RIS. My husband and I
personally remember Sean and Pedros
commitment ceremony as one of the
first we ever saw on television. Now
Sean is focusing on his work as a pastry
chef and sharing his life with current
partner Michael Kaplan.
Sasser has been fascinated with
food and cooking since he was young.
He loves the creativity and science
involved in making pastries and he is
fond of, working with yeast, tempering

chocolate and figuring out why an end

product is successful or not. Sasser
enjoys pairing seasonal fruits with herbs
like apples with rosemary, grapefruit
with tarragon, or lemon with thyme.
But he also loves chocolate, anything
chocolate, anytime, anywhere.
His affection for fruits and herbs is
currently visible on the RIS dessert
menu with the Meyers lemon meringue
tart with grapefruit tarragon sorbet.
This tart was full of exciting and fresh
flavors and the grapefruit sorbet was a
powerful and herbaceous compliment
to the multidimensional dessert. What
I found most pleasing about this plate
was that I was familiar with the dessert
but surprised by how Sasser brought it
to the next level. This is Sassers favorite
dessert currently on the menu at RIS.
The superior craftsmanship needed
to deliver familiar desserts to the next
level was evident in all the dessert
plates delivered to our table that
evening, from the apricot coupe to
the cookie plate. The slice of the day
was especially pleasing: the red fruit
tart with strawberries and raspberries
topped with honey yogurt ice cream
was a perfectly balanced dessert.
His chocolate macaroons that were
part of the cookie plate were heavenly.
And just in case pies, cookies and cakes
arent enough to satiate your sweet
tooth, Sasser delivers some of the most
dynamic homemade ice creams and
sorbets. There were fights at our table
and spoons almost being thrown across
the restaurant as the diners at my table
defended the last spoonful of sorbet
in a dish. I personally smacked a few
hands away defending the last bite of
the divine apricot sorbet.
RIS is an established restaurant and
has a very strong menu; many of the
savory items are worth the trip although
some fell short of expectations.
However, Sasser does not fall short on
any of his delightful creations. When
asked about the philosophy behind
the food he serves, Sasser says, I want
to serve desserts and pastries that
people recognize and love to eat, but
sometimes with an unexpected twist of
surprise. This is exactly the experience
a diner has when diving into one of
Sassers desserts and experience that I
enjoyed wholeheartedly.

FRANCESCA ZAMBELLO, Washington National Operas new artistic director, is seen here in a photo
from 2007 when she directed the companys Americanized version of Wagners Die Walkre.

Operas new artistic director to

focus on homegrown repertoire
By GREG MARZULLO
Washington opera audiences have
always known that former artistic
director Placido Domingos tenure with
the company provided an incredible
boost to the capitals cultural scene. The
tenors long performance career speaks
for itself, never mind his respectable
dabbling in conducting and even stabs
at baritone roles at an advanced age;
add to that his steerage of Washington
National Opera onto an increasingly
international platform and it was easy to
wonder who could possibly fill the role
after his departure.
Longtime opera and theater director
Francesca
Zambello,
a
lesbian,
assumed the artistic directorship on the
first of this year and she comes with a
strong pedigree of her own. From the
Metropolitan Opera to Milans famed
La Scala and Russias Bolshoi, Zambello
has made a serious stamp in the opera
world over decades of work that has
garnered her high accolades, including
the French governments Chevalier
des Arts et des Lettres and the Russian
Federations medal for service to culture.
Now, traveling back and forth
between the New York City home she
shares with her wife and their 4-yearold son, and her new residence in
Georgetown, she says shes ready to
take Washington National Opera in a
direction befitting its name and status in
the American cultural landscape.
Were taking national seriously,
Zambello says. Focusing more on
American artists, more new works and
contemporary operas. Thats a big
change for the company.
The past few years have seen
simultaneously exciting and predictable
seasons at Washington National Opera.

Big name artists Renee Fleming,

Patricia Racette, the up-and-coming
Vittorio Grigolo were often saddled with
productions that hewed closely to creaky,
early 20th-century performance idioms.
Were responding to the time
and the place, Zambello says of the
company now. Why shouldnt we be
unique and speak to D.C.? We should
relate to who we are and where we are.
Although Zambellos directing history
with Washington National Opera
encompasses repertoire classics like
Wagners famed Ring operas, her first
offering as artistic director is this springs
Show Boat, the Jerome Kern-Oscar
Hammerstein operatic musical now playing
the Kennedy Center and being simulcast
live at Nationals stadium Saturday.
There are a lot of great issues to
explore with Show Boat racism,
misogyny, civil rights, she says,
explaining that bringing this production
to the D.C. audience is a way to honor
the locale, something she plans to
continue during her first full season,
which begins next September with
Tristan und Isolde.
Yet, its the focus on newer works
and the development of an American
repertoire that stands out in Zambellos
vision for the company. Old-school
audience members can look forward to
the season opener as well as Zambellos
own version of Verdis La Forza del
Destino and a LElisir DAmore later
in the year. But those curious about
operas evolution with an American
voice will be frothing at the mouth
over the Washington-premiere of Jake
Heggies well-acclaimed Moby Dick.

When you were younger, you wanted

nothing to do with parenthood.
Life was a party then and having a family
was the farthest thing from your mind.
Kids changed people and who wants
that? Being a parent was something that
happened to somebody else.
Once upon a time, Jennifer Finney
Boylan thought that, too. But then she
became a father. And then she became
a woman and in her new memoir Stuck
in the Middle with You, she writes
about finding love, discovering lifes
sweet spot and being both a mommy
and a daddy.
Well over 25 years ago, James Boylan
fell in love at first sight.
He remembered seeing Deirdres blue
eyes from the audience as she performed
onstage. He knew he had to ask her out,
that he wanted to be her boyfriend. After
she finally said yes to a date, it wasnt
long before she said yes to marriage and
yes to a family. They welcomed son Zach
first and Sean a few years later.
And then James Boylan told his wife
something that hed been struggling with
for his entire life: deep inside, he was really
a woman. He could no longer tolerate life
in hiding. After six years of being a father,
James needed to live as Jennifer.
So how does a woman teach her son
about being a man? Would the boys be
teased, ostracized or ashamed? Would

they feel as though they lost a parent?

What kind of men would my children
become, Boylan writes. having been
raised by a father who became a woman?
As it turns out, Boylan shouldnt have
worried. Her eldest became an activist
and works for justice. Her youngest is a
fine musician. Their lives werent much
different from that of their friends, and
everyone generally forgot that there was
anything extraordinary about our family.
Today, Boylan is still married to
her wife of a quarter-century. Its as
nontraditional a union as you can
imagine but then again, traditional
families are no longer the norm anyhow.
And besides, says Deirdre, No matter
what else you say about my husband,
shes an amazing woman.
And though parenting memoirs
replicate like rabbits these days, Stuck
in the Middle with You is a pretty
amazing book.
With her slightly askew humor and
a grateful sense of awe for her familys
relative ease in her transition, author
Jennifer Finney Boylan writes from the
heart on the subjects of being father
and mother, son and daughter. Those
four roles were obviously played out by
the same person, but its interesting to
note how Boylan sees herself differently
(and similarly) in each of them, preand post-transition. I also enjoyed
her observations on connections
between past and present, which nicely
accompany interviews with friends and
colleagues about family, children and
being a child.
Readers looking for scandal wont find
it here, but if you want something thatll
bring you to the brink of tears again and
again, this is your book.

Two cool cars earn raves

and a couple of rants
By JOE PHILLIPS
What do a Mazda Miata and Porsche
Carrera S have in common? Not the
sticker price, thats for sure.
At $140,000 the cost of a deckedout Porsche cabriolet you can buy
five Miatas. But then, the Carrera has
a killer engine, sublime handling and
revved-up exhaust rumble that can be
heard blocks away.
Still, dont make a beeline to your
local Porsche dealer just yet. The
redone Miata the MX-5 Club edition
below is the best ever, with sexy sport
package, quick steering and grippy
rear-wheel drive.
MAZDA MX-5 MIATA CLUB PRHT
$27,000
MPG: 21 CITY/28 HIGHWAY
0-TO-60 MPH: 6.1 SECONDS
CARGO SPACE: 5.3 CU. FT.
Sure, most Miatas look like toy
Matchbox cars. But Mazda butched
things up by adding the tuner-like Club
model, with front air dam, rear diffuser and
racy black accents on the power hardtop,
side mirrors and 17-inch alloy wheels.
Those Euro-like alloys also come with
thick, high-performance tires to help hold
the road. Inside, the Fast and Furious
tweaks continue, with red stitching on
the black cloth seats, a leather-wrapped
shifter knob and steering-wheel audio
controls. But there are a few downsides:
the engine can sound course when
revving to highway speeds, and the quirky
release lever for the fuel lid is hidden in
a hard-to-reach compartment between
the seats. Another bummer: no back seat,
which means no rear stowage (except for

the tiny trunk) where you can easily toss

a briefcase or purse. But the Miata easily
beats similar pint-sizers in price, and it
retains its crown as the best-selling twoseat convertible in history.

PORSCHE 911 CARRERA S CABRIOLET

$140,000
MPG: 19 CITY/27 HIGHWAY
0-TO-60 MPH: 4.3 SECONDS
CARGO SPACE: 12 CU. FT.
Pull up in front of a tony restaurant, flip
the keys to a valet and suddenly youre a
rock star. At least thats what happened in
the Carrera S cabrio, which should be at
the top of any midlife-crisis checklist. This
is the high-performance model of the
iconic 911 (redesigned last year) with 400
hp (or a monster 430-hp in the optional
Powerkit package). Fast and precise,
with 20-inch wheels and stunningly quick
braking, this is still the only production car
with a seven-speed manual transmission.
Yet, soft-top convertibles without the
sturdy rear pillars of a coupe are prone
to cowl shake and wrinkly rooflines.
Not so the 911. Porsche reinforced the
chassis and used firm curved panels in
the canvas top to give this roadster a
true coupe silhouette. That top can be
raised or lowered in 13 seconds, even
while driving at low speeds. Both the
automatic wind deflector and rear wing
can be stowed with the push of a button.
And the glam cabin is tres trendy, with lots
of high-tech gauges, 12-speaker Bose
surround-sound stereo and sleek Pradalike lines across the dash and center
console. Perhaps the only real problem
is the low-slung chassis. Older, er, more
mature drivers may feel like Mick Jagger
when they try to get in this Porsche. But
once theyre behind the wheel, theyll
feel as young as Justin Timberlake.

REAL ESTATE

What do the numbers mean?

By TED SMITH

are the conditions of a buyers market.

If youre paying attention to the real

estate news, youve probably heard multiple reports about the numbers in April
2013 that indicate an improving real
estate market: new listings are up 17.4
percent over April 2012, although active
listings are still at a five-year low. Sales
are up 13.7 percent, the median sold
price is up 4.7 percent over last year to
$470,000 the highest in five years, and
the average sold price is up 4.6 percent
to $551,214. Average days on the market
(DOM) are down 37.3 percent to 42 days
on the market and the average ratio of
sold price to original list price (OLP) is at
a five-year April high of 99.5 percent
But what do these measurements indicate and what do their values mean?
Active Listings indicate the number of available properties at any given
moment. This number has an inverse
relationship to median sold prices and
average sold home prices. Putting this
relationship into a familiar concept-the law of supply and demand you
can state the relationship like this:

When the supply of homes is low and

demand is high, median prices and average prices are relatively high. These are
the conditions of a sellers market. Right
now, we are in a sellers market in DC.

When the supply of homes is high and

demand is low, median prices and average prices are relatively low. These

Median Sold Price indicates the

middle value in the range of homes
sold during a particular period. The
median is not the same as the average; it can be lower or higher than
the average, depending on the number and size of the sales transactions
being analyzed. The median tells us
more about the number of transactions; the average tells us more about
the size (value) of the transactions.
Average Sold Home Price indicates
the total value of all sales transactions
divided by the number of transactions.
As mentioned above, this can be higher or lower than the median. Rising
sold home prices over an extended
period indicate a sellers market; falling
sold home prices over an extended period indicate a buyers market.
Days on the Market indicate market conditions: When the supply of

homes is limited (as in a sellers market), homes tend to sell faster, so they
are on the market for fewer days. When
the supply of homes exceeds demand
for them (as in a buyers market), days
on the market will tend to increase.
Ratio of Sold Price to OLP (Original List Price) is also a good indicator
of market demand. In a sellers market,
this ratio will tend to be high in the
90s and may even exceed 100percent in a market where the competition for homes is especially fierce. In a
buyers market, this ratio may dip below 90percent (or more) as sellers are
forced to bargain more with buyers.
Having described what each of these
categories indicates and how their values rise or fall depending on a particular market, lets put them all together to
see what their expected values would
be in a sellers market:
In a sellers market:
Active Listings should be decreasing
Median Sold Price should be increasing
Days on the Market should be decreasing
Ratio of Sold Price to OLP (Original

List Price) should be increasing

Average Sold Home Price should be
increasing
In a buyers market:
Active Listings should be increasing
Median Sold Price should be decreasing
Days on the Market should be decreasing
Ratio of Sold Price to OLP (Original
List Price) should be decreasing
Average Sold Home Price should be
increasing
With a good understanding of what
these categories indicate and the significance of each category (and how it
might be tied to values in another category), you are ready to better understand the real estate news.

All over Morgan County, W.Va., dogwoods are blossoming, a perfect backdrop for the Berkeley Springs Studio Tour.
Each day from 10 a.m.-5 p.m. on Memorial Day Weekend, artists and craftsmen open their studios to the public. In
addition to offering their wares for sale,
participants will answer questions and
demonstrate various techniques they use.
The free, self-guided tour can be divided
into sections that fit into a day or spread
across the entire weekend.
The tours website, berkeleyspringstudotour.org, includes maps and driving
directions suitable for smart phones and
tablets. In addition, visitors can print a PDF
of the tour brochure, which contains all this
information, or they can pick up one at
The Lions Lair (81B North Washington St.,
in Berkeley Springs) and at hotels, B&Bs,
and restaurants around town. The web site
includes links to lodging, dining, shops,
galleries, and outdoor activities in Morgan
County so you can easily plan your Memorial Day getaway. Berkeley Springs is only
90 minutes from the Washington, D.C., and
Baltimore metropolitan areas.
Morgan Countys resident artists are
regionally and nationally recognized for
their work. The roster of participants in this
springs Studio Tour include makers working
in diverse metals, textiles, ceramics, glass,
painting, and printmaking.
Hsu Studios produces jewelry, mobiles, and wall-mounted sculptural pieces
with richly colored anodized aluminum.
Their designs range from fun to formal,
often structured so that pieces move in
response to their wearer. Anne Larsen of

Deerlight Studio makes jewelry, boxes,

and flatware featuring one-of-a-kind
stones, found objects, and enamelwork.
Abigail Porter produces a signature line of
looped earrings; she has also developed
a clasp for scarves that does not pierce
the fabric, but holds it gently in an ingenious embrace, making her work perfect
for pairing with fine textiles. Blacksmith
Glenn Horr at Highland Forge builds
wonderful accessories for the home, including light fixtures, cooking utensils,
door hardware and fireplace tools.
Kim Potter of Handwoven Designs creates exquisite scarves using loom techniques enhanced by surface applications of
additional yarns, many of which he makes
himself. He displays his clothing alongside
the intricate quilts of Fiesta Fibers, whose
dynamic designs feature fabrics altered by
vat dye discharge, a method that artist Jane
Frenke uses to develop subtle layers of pattern and color which she integrates into the
larger geometry of her quilts.
Crawford Horne of Thistle Glen Pottery
has built a large wood-fired kiln and explores the alchemy of smoke and glazes
on his dishes and serving ware. David Flohr
brings more than 30 years of experience to
his potters wheel, where he throws bowls
and vases to carry his distinctive glazes.
Between them, brothers Edward and
Henry Palczewski have mastered an astonishing range of glass working skills. They
make stained and fused glass windows,
serving ware, and mirrors using unusual irridized and dichroic glass to bring depth to
their designs. They have finished work for
sale and also accept commissions.
