Terms & Conditions Adobe ExportPDF Refer-A-Friend Program

1. The Program and Timing. The Adobe ExportPDF Refer-A-Friend Program (Program) runs from April 18, 2013 through July 17, 2013 (the Program Period), is sponsored by Adobe Systems Incorporated, 345 Park Avenue, San Jose, California 95110 (Adobe) and administered on Adobes behalf by the Next Bee Corporation, California (Program Administrator). 2. Eligibility to Participate in the Program. The Program is open to legal residents of the fifty (50) United States, the District of Columbia, and Canada (excluding Quebec) who are at least eighteen (18) years of age (or the age of majority where he/she legally resides) and who have a Program ID as of the date of referral (each such person a Referring Participant). Employees and contractors of Adobe are not excluded from participating in the program. Employees, independent contractors, officers and directors of the Program Administrator, its parent, affiliates, subsidiaries, advertising, promotion, and fulfilment agencies and legal advisors, and the immediate family members and persons living in the same household of such persons are not eligible to participate in the Program. The Program is subject to availability and U.S. export controls law and laws of where the participant resides. The Program is void outside the U.S. and Canada, and where prohibited, taxed, or restricted by law. 3. How to Refer-A-Friend, Earn a verified Eligible Referral, and Receive a $5 Gift Card Referral Award. (a) Refer-A-Friend: visit the Program page on https://www.acrobat.com/exportpdf/en/referral/epdf_referral_landing.html (the Site), sign in using your Program ID (which is separate and distinct from your Adobe ID, if you have one) and use the Program Refer-A-Friend form to send an email, Facebook or Twitter message to invite your friends age eighteen (18) or older to join ExportPDF (each such referred friend a Referred Participant). If you do not have a Program ID you can create one for FREE at the Site. Use of the Site is subject to the Adobe online Terms of Use and Privacy Policy, incorporated herein by reference;

(b) Earn an Eligible Referral: For every Referred Participant who uses the unique link provided
within your referral message (your Personal Referral Link) to visit the Site and register as a first-time paying subscriber to the ExportPDF online service conforming with the requirements of Section 4 below, you will earn one (1) referral eligible for one (1) referral award (Eligible Referral);

(c) Receive a $5 gift card Referral Award: For each Eligible Referral you earn that is verified by the
Program Administrator to meet the requirements of Section 4 below, you will receive one (1) Starbucks or Amazon gift card valued at five dollars ($5.00 USD) (a Referral Award). Referring Participants may make an unlimited number of Eligible Referrals during the Program Period, but regardless of the number of Eligible Referrals made, each Referring Participant is only eligible to receive a maximum of one hundred and twenty (120) gift cards, or an equivalent Referral Award value of six-hundred dollars ($600.00 USD) in this Program. 4. Eligible Referral Requirements, Restrictions and Verification; Referral Award Fulfilment. To be eligible for redemption of a Referral Award, each Eligible Referral is subject to verification by the Program Administrator and the following requirements: (a) Each Referring Participant must have a Program ID and use the Program approved mechanism for sending his/her message with Personal Referral Link to Referred Participants;

(b) Eligible Referrals will be accepted and applicable requirements deemed to be satisfied only after receipt and verification by Program Administrator. In order for an Eligible Referral to be verified, the Referred Participant must be a first-time subscriber to ExportPDF and, during the Program Period, must use the Referring Participants Personal Referral Link to subscribe to a paid ExportPDF account plan. Any purchase (or attempted purchase) of an ExportPDF subscription by a Referred Participant using fraudulent means will invalidate an Eligible Referral. (c) Following verification of Eligible Referrals, Referral Awards (and/or notification and instructions for Referral Award claim or redemption) will be delivered to Referring Participants electronically in the form of an email sent to the email address specified in the Referring Participants Program ID profile. Allow up to four (4) weeks for delivery of Referral Awards. Referral Awards must be claimed within ninety (90) days of issuance or will be forfeited and use of Referral Awards in the form of gift cards is subject to any applicable card-issuer terms and conditions which may accompany or be specified thereon. Taxes on Referral Awards and all expenses associated with Referral Award receipt and use are the sole responsibility of the Referral Award recipient. (d) The individual associated with a Personal Referral Link, as determined by the Program Administrator, will be deemed the Referring Participant for all Eligible Referrals made using that Personal Referral Link, regardless of whether the Referred Participant obtained the Personal Referral Link directly from the Referring Participant or from another source. In the event of a dispute regarding any Referred Participant or the identity of the corresponding Referring Participant, the referral will be deemed to be made by the authorized account holder of the email address in the account profile for the Program ID connected to the Personal Referral Link from which the referral originated, as determined by the Program Administrator. (e) Each email address supplied by the Referring Participant must be valid, unique, and correspond with a single individual personally known to the Referring Participant. Incomplete, indecipherable, or illegible referrals or referrals using invalid, repeating or non-unique email addresses for Referred Participants, or any attempted referral that fails to provide all required information, or otherwise fails to meet the requirements of these Terms and Conditions, will cause the referral to be unqualified and ineligible for purposes of Referral Award redemption. (f) Referring Participants may be required to provide proof of identity, age and place of residence in order to claim Referral Awards. 5. Personal Information. Personal information collected or received from participants by Adobe will be used in accordance with the Adobe online Privacy Policy accessible here: http://www.adobe.com/privacy.html. Participants should direct any requests to access, update or correct information to Adobe at the address provided in Section 1. Personal information collected through the Program Site may be used by Program Administrator in accordance with its privacy policy to identify a Referring Participant and to track activity associated with a Personal Referral link for purposes of Program administration and Referral Award fulfillment. You can read the Program Administrators privacy policy here: http://www.nextbee.com/privacy.htm. 6. Adobes Right to Disqualify; Modify or Terminate the Program; Limitation of Liability. (a) Adobe reserves the right in its sole discretion to disqualify any participant who (whether in fact or by attempt) subverts, circumvents or tampers with the referral submission process, or the lawful operation of the Program or the Site, or whom it finds to be in violation of these Terms and Conditions. Failure by Adobe to enforce any of its rights at any stage does not constitute a waiver of those rights. (b) Adobe reserves the right, at its sole discretion, to (i) modify the Program Terms and Conditions at any time, or (ii) modify, suspend, terminate or cancel the Program, or any portion thereof, if

for any reason it cannot be conducted as planned due to unauthorized intervention or technical failures which corrupt or impair the integrity or lawful operation of the Program, or other conditions beyond the reasonable control of Adobe or the Program Administrator. (c) To the fullest extent permitted by law, Adobe (including its officers, employees and agents) disclaim all liability (including negligence) for any personal injury, damage or loss whatsoever (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of or in relation to the Program or participation in the Program, including, without limitation where arising out of: (a) technical failures or equipment malfunction (whether or not under Adobes control); (b) theft, unauthorized intervention, access, or third party interference; (c) late, lost, altered, damaged, misdirected or undelivered referral messages, messages unintentionally filtered as SPAM, or messages not otherwise sent or received by the intended recipient; (d) circumstances outside the reasonable control of Adobe, the Program Administrator, and/or their respective associated agencies. 7. Miscellaneous. (a) Referral Awards and the offer from Adobe to participate in the Program are unique to the Referring Participant and may not be assigned, exchanged, sold, transferred or redeemed for cash or other goods and services. No participant may change, vary, substitute or extend any element of the Program (in whole or in part). (b) Referrals must be made and distributed using the approved Program mechanisms in a manner customary to personal communications with friends and family members. Bulk email distribution by the Referring Participant, including distribution to persons who are strangers to the Referring Participant, or use of a Personal Referral Link in a manner that would constitute unsolicited commercial email or SPAM under any applicable law or regulation is expressly prohibited and will be grounds for immediate termination of the Referring Participants participation in the Program and deactivation of his/her Personal Referral Link. (c) The form and amount of the Referral Award earned for verified Eligible Referrals is subject to change by Adobe at any time without advance notice. In the event the advertised Referral Award becomes unavailable, Adobe reserves the right to substitute an alternate Referral Award of equal or greater value. (d) By participating in the Program all participants accept and agree to abide by these Terms and Conditions. (e) All issues and questions concerning the construction, validity, interpretation, and enforceability of these Program Terms and Conditions, or the rights and obligations of participants, Adobe and the Program Administrator in connection with the Program, shall be governed by, and construed in accordance with the laws of the State of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of the State of California or any other jurisdiction), that would cause the application of the laws of any jurisdiction other than the State of California.
