MINUTES OF JCM MEETING WITH ALL INDIA CANTONMENT BOARD EMPLOYEES FEDERATION (AICBEF) HELD ON 24.03.

2011 IN RAKSHA SAMPADA BHAWAN, DELHI CANTT UNDER THE CHAIRMANSHIP OF DGDE

General Secretary of AICBEF informed that their Executive Body has been re-elected on 23.3.2011. All reps present in the meeting introduced themselves. DG welcomed all delegates before start of discussion on agenda points. 2. The following decisions were taken after the discussion:1. Revision of Memorandum of settlement arrived at in the year 1969, which was operational for 03 years. Request for a fresh negotiation. Views of the recognized Federations/ Associations/ Unions of Cantonment Boards will be taken into account during the exercise for revision of CFSR. This may obviate the need for any fresh Memorandum of Settlement. It will be ensured that prior consultation with Federation is done before the CFSR draft is finalized. The report of the Committee will also be discussed with the Federation at the DGDE level, before the draft is finalized. Terms of Reference of Committee will be suitably modified and MoS will also be referred to therein. A separate promotion channel should be In view of the enactment of Cantonments provided to stenographer from the Act, 2006 and need to review service classification table of CFSR, 1937 conditions of Cantt. Fund Servants in the present scenario as per functional requirements, this will be taken care of during revision of CFSR 1937. The issue of promotion channel of Stenographers will be

dealt with during the revision process. Accepted as far as Annual medical check-up of employees and their dependants are concerned. A computerized health record will be maintained for employees & their families. Specialist doctors who are engaged in the Cantonment Hospital will also be associated by Cantt Boards for such check-ups. DGDE advised that Federation should also run awareness campaign for preventive health measures of employees. Defence land can not be released for construction of private houses. However, Cantonment Boards could take up construction of houses for its staff depending on financial condition. The issue of housing loan can also be taken up in CFSR amendment. It was further decided to issue instructions to PDsDE to take up the matter with the State Governments at their level to consider allotment of land for housing purposes to Cantonment Boards Employees at concessional rates. The case of Secunderabad Cantonment will be taken up separately to examine request of employees for allotment of Cantt Board land (Outside the Cantt limit) to them for housing purpose. In view of the Govt. policy with regards to recruitment procedure which is applicable to Cantonment Boards too, it may be difficult to agree to this request. Restricting recruitment from within the district is not possible currently. It may not be possible to accept since the same is not within the existing Govt. policy and these are local issues based on functional requirements. However, it will be examined whether a circular can be issued to Cantonment Boards to utilize the employees for duties assigned to his or her post subject to the administrative convenience.

The housing be recognized as priority and the Govt. release land and provide grants/loans to the Cantt. Board Employees.

Cantonment Board Service not being an All India Services or even at State level. Hence calling candidates from all over the country for a particular Cantt. Board is not justified. Requests that the recruitment be done within the district as was being done earlier. Request that Safai Karamcharies be appointed only from scheduled Caste, as the Employees appointed from Nonscheduled Caste, refuse to work as Safaikaramcharies, for which they are paid, but are employed and utilized in white collar jobs.

While revising the CFSR, it is requested that All India Cantonment Board Employees Federation be co-ordinated. Gratuity Act 1972 be made applicable to all the retiring and retired employees of Cantt. Boards.

Accepted.

Deputation of Cantt. Board Employees from one Cantt Board to another Cantt. Board on higher post may please be considered.

Cadre review of Cantt. Board Employees be approved to avoid stagnation and is in the interest of Management also.

Request that 5% limit of appointment on compassionate grounds will not provide an opportunity to the next of kin of deceased employee, as the strength of employees in a single Cantt. Board is far less to justify 5% quota. It may be reasonable for large establishments. Hence at lease for Safai Karamcharies it may not be made applicable, keeping in view the death rate among this class of our society, who work under most unhygienic conditions. Yearly conservancy agreement with the Army should be made a permanent feature to avoid this class of our society, who work under most unhygienic

The existing Cantonment Board employees recruited prior to 1st January 2004 are covered under CCS (Pension) Rules, 1972 for the purpose of payment of gratuity. The issue of payment of gratuity, under the Gratuity Act, 1972 is yet to be decided by the Govt. of India. Efforts will be made to sort- out this problem. In the meanwhile data will be collected from Cantonment Boards to find out the number of cases where they had to make gratuity payment under the Payment of Gratuity Act, 1972 under specific court orders. The data so collected may be projected to the Government for deciding the issue. The matter has been taken up with Ministry of Defence. It will also be examined whether the deputation of Cantt Board employees from one Cantt Board to another Cantt Board can be provided in the proposed revised CFSR. This aspect will be addressed while framing revised CSFR. Federation was informed that cadre-restructuring in respect of Secunderabad, Jhansi & Deolali Cantt Boards has been done. It was also agreed that copies of all such orders shall be endorsed to the Federation. The request to give relaxation in the limit of appointment on compassionate ground beyond 5% was earlier taken up with the Govt. but the same was not accepted. However, DGDE informed that in respect of Group D staff the matter will be examined again and taken up with the MoD for relaxation on 5% embargo and three years restriction.

Conservancy agreements with the Army are being executed by the Cantonment Boards as per existing Govt instructions. DGDE will take up the matter with Ministry of Defence

Request for implementation of Medical Health Scheme for Cantt. Board Employees, Pensioners and Family Pensioners are prepared to contribute from their salaries and pensioners will pay in lump sum whatever becomes payable.

Request that the arrears payable under 6th Pay Commission which have been withhold by Cantt Boards, may be paid in full to the employees when the funds are available with Cantt. Boards.

for issuing instructions to Army HQ/CGDA regarding timely execution of conservancy agreement and release of payments by PCDA as per Govt instructions. Instructions have already been issued to the PDDE for payment of revised medical allowance @Rs. 300 per month to the pensioners of Cantt Board. However, difficulties brought out by Federation regarding non-payment of Rs. 300 to pensioners who avail CGH facilities as a common man will be examined and sorted out. Further, the issue of direct payment to referral hospitals by Cantt Boards, instead of reimbursement to the employees subsequently, will also be examined and suitable orders issued. In this regard, it was decided that Medical Insurance Scheme for all Cantonment Board employees and pensioners can be worked out. For this purpose, a group can be constituted associating the rep. of Federation too to work out the modalities and submit its recommendations to DGDE. DGDE has already issued order in the matter vide letter No. 9/63/C/DE/2010-11 dated 22.09.2010. However, the matter will be reconsidered.

With the permission of Chair following supplementary agenda were discussed:1A. Matter pertaining to Clement Town Federation brought out that certain Cantonment Board irregularities were committed in Clement Town. DGDE ensured that the same will be looked into. Instructions in this regard have been issued on 23.3.2011. Computerization of Pay & Allowances of Computerization of Pay & Allowances Cantonment Board employees system of Cantonment Board employees will be done on priority basis. It will be examined whether the same can be covered as a part of proposed Accrual based Accounting System or as a separate programme.
