tive state, and the minimum sentence has doubled to 20

years for gang rape, rape of a minor, rape by policemen
or a person in authority; it can also be extended to life
without parole. Womens rights organizations, civil society
groups and activists have criticized the ordinance for being
inadequate to combat sexual crimes against women and
for being passed without proper debate.
The rape and subsequent death of a 23-year-old New
Delhi medical student in December 2012 sparked mass
protests in India and led to the creation of the committee
that recommended the legal reforms in its report. The
report recommended numerous reforms in the way the
nations legal institutions handle rape cases, many of
which were taken into consideration in the ordinance. In
December Indian authorities charged six suspects with
murder after the death of the gang rape victim. Also in
December Indian Prime Minister Manmohan Singh called
for peace after a protest over sexual violence resulted in
a clash between protesters and police.

retiring Justice D K Jain

appointed Chairman Law Commission

ustice D K Jain is the first judge to retire in

2013 from the Supreme Court of India. Following
his retirement Justice Jain has
been appointed the Chairman of
the Twentieth Law Commission
of India, a post he will enjoy till
August 31, 2015.
Justice Jain began his career
as an Advocate enrolled in the
Delhi Bar Council. He was initially appointed as an Additional
Judge of High Court of Delhi on
March 19, 1991 and was made a Permanent Judge
on January 23, 1992. In 2005, he was elevated as the
Chief Justice of the Punjab and Haryana High Court,
eventually being elevated to the Supreme Court on
April 10, 2006.
Justice Jain served in the Supreme Court from April
10, 2006 to January 24, 2013 for 2482 days (6 years, 9
months and 15 days). During his tenure as a Supreme
Court judge, he delivered 135 judgments.
It was a three Judge Bench headed by Justice D
K Jain that had rejected the CBIs plea to transfer the
high profile Ghaziabad PF Scam trial. It was a Division Bench of Justice Jain and Justice H. L. Dattu that
had banned the holding of public meetings on roads.
The Bench held that, right to hold a public meeting is
inferior to the common mans right to free movement.

New York becomes first US state

to pass toughest gun-control law

New York has become the first state to pass a gun

control law, which is the toughest in the nation, since

the Sandy Hook Elementary School shooting massacre
last month.
Acting one month and a day since the rampage that left
20 children and six educators dead, Governor Andrew
Cuomo signed the bill into law.
Called the New York Safe
Act, the law includes a
tougher assault weapons
ban that broadens the
definition of what constitutes an assault weapon,
and limits the capacity of
magazines to seven bullets from 10, ABC News
reports.
According to the report, the law also requires background
checks of ammunition and gun buyers, even in private
sales, imposes tougher penalties for illegal gun use, a
one-state check on all firearms purchases, and programs
to cut gun violence in high-crime neighborhoods.
As he signed the bill into law, Cuomo said it was not only
`the first bill, but the `best bill.
New Yorks law also aims to keep guns out of the hands
of those will mental illness.
The law gives judges the power to require those who pose
a threat to themselves or others get outpatient care, the
report said.
The legislation also includes what is called a Webster
provision, named for the two firefighters ambushed on
Christmas Eve in Webster, N. Y.
The measure would mandate a life sentence with no
chance of parole for anyone who kills a first responder,
the report added.

sexual assault ordinance

ndian President Pranab Mukherjee signed an ordinance on Sunday imposing stricter penalties
for rape. The ordinance,
which was passed by
the Union Cabinet on
Friday [Times of India
report], will be tabled
before the parliament
within six weeks of the
next session beginning on February 21. The new laws
are effective immediately with the presidents signature
because parliament is not in session but the president
deemed immediate action necessary. However, if the bill
is not passed, the ordinance will lapse and the laws will
no longer be valid. The new law provides for the death

In such a case, you may be able to file an affidavit
which demonstrating your search for the individual
and seeking court permission to serve the divorce
petitoin by alternative service (usually a news
paper publication). In such a manner, you may be

Ans:
Yes, we can still do your divorce. But, in this situation, it is better if your spouse is in agreement
with the divorce and signs the divorce papers. We
can still do your divorce if it is a Default Divorce,
but it is more difficult. Just make sure it is not a
Contested Divorce.

I have been legally separated from my husband
for more than 10 years. My country doesnt
recognize divorce but they will approve a legal
separation. Can I get marry in the united states
just for having legally separated?

Ans:
No - a Legal Separation leaves you married to your
spouse, and you cant be married to two people at
the same time. If you want to marry somebody else,
you will have to move to a country that recognizes
divorce, satisfy the residency requirements there,
and then seek and obtain a divorce through that
countrys courts. to proceed with your divorce. You
would best retain an experienced Family Lawer to
advise and represent you in your divorce.

If a foreigner is arrested in India . In such a case
can the foreigner give cash as a security for his
release and if so any case laws on this point ?

Ans:
This is the question indeeed raised a complex point
and usually there is not any sraightforward answer .
Having said that it would appear that the Lawyer
representing the foreigner may well as a Professional coutesy and by way of diplomatic protocal
may inform the embassy of the foreigner giving
them the full details of the offence for which the
foreigner may have been arrested and charged for
the offence and thus involving the embassy and
enabling the Lawyer to take seperate instructions
from them as well .
In majority of the cases the embassy will render
or extend the consular assistance to the accused
and some time providing the necessary surities or
the amount fixed for bail on the assumption that
the offence is Bailable
Furthermore, as all our learned friends will know
the Highcourt has power to determine and stipulate
certain conditions which in the opinion of the Honourable court will be just and appropriate having
regard to all the circumstances of the case befor
their Lordship which may require to hand over the
passport of the foreigner, custody or reporting to
the police and so on .
It is my humble view that it is most unlikely and
particularly (in view of the money laundering awareness ) the court will be inclined to accept cash as a
security but again this will depend upon the merits
of the case before the Honourable court.

Can my mother in law win in wanting visitation rights to my daughter?

Ans:
Grandparents do not have legal rights, as such. So long as the parents are
alive, together and not abusing the children, you and only you get to decide
with whom the child has contact. There are circumstances when grandparents do have court-ordered visitation or even custody, but those situations
are very much the exception and not the rule. All you have to do to win is
not agree to any court orders, remain fit parents and always show up if she
takes you to court. There is almost always more to these questions than
just the naked legal question. On the off chance that you are typical of the
cases where this sort of thing comes up, you might want to think through
what has brought you, the childs father and your childs grandmother to
this rather sorry state of affairs where one of you is threatening the other
with legal action over what should be a joyous and bonded relationship.
In almost 40 years of doing this for a living, I have learned that the only
persons conduct you can control is your own, and sometimes even that
does not work. Make whatever adjustments you need to make to make this
situation better and as good as it can get.

I have been estranged from my husband for years and was wondering
if there is a way he could have gotten a divorce without my consent?

Ans:
Yes, Check with the family court in your jurisdiction. Check from the time
you separated until now under both your names to see if an action was
started and granted. Your husband could have begun a divorce action
and completed it as long as he followed the notice requirements in your
jurisdiction. This means if he ran newspaper adds in accordance with the
state statute stating that he had started a divorce action, and listing the
court date and/or dates and you failed to appear then you could have
been defaulted, and he would have been granted his petition. Also, he
could have had service perfected by claiming he was trying to have you
served at your last known address which you no longer lived at by having
a sheriff draft an affidavit claiming that he attempted to serve you at that
address a number of times and he believes you are avoiding service, then
your husband could ask for tack on service which is what it says, they nail
it to the door and you are served even if you dont live there anymore as
long as your husband claims that is the last known address he had. Those
are a couple of ways and there are more, so check if you want to know.
