RENTAL AGREEMENT

1. Supplies The unit is completely equipped with linens, towels, dishes, cooking utensils, and all furnishings based upon normal occupancy and use. The unit is also equipped with a starter supply of toilet paper, paper towels, dish soap, dishwasher detergent, hand soap, and very basic non-perishables. Street parking is available but is limited. NYC alternate side street parking rules applies. For more information, visit http://www.nyc.gov/html/dot/html/motorist/prkintro.shtml Utilities gas, water, electricity, basic cable/satellite service, Wireless Internet access (Wi-Fi) are included in your rental fee. It is tenants responsibility to have proper hardware necessary to access the Internet. Tenants will be billed for any movies or paid television services they order during their stay. Condition of Property Tenants agree to keep the property, furnishings, and appliances clean and in good condition and to pay for any damages tenant or tenants invitees may cause in excess of what the security deposit would cover. If any furniture is moved, tenant agrees to place it in its original position before vacating the premises. If premises are found in an unacceptable condition upon arrival, or if something does not work properly, report to management immediately and get a confirmation of such. Do not assume we already know of it. If no report is made, we will presume that the premises are acceptable and all is in working order. Cleaning Property should be kept and left in the same basic condition as upon check-in. You will be responsible to leave the dishes, utensils, and appliances clean. All trash and recyclable items are to be disposed of in the appropriate trash bins located in the front yard of the property. Under no circumstances shall a tenant leave trash in the apartment as they check out. Additional cleaning charges will be deducted from the security deposit unless premises are kept and left in the same basic condition as upon move in. Security Deposit The security deposit is refunded seven (7) to ten (10) business days after premises are vacated, less any charges for damage, missing items, and/or any additional housecleaning if required. Security Deposits are refunded using the same method used to pay them by the guest. Repairs Tenant agrees to allow management to enter the premises to make necessary between the hours of 8am and 6pm, or anytime thereafter if the issue requires immediate attention. 7. 8. Sublet Tenant shall not let or sublet all or any part of the premises nor assign this agreement or any interest in it. Abandonment If tenant abandons the property or vacates before the check-out date and time, management may at their option, re-enter the premises and take possession of and remove all their property. Late Check Out Check out time is 11:00 AM Eastern Standard Time. Management reserves the right to charge guests a late check-out fee of $25 for each hour beyond the check out that the Tenant occupies the apartment. If Tenant does not vacate the apartment, two (2) hours past the check out time, Tenant will be billed for a full day and management reserves the right to remove Tenants property.

Early Check-In - For guests requesting early check-ins, they must pay in accordance with the schedule below: 1-3 hours early - fee is 25% of the full or discounted daily rate 4-6 hours early - fee is 50% of the full or discounted daily rate 7 or more hours early - fee is 100% of the full or discounted daily rate

11. Guests must confirm arrival time at least 72 hours before check-in. This will allow us to bill the guests for these charges and have their payment received prior to check-in. 12. House Rules Tenant is responsible for reading the Smart Home Group House Rules and adhering to them. House rules are to be initialed by the tenant and returned to Smart Home Group at least 48 hours before check-in. 13. Registration Tenant agrees that only the parties listed on the SHG Registration form will be residing on the premises. Tenant further agrees to abide by unit maximum occupancy numbers as mentioned above. 14. Personal Property Tenants' personal property is not insured by the Smart Home Group. Neither owners, managers, nor managers agents are responsible for articles left behind, lost or stolen. 15. Owners Property- Tenants' to insure that the utmost care will be taken with respect to the owners property and furnishings. Tenant will be charged for replacement if a loss is found to be through tenant negligence. 16. Disturbances Guests/ tenant will not disturb, annoy, endanger or interfere with other occupants or neighbors, nor use the premises for any unlawful purposes, nor violate any law or ordinance, nor commit waste or nuisance upon the premises. It is further agreed and understood between tenant, agent and owner that any disturbances resulting in neighborhood complaints or police action will cause tenancy to be subject to termination forthwith and all monies to be forfeited to the landlord. 17. Cancellation - In the event of cancellation prior to occupancy, refunds will be made in accordance with the Security Deposit, Refund and Cancellation Policies as outlined in Tenants billing statement and invoices. 18. Conduct Unbecoming It is further agreed that in the event of party activity in the unit resulting in neighbor complaints and/or police visit/investigation, I will pay a fine of $300 per occurrence. This fine is in addition to any other remedy available to owner/management and will be deducted from the security deposit. I also understand that the Smart Home Group has a zero tolerance policy on any illegal substances, drugs, and/or paraphernalia on or around the above referenced property. 19. Occupancy - All parties shall abide by the maximum number of guests as stated in this rental agreement. If any additional guests remains for more than 1 day, their names shall be added to the current attached registration agreement and applicable fees will be assessed.

House Rules and Information


(Please read and keep available for all guests in your party!) RELAX, HAVE FUN, ENJOY YOURSELF! MAKE THE MOST OF YOUR TIME HERE IN STUYVESANT HEIGHTS!!!!! We are an energy conscious environment. When you are not using the apartment or checking-in out, please do not leave the air conditions, lights, and appliances on. CHECK INVENTORY The property has been inspected and all items inventoried prior to your visit. If any item is missing, or not working, please call and notify us immediately at 718-916-1662 or via email rentals@thesmarthomegroup.com NO SMOKING This is a NON-SMOKING house. Guest may smoke outside of the property on the sidewalk. Smoking on the steps, front yard or any area on the property is prohibited. Please insure that any cigarette butts are discarded properly. Violators will be charged for any additional cleaning not limited to carpets, upholstery, and aeration for the unit or cleaning the yard. PETS ABSOLUTELY, POSITIVELY NO PETS ARE ALLOWED! NO EXCEPTIONS! TRASH - The trash bins are located in the front of the house. There are separate labeled bins for Recycling paper items and plastic/metal items. Recycling is required by New York State law. If tenants do not recycle, a $50 fee will be assessed. EXTRA BEDDING/LINENS All bedrooms have an extra set of bedding which is usually stored in a closet in or closest to the bedroom. If for some reason, linens are under-supplied, please contact management. EXCESSIVE NOISE Will not be tolerated under any circumstances. ILLEGAL SUBSTANCES The Smart Home Group has a zero tolerance policy on any illegal substances, drugs, and/or paraphernalia on or around the property. SUPPLIES We have provided you with basic supplies (toilet paper, paper towels, dish soap, etc) to begin your stay should you run out. UNIQUE QUALITIES OF THIS HOME- Many furnishings are new. All of the decor belongs to the Owner and has sentimental value. Please be mindful of such. PARKING - Use street parking with discretion. Street parking is available but is limited. NYC alternate side street parking rules applies. The secure wireless network and password will be provided to you at check-in. Upon check-out/departure PLEASE ENSURE THE FOLLOWING:
TURN OFF ALL AIR CONDITIONS, LIGHTS AND APPLIANCES. Place soiled dishes in the dishwasher (where applicable) & run clean cycle. If your apartment is not equipped with a dishwasher, guests are required to wash their dishes before checking out. Remove ALL remaining trash from unit and place in the appropriate trash bins located in the front of the house. Place ALL items back where they were prior to you moving them. Close and lock all doors and windows. Lock the main door of the building and toss the Owners mailbox which is located at 55 Bainbridge Street on the gate under the stairs.
