PETITION
Petitioners, by undersigned representatives, respectfiilly state that:

Nature of the Petition

This is a petition for Indirect Initiative filed with the Senate under Section 3 (b) and Section 11 of Republic Act 6735, or "The Initiative and Referendum Act", which provide:
Section 3. Definition of Terms. Acg the following teflns shall mean:

1,.

For purposes of this

xxx
(b) "Indirect initiative" is exetcise of initiative by the people through a proposition sent to Congress or the local
legislative body for action.

xxx
Section 11. Indirect Initiative. Any duly accredited people's orgarizaiofl, as defined by law, may file a petition fot inditect initiati-re with the House of Representatives, and other legislative bodies. The petition shall contain a sunmary of the chief purposes and contents of the bill that the organtzaion ptoposes to be enacted into law by the legislature.
The procedure to be followed on the initiative bill shall be the same as the enactmeot of any legislative measure befote the House of Reptesentatives except that the said initiative bill shall have precedence ovet the pending legislative measures on the committee.

The Petition proposes the eriactrnent into law by Congress of an Initiative BiII tided "ANI ACT TO STRENGTI{EN THE PEOPLETS RIGHT TO INFORMATION", also to be known as the "PEOPT F'-'S FREEDOM OF INFORMATION ACT''.
2.1. A copy of the Initiative BiIl is hereto attached rrAtr and made an integtal part of this Petition.

2.

Annex

Petitioners have filed on 1 J.rty 2073 a similar Petition with the House of Representatives fot the passage of its counterpart version.

3. 4.

From the plain meaning of ptovisions of RA 6735 there is no question that a, Petition fot Indfuect Initiative may be fiIed with the House of
Representatives. However, there is arrrbiguity as to whether RA 6735 allows the
2

filing of a similar petition with the Senate. While Section 3 (b) of RA 6735 speaks of "Congress" (which, by Article VI, Section 1 of the Constitution "consists of a Senate and a House of Representatives"), Section 1L speaks of "the House of Representatives, and other legislative bodies". Not only is the Senate not spelled out in conftast to the House of Reptesentatives, the phtase
is also stated in the plural.

5. A textual reading of other related ptovisions of RA 6735 will not

necessarily lead to a resolution of the ambiguity. Section 11 falls undet subtitle II: "National lnitiative and Referendum". Subtitle III, on the other hand, refers to "Local Initiative and Referefldumtt, and ptovides a procedure fot local Iegislative bodies diffetent than that under Section 11. In addition, the second pangraph of Section 11 speaks of a procedure to be followed in the eflactment of the initiative bill, but makes reference only to the House of Representatives.

Resort to the legislative record on RA 6735 will likewise not be instructive to the resolution of the ambiguity. RA 6735 is a consolidation of Senate Bill No. 17 passed on Thitd Reading on 28 Septembet 1,987, and House Bill No. 27505 passed on Thitd Rearling on 24 Ap.il 1989. The Senate version confined itself to a system of initiative and referendum in local govemrnent units, adopting what the Senate's main sponsor, Senatot Neptali M. Gonzales, descdbed as "a cautious approach". G.ecord of the Senate, Vol. 1, No. 33, p. 871) In contrast, the House vemion coveted national laws (and even the Constitution). It provided for "Indirect Initiative" in Section 7 thereof, from which Section 17 of RA 6735 was adopted verbatim, except N thzt point it still did not include the phtase "and other legislative bodies". The phrase appeared in the Conference Committee Report on the disagteeing provisions of Senate Bill No. 77 ard House Bill No. 27505 approved by the Senate and the House of Representatives on 8 J*. 1989. An exarrination of the transcript of the conference committee meeting, however, does not disclose a discussion specific to the adoption/addition of the phrase "and other legislative bodies".

6.

7.

In an obiter dicturr in the case of Santiago vs. COMELEC (G.R. No.

127325, March 79,1997),theponenteJustice Davide,Jr. suggests that the phrase "and other legislative bodies" may have been misplaced and that it may have been referring to local legislative bodies, as follows:

frrrther examination of the Act even reveals that the subtitling is not accurate. Provisions not gelmane to the subtitle on National Initiative and Referendum ate placed therein, like (1) paragraphs (b) and (c) of Section 9, which teads:

xxx
Section ll (Inditect Initiative) referrins to indirect initiative with the lecislative bodies of

@ that portion bf

local governments; thus:

Sec. 11. Indirect Initiative. Any duly acctedited people's orgarrization, as defined by law, may file a petition for inditect

initiative with the House of Representatives, and otber hgislatiue

bodies.

...

(emphasis supplied)

Given that Congress is the body pti-*ily rnvolved i" g.ri"g course to an exetcise of Indirect Initiative under RA 6735, Petitioners respectfuIly submit that the filing of this Petition calls for the Senate's exercise of its power and prerogative to contemporaneously resolve the ambiguity, ffid to decide whether or not RA 6735 allows the filing of this petition with the Senate.
Petitioner's position, and which we plead to this Honorable Senate, is that the phtase "and other legislative bodies" in Section 71 caurr be given a reasonable, just and legally valid intetpretation as necessarily including the Senate, and that therefore this Petition can be given due course.

8.

9.

10. RA 6735 urith respect to the enactrnent of laws finds its wellspring
from Sections 7 ar'd 32, Artcle Vf, of the Constitution, which provide: Sec. 1. The legislative power shall be vested in the Congress of the Philippines which shall consist of a Senate arnd a, House of Representatives except to the extent reserved to the people by the provisions on initiative and referendum.
xxx
Sec. 32. The Congress shall, as earLy as possible, provide for a system of initiative and refetendum, afld the exceptions therefrom, whereby the people can direcdy propose and enact laws or approve or teject any act ot law or part thereof passed by

the Congress ot local legislative body aftet the rcgistration of a petition therefor signed by at least ten per centum clf the total number of tegistered voters, of which every legislative disttict must be represented by at least three per centum of the
registered voters thereto. (emphasis supplied)

11. The Supreme Court has held that "provisions for initiative and referendum are liberally construed to effectuate their pu{poses, to facihtate and not to hampet the exetcise by the voters of the dghts gtanted thereby." In the case of Subic Bay Metopolian Authority vs. COMELEC (G.R. No. 125416,
September 26,7996), the Supreme Court said:

x x x Indeed we recognize that "(p)rovisions for initiative and teferendum liberally construed to etfectuate their ^re puiposes, to facilitate and not to hamper the exercise by the voters of the rights granted thereby." In his authoritative treatise on the Constitution, Fr. Joaquin G. Bernas, S. J. treasures these "instruments which can be used should the legislanrre show itself

indifferent to the needs of the people." Impelled by a sense or ugency, Congtess enacted Republic Act No. 6735 to give life and form to the constitutional mandate. Congress also interphased initiative and tefetendum into the workings of local governments by including a chapter on this subject in the Local Goverrment Code of. 7997. And the Commission on Elections can do no less by seasonably and judiciously promulgating guidelines and rules, for both national and local use, in implementation of these lays. For its paft, this Court early on expressly recognized the revolutionary import of resenring people powet in the process of law-making.

Iike elections, initiative and referendum are powerful and valuable modes of expressing popular sovereignty. And this Court as a matter of policy and doctrine will exert every effort to nurture, protect and promote their legitimate exercise. For it is but sound pubiic policy to enable the electotute to express their free and untrarnmeled will, not only in the election of theit anointed lawmakers and executives, but also in the formulation of the very rules and laws by which our society shall be governed
and managed.

1,2. The purposes of initiative as provided in the Constitution and the meaning and intention of authots of RA 6735 would be best effectuated if the phrase "and other legislative bodies" is interpreted to cover the Senate for pu{poses of the filirg and consideration of a Petition for Inditect Initiative. Under the Constitution and the Rules of the House of Representatives and of the Senate, fot a bill to become law it must be passed by both Houses on three readings. The exercise by peoplers organizatons of the Inditect Initiative would be rendered futile if no cor:ntelpart petition is allowed to be filed in the Senate, and thete is no sirnilar bill filed by members of the Senate. Even if the House of Representatives pass a bill on third reading, and the Senate takes it up as a bill ftom the House of Representatives, the loss of material time compated to if the measute is taken up simultaneously by both Houses, gready teduces the prospects of enactrnent specially in the case of contentious bills.
feature of Indirect l.nitiative which Petitioners also submit should be given effect by the Senate, is the ptecedence it gives to zn initiative bill over other legislative measrues pending in a committee, as provided in paragraph 2, Section 11 of RA 6735. The pwpose fot this was fully discussed at the Bicameral Conference Committee held on 6 J*. 1989, as follows:

13. One impoftant

xxx
HON. ROCO: So, kahit walang sectoral representative because malzkas ang kontra sa sectroal representatives, the farnets gtoup can file theit own bill, the wotkets will fiIe theit own bill and it will be glverr priodty in the committee. But

evidendy, it must be considered with any other bill on the same subject matter by the committee.

SENATOR AQUINO: Basta na,kalagay doon, be given priority.

HON. ROCO: In the deliberations of the bill in the comrnittee, dapat ri,aka-agenda kaagad sa comrnittee. Kung meton ka ring pending bill na ganon ang topic, siyempre ikucombine na lang

Chief Purposes of the Initiative Bill

19. The people's right to infotmation held by govefirment is expressly recognized in both international and Philippine law. At the intemational level,
to government-held information has alrcady evolved into a recognized human oght. It is flow acknourledged that Atticle 1,9 of the Universal Declaration of Human Rights which states that"Euerlone has the ight tofreedom of
access
opinion and expression; tbis rigbt iruclufu; freedon to bold opinions atithout irterference and to seek, rcuiae and irrpart infamation and ideas througlt an-y media and regardless of

frontierl', and its countelpart provision under Article 19 Q) of the trntetnational Covenant on Civil and Political Rights, embody not just freedom of opinion and expression, but a right of access to inforrrration as well.

20. The United Nations Human Rghtr Committee, in its General Cornment No. 34 issued at its 702nd session on 77-29 Juily 2011 in Geneva,
expounded on the right to information aspect of Article (19) 2 of ICCPR:

Article L9, pxagraph 2 embraces a dght of access to infornation held by public bodies. Such information includes tecords held by a public body, tegatdless of the form in which the information is stored, its source and the date of ptoduction.
xxx

To give effect to the right of access to informad.on, States parties should proactively put in the public domain Government infonnation of public interesl States parties should make every effort to ensute easy, prompq effective and ptactical access to such information. Sates parties should also enact the necessary procedutes, whereby one mly gllrt access to information, such as by means of freedom of information legislation. The procedutes should provide for the timely processing of requests fc,r information according to clear rules that are compatible with the Covenant. Fees for tequests for inforrration should not be such

access to information. Authodties should provide reasons for any refusal to provide access to information. Arrangements should be put in place for appeals from refusals to provide access to information as well as in cases of failure to tespofld to requests.

as

to cofrstiflite arl unreasonable impediment to

27. In the Philippines the people's right to information is

recogrrized in no less than the Constitution. Article of the 1987 Constitution states:

IIi

@iX

of

expressly Rights), Sec. 7

The right of the people to information ofl matters of public corrceflr shall be rccoggtzed. Access to official records, and to documents and papers pertaining to official acts,
ttansactions, or decisions, as well as to govefirment research data used as basis for policy developmenq shall be afforded the cit:zer, subiect to such limitations as may be ptovided by law.

Complementing the Bill of Rights provision on FOI is the state policy of full disclosure of all state transactions involving public interest. Article II (Declaration of Pdnciples and State Policies), Section 28 teads: Subject to reasonable conditions prescribed by Iaw, the State adopts and implements a policy'of full public disclosue of all its traflsactions involving public interest.

22.

While the Supreme Court has consistently held that the right to inforrnation under the Bill of Rights is self-executorf, it lacks the substantive and procedural details necessary fot its effective and predictable
implementation.

23.

24.

Thus, the Initiative Bill has the following chief specific pu{poses:

25. First, it seeks to address the lack of definite scope and limitations to the right to information. The constitutional provision states that access to
inforrration shall be afforded our citizens "subiect to such limitations as may be provided by l^\r/'. Congress has yet to fulfill this mandate. While the Supreme Court has stepped in by enumerating a number of exceptions thtough jurisprudence, the expected lack of exactness in the absence of legislation opens the enumeration to wide intelpretation. In Chavez vs. PCGG (G.R. No. 1,30716, December 9, 1998), the Supreme Court noted that "there are no specific laws ptescdbing the exact limitations within which the right may be exercised or the correlative state duty may be obliged." Given this, it has been easy for govefnment agencies to set up discretionary exceptions, and citizens have to deal with a litigious process to challenge a denial of access.

to addtess the absence of a uniform and effective ptocedute for access to infornation. The closest to a procedute that Congress has provided is contained in Section 5 of Republic Act 6773 (Code of Conduct and Ethical Standards fot Public Officials and Employees), which lists the duties of public officials and employees. Letter (e) of said section states: "Make
Second,
seeks
11

26.

it

documents accessible to the public. - All public documents must be made accessible to, and rctdtly avalable fot inspection by, the public within reasonable working hours." In practice, goveflrment has evaded the application of this plnin provision by applyrng instead letter (a) of the same section: "Act ptomptly on letters and requests. All public officials and employees shalf within fifteen (15) working days ftom teceipt thereof, respond to letterc, telegrams or other means of communications sent by the public. The reply must contain the action taken on the request." Thus, a response within fifteen days (such as mere acknowledgement of the request with indication of the steps being taken) without Santing access is deemed substantive compliance.

denial

27. Third, it seeks to addtess the absence of sanctions for unlawful or delay of access to infotnation. Because of the lack of definite

procedure as well as the absence of definite scope and limitations, it is difficult to enfotce the general administtative ot penal sanctions provided irr RA 6713. Putting in place effective sancdons will work as a detertent against violation of the right to information, or alternatively, as a mechanism for accountability when the right is violated.

28. Beyond the above specific pulposes, the Initiative Bill will

also

promote the genetal pqposes that the ftamers of the Constitution sought to achieve with the express recognition of the tight to information and the adoption of full disclosure of ttansactions as a state policy. The twin constitutional provisions of the dght to infonnation and the policy of full public disclosure of govemment transacdons are intended to promote the fundamental precepts of democracy, peoplers participation, public office being a public trust, governmeflt accountability, prevention of corruption, and
responsive decision-making.

These precepts ate emphaically expounded by the Supreme Court in its decisions relating to the dght to infonnation. In Legaspi vs Civil Service Comrnission (G.R. No. 72179,May 29,7987), the Supreme Court said:

29.

The incolpotation in the Constitution of a guarantee of access to information of public concern is a recognition of the essentiality of the free flow of ideas and information in ^ democracy @akdoza v. Dima; rro, Adm. Matter No. 11,20-MJ, May 5, 1976,17 SCRA 74).h the same way that free discussion enables members of society to cope with the exigencies of their time (Ihornhill vs. .r{labama, 370 U.S. 88,102 11,9391), access to infornation of general interest aids the people in demociatic decision-making (87 l{arvard Law Review 1505 [197aD by gr..ing them a better perspective of the vital issues conftonting the
nation.

30. In Valmonte vs Belmonte (G.R.No. 74930, February

Supreme Court observed:

13, 1989), the

t2

An informed citizenry with access to thb diverse cuffents in political, motal and artistic thought arr.d data relative to them, and the free exchange of ideas and discussion of issues thereon, is vital to the democratic goveflrment envisioned undef ouf Constitution. The cornefstofle of this republican system of government is delegation of powet by the people to the State. In this system, governmental agencies and institutions opefate u/ithin the lirnits of the authority conferred by the people. Denied access to information ofl the innet workings of goveulment, the cilzer, rry can become ptey to the whims and capdces of those to whom the power had been delegated. The postulate of public office as a public trust, institutiontliz.ed in the Constitution (in Art. XI, Sec. 1) to protect the people from abuse of governmental Power, would certainly be were empty words if access to such nfotmaion'of public concefn is denied, except
under limitations presctibed by implementing legislation adopted pursuant to the Constitution.

x x x It is in the interest of the State that the channels for free political discussion be maintained to the end that the govefirment may perceive and be responsive to the people's willYet, this open dialogue can be effectiv'e only to the extent that the citizenry is inforrned and thus able to formulate its will intelligendy. O"ly when the participants in the discussion are arwate of the issues and have access to informadon relating thereto can such beat fruit.

The right to infoonation is an essential premise of a meaningful tight to speech and expression. But this is not to say that the right to information is merely at:- adjunct of and
therefore restricted in application by the exercise of the fteedoms of speech and of the press. Far from it. The right to information goes hand-in-hand with the constitutional policies of full public disclosute and honesty in the public service. It is meant to enhance the widening role of the citizenry in goveflrmefrtal decision-making as well as in checking abuse in govemment. Chavez vs PCGG (G.R Supreme Court noted:

3L. In

No. 130716, Decembet 9,

1988), the

f'his principle is aimed at affotding the people an opportunity to determine whether those to whom they have entnrsted the affairs of the goveflrment are honestly, faithfully and competendy performing their functions as public ser\rants. Undeniably, the essence of democracy lies in the ftee flow of thoughq but thoughts and ideas must be well-

Certainly, it is by ensuring an unfettered and uninhibited exchange of ideas among a wellinfor:ned public lhat a government remains responsive to the
changes desired by the people.

32. Finally, in
Supreme Court stated:

Chavez vs

PEA (G.R. No.

These t$dn provisions of the Constitution seek to promote transpareflcy in poliry-making and in,the operations of the government, as well as ptovide the people suffi.cient informatiori to exercise effectively other constitutional rights. These t"vin provisions are essential to the exercise of freedom of e:rpression. If the government does not disclose its offi.cial acts, Eansactions and decisions to citizens, whatever citizens say, evefl if expressed without aurly resttaint, will be speculative and amoutrt to nothing. These trxrin provisions are also essential to hold public officials t'at all times x x x accountable to the people," for unless citizens have the proper information, they cannot hold public officials accountable for anything. Armed with the right
information, citizens can participate in public discussions leading to the formulation of govefirment policies and their effective irnplementation. Arr informed ciizenry is essential to the existence and propet functioning of any democracy.

EXPI.AI\ATORY NOTE The people's dght to information held by govenrment is expressly rccogmzed in no less than the Constitution. Article III @ill of Rights), Sec. 7
of the 1987 Constitution states:

The dght of the people to information ofl matters of

public concefll shall be recognized. Access to official records, and to documents and papers pertaining to official acts, transactions, or decisiofls, as well as to goveffrment research data used as basis for policy developmenq shall be afforded the ciazen, subject to such limitations as may be provided by law.
Complementing the Bill of Rights ptovision on FOI is the state policy of firll disclosure of all state transactions involving public interest. Article II (Declaration of Principles and State Policies), Section 28 reads:

Subiect

to

reasonable conditions ptesctibed

by law, the

State adopts and implements a policy of full public disclosure all its transactions involving public interest.

of

While the Supteme Court has consistendy held that the nght to information under the Bill of Rights is self-executorlr it lacks the substantive and procedural details necessary for its effective and predictable
implementation.

This Initiative Bill, filed under Section 3 (b) and Section 77 of Republic Act 6735, or "The Initiative and Refetendum Act", has the following chief
specifi.c pu{poses:

Fitst, it seeks to add.tess the lack of definite scope and limitations to the right to information. Second, it seeks to address the absence of a uniform and effective ptocedure for access to information. Third, it seeks to address the absence of sanctions fot unlawfirl denial or delay of access to information. Fourth, it introduces mechanisms to facilitate better citrzer, access to rnformation, such as providing standatds for recotd keeping and mandating the pro-active disclosure of classes of information imbued with high public interest.
Beyond the above specific pu{poses, the Initiative Bill wiII also promote the general purposes that the framers of the Constitution sought to achieve with the e{press recognition of the right to information and the adoption of fiill disclosure of tansaclions as state policy. The twin constitutional ^ provisions of the right to information and the policy of full public disclosure of government ftansactions are inteflded to promote the fundamental precepts of democracy, people's participation, public office being a public trust, government accountability, prevention of corruption, and responsive decisionmaking.

The enactnent of this Initiative Bill is eamesdy uged.
