e Waukee City Council was called to order by Mayor Peard at 5:33 p.m. in the Council Chambers at City Hall. Pledge of Allegiance Roll Call The following members were present: Mayor William F. Peard; Council Members Shane Blanchard, Casey L. Harvey, Shelly Hughes, Mike Watts. Absent: Council Member C. Isaiah McGee. Also present: City Administrator Tim Moerman, Director of Finance Linda Burkhart, Director of Development Services Brad Deets, City Planner Ben Landhauser, Director of Public Works John Gibson, Parks and Recreation Director Matt Jermier, City Clerk Rebecca D. Schuett, City Engineer Forrest Aldrich, City Attorney Steve Brick. Open Forum Tim Wilson, 125 Northview Drive, voiced his concern regarding heavy truck traffic on Northview Drive; City staff will research the matter. Agenda Approval Council Member Harvey moved to approve the agenda; seconded by Council Member Blanchard. Results of vote: Ayes: Blanchard, Harvey, Hughes, Watts. Nays: None. Absent: McGee. Motion carried 4 0 1. Mayors Report Mayor Peard noted that a study shows the Alices Road/105th St. Interchange project is not likely to adversely affect the endangered Indiana Bat. He listed the Citys 4th of July festivities, including a sneak peek of the Waukee Community Center. On 07/02, Mayor Peard will meet with representatives of the Greater Des Moines Partnership, and on 07/08 will take part in interviews for the Citys Community and Economic Development Director position. Presentations: 1) Certificates of appreciation for years of service for employees who have worked a certain number of years for the City of Waukee Mayor Peard presented certificates for the following employees:

Public Hearings: 1) On plans, specifications, form of contract and estimate of cost [Sugar Creek Trail Project] Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Administrator Moerman replied in the negative. Parks and Recreation Director Jermier briefly reviewed the project. No comments were made by the public present. Mayor Peard declared the public hearing closed.

2) On an ordinance to amend Chapter 300, Zoning Ordinance, City of Waukee, Iowa by rezoning and changing certain property therein from R-1 [Single Family Residential District], R-3A [Owner Occupied Multi-Family Residential District]/PD-1 [Planned Development Overlay], R-4 [Row Dwelling & Townhome Dwelling District], C-1A [Neighborhood Commercial District] and C-1A [Neighborhood Commercial District]/PD-1 [Planned Development Overlay] to R-2 [One and Two Family Residential District], R-3 [Rental Multi-Family Residential District] and C-1A [Neighborhood Commercial] (Fox Creek Estates) Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Administrator Moerman replied in the negative. Director of Development Services Deets and Erin Ollendike with Civil Design Advantage (CDA), representing the applicant, briefly reviewed the rezoning request. Mr. Deets noted a sanitary sewer project nearing completion that would service the area in question. No comments were made by the public present. Mayor Peard declared the public hearing closed. 3) On an ordinance to amend Chapter 300, Zoning Ordinance, City of Waukee, Iowa by amending the Planned Development for Lot 1 of Williams Pointe Plat 13 including modification of the underlying zoning district of C-1 [Community and Highway Service Commercial District] to R-4 [Row Dwelling & Townhome Dwelling District] Mayor Peard opened the public hearing and asked if any written correspondence had been received; City Administrator Moerman replied in the affirmative, referencing a 07/01 letter from Carol Jahnke, 1313 SE University Ave. #106, in opposition to the rezoning application. At Ms. Jahnkes request, Mayor Peard read her letter aloud. Director of Development Services Deets briefly reviewed the rezoning application, including some history on the zoning changes in the Williams Pointe North area. David Smith of Equity Growth Group, representing the applicant (Valley Bank), discussed the application, noting that the parcel in question is too far removed from highway frontage to be commercially developed. He referenced a concept plan for development of the parcel as townhomes, stating that there were currently no development prospects for the parcel. Council Member Watts noted that the parcel was originally zoned residentially when the area was first platted and voiced his support for the rezoning application. Mayor Peard asked if anyone in attendance wished to speak on the matter under consideration. The following spoke in support of the rezoning application: 1) Art Ball, 630 SE Whitetail Ln. and head of maintenance for Thomas Place, Waukee Family Townhomes and the future Alice Place; 2) Kay Thomas, manager of Thomas Place; 3) Ardis Leister, 560 SE Brick Dr.; 4) Diane Haynes, 400 SE Jonas Cir.; 5) Ron Herr, 9710 Madison Ave., Urbandale; and 6) Doris Soderstrum, 560 SE Brick Dr. Those in favor noted job creation in the management and maintenance of townhome associations and the need for affordable housing. They also spoke in support of the current maintenance and management of the income-based units in the area. The following spoke in opposition to the rezoning application: 1) Nancy Cullen, 817 SE Williams Ct.; 2) Annette McCarthy of RJ Lawn and Landscaping, 16180 SE Laurel Ave.; 3) Roberta Martindale, 1313 SE University Ave., #206; 4) Scott Politte of Stivers Ford Lincoln, 1450 E. Hickman Rd.; 5) Justin Alliss, 560 SE Sagewood Dr.; 6) Bruce Meyer, 1416 SE Williams Ct. Those in opposition cited a high concentration of rental and low-income housing in the area, property maintenance issues, increased traffic and crime, and lower property values. Some also expressed doubt that the applicant did not yet have a development prospect for the parcel, noting that Mr. Smith had also represented a previous rezoning applicant who had planned income-based housing on the same parcel. Council Member Harvey noted that the City Council could only consider the rezoning application itself and not the applicant. Regarding property maintenance concerns, Mayor Peard stated that homeownership did not automatically equate to a well-maintained property. Council Member Watts requested a police report on calls for service in the area. Mr. Smith again addressed the City Council, stating that his representation of the current applicant did not mean it was the same previous applicant. He also reiterated that the applicant told him there is no current buyer for the parcel at this time. Council Member Hughes found it coincidental that Mr. Smith represented both the previous and current applicant; Mr. Smith stated that he and the different applicants

are all based in Davenport. Council Member Hughes expressed discomfort in leaving open the possibility of development of the parcel as income-based housing. Mayor Peard asked that Mr. Smith discuss the possible elimination of income-based housing development with the applicant; Mr. Smith agreed to do so. Mayor Peard declared the public hearing closed. Public Hearing Action Items: 1) Resolution: Consideration of approval of a resolution approving plans, specifications, form of contract and estimate of cost [Sugar Creek Trail Project] Council Member Harvey moved to approve the resolution; seconded by Council Member Blanchard. Parks and Recreation Director Jermier recommended the contract be awarded to Absolute Concrete of Slater, IA, in the amount of $224,023.40. Results of vote: Ayes: Blanchard, Harvey, Hughes, Watts. In response to concerns about traffic in the area, Mr. Deets noted that SE Brick Dr. is designated as a major collector roadway and reviewed those intersection in the area planned for future traffic signals. Council Member Harvey asked if the applicant would be amenable to an agreement that would remove the possibility of low income housing on the subject property; David Smith of Equity Growth Group, representing the applicant, agreed to bring up the matter with his client. Council Member Harvey then spoke in favor of the rezoning application, stating his belief that commercial development would not occur so far removed from the major corridors. Council Member Blanchard spoke against the rezoning application, stating that the property should remain commercial. In light of Council Member McGees absence, Council Member Watts encouraged his fellow council members to vote in favor of the first reading of the ordinance in order to move the second reading forward to a vote of the full council; in response, Council Member Blanchard agreed to vote in favor on the first reading only.
