76.0

SUPPLEMENTARY SPECIFICATIONS FOR CONTINGENCY WORKS

76.1

GENERAL Supplementary Specifications Section 76 is to be read in conjunction with the Standard Specifications For Building Works And Other Installations and other Supplementary Specifications. In case of discrepancies between Supplementary Specifications Section 76 and the Standard Specifications For Building Works And Other Installations and other Supplementary Specifications, Supplementary Specifications Section 76 shall prevail.

76.2

SCOPE OF CONTINGENCY WORKS The Contingency Works shall be carried out in HDB properties and for the following purposes: a) b) c) d) Ensuring safety of the residents or the public; Minimising nuisance and inconvenience to the residents and public; Protecting and safeguarding HDBs interests and public standing; and Carrying out work deemed fit or appropriate by the Superintending Officer.

Every individual contingency work done by work order will be measured on site and payment made according to the Standard Schedule of Rates plus 25%, 50%, 75% and 100% respectively of the Standard Schedules of Rates depending on the category of urgency for execution of contingency works as shown below: Category of Urgency for Execution of Contingency Works 1. 76.3

DURATION OF CONTRACT TERM FOR CONTINGENCY WORKS The Contract Term for Contingency Works shall be 24 months and commencing from the commencement date of the earliest phase under the Contract.

76.4

TOTAL ESTIMATED EXPENDITURE The total estimated expenditure for Contingency Works is $500,000.00. It may or may not exceed this amount depending on the actual quantities of work done towards the end of the Contract Term. This is indicative information and shall not be relied on by the Contractor in the preparation of the Tender

76.5 POWER TO REDUCE THE SCOPE OF OR OMIT TOTALLY THE CONTINGENCY WORKS The SO Rep shall have the right to omit completely the Contingency Works included in the Contract or reduce the scope of the Contingency Works included. The Contractor agrees and accepts that he shall not hold the Employer liable in any way for any loss or damages whatsoever caused or suffered in connection with or arising out of the omission of the scope of contract for Contingency Works.

76.6

PLANT, EQUIPMENT AND LABOUR For immediate and emergency cases, the following plant, equipment and labour shall be mobilised and provided by the Contractor within the time frame as follows: Item a) b) c) d) mobile crane mechanical suspended cradle mobile platform chain-linked fencing, approved hoarding boards, warning signs and lights, propping, strutting and protective devices and measures form-work and prop systems labour (skilled workers) Licensed plumber, licensed gas service workers and licensed electrical worker other plants and equipment as directed or required in the execution of the works Time Frame within two hours upon notification within four hours upon notification within twenty four hours upon notification within two hours upon notification within two hours upon notification within two hours upon notification within two hours upon notification within the time frame in the opinion of the SO Rep, is reasonable or practicable for emergencies

76.7

ORDER OF PROCEEDING AND EXECUTION OF WORK The Contingency Works shall be proceeded with due diligence and without delay and shall be completed within the time stipulated by the Employer/ SO Rep or prescribed in the Works Orders. The time for completion of the Emergency Works, as decided by the Employer/SO Rep, depends on the degree of urgency the Employer/SO Rep deemed necessary for completion. The degree of urgency is categorised as follows: Category Of Urgency For Execution Of Emergency Works 1. 2. 3. 4. 76.7 ORDER OF PROCEEDING AND EXECUTION OF WORK (CONTD) The Employer/SO Rep shall have the absolute discretion to decide on the classification of the Contingency Works into the various categories of urgency. These decisions will however be guided by the broad guidelines set out below: Category of Urgency for Execution of Contingency Works 1. Immediate (i) (ii) 2. Emergency

Classification of Contingency Works Irregularities of defects that may endanger life, limbs and properties (e.g. collapsing) Those which affect the security of the premises (e.g. collapsing partition walls)

Those that cause nuisance/annoyance or inconvenience to residents (e.g. water leaks) Defects in common areas posing risks to the residents (e.g. spalling concrete)

Normal

All other defects not classified and not coming within the definitions of the above three categories (e.g. repairs to wall cracks)

For works categorised under immediate or emergency, they can be initiated at anytime within 24 hours of the day by the Employer/ SO Rep. 76.8 LIQUIDATED DAMAGES The rates of liquidated damages are computed as follows: Category of Urgency Rates of Liquidated Damages

Immediate 10% of the value of each Works Order or $100.00 whichever is higher, per day for every day the Works remain incomplete.

Emergency 6% of the value of each Works Order or $60.00 whichever is higher, per day for every day the Works remain incomplete.

Urgent 4% of the value of each Works Order or $40.00 whichever is higher, per day for every day the Works remain incomplete.

Normal 2% of the value of each Works Order or $20.00 whichever is higher, per day for every day the Works remain incomplete.

Provided always that the maximum amount of liquidated damages imposed for Contingency Works under each Works Order shall be limited to 100% of the value of each Works Order.

RIGHT TO ORDER AND EXECUTE SPECIALISED WORK The SO Rep reserves the right to order such works or services which in the opinion of the SO Rep are deemed to be of a specialised nature, to be executed by other workmen or by other contractors or firms.

76.10 PHONE AND MESSAGING SERVICES The Contractor shall provide two handphone numbers with message leaving facilities to EMSU. It shall be the Contractors responsibility to receive and respond to calls within 15 minutes whenever called by the EMSU or the SO Rep. One handphone each shall be held by the Contractors project manager and the other by the Contractors general manager or managing director. All fees and expenditure incurred for the application, installation and maintenance of the 2 no. handphones shall be borne by the Contractor The Contractor shall ensure that his representatives holding the two handphones are contactable 24 hours a day throughout the Time for Completion and any time periods where liquidated damages are imposed under the Contract. This is to facilitate the issuance of instruction by the SO Rep for emergency repairs. The handphones must be switch on at all times throughout the time for Completion and any time periods where liquidated damages area imposed under the Contract. The Contractor shall also ensure that the handphones and batteries are in good working condition at all times.

76.11

FACILITIES FOR SUPERVISION The Contractor shall provide all facilities, instruments, proper access for the inspection of each stage of the Works in progress as and when directed by the SO Rep.

76.12

REMOVAL OF DEFECTIVE WORK OR MATERIAL Works which in the opinion of the SO Rep are not in compliance with the Contract and not to his satisfaction shall be removed from the site within 24 hours or made good by the Contractor upon receipt of instruction from the SO Rep. Should the Contractor fail to comply, the SO Rep may instruct the Works to be rectified by another contractor and all costs and expenses plus administrative charges to be decided by the SO Rep shall be borne by the Contractor.

76.13

TAKING OF DIGITAL PHOTOGRAPHS Where Contingency Works are to be carried out, the Contractor shall provide for the taking of digital photographs before, during and after the execution of the Contingency Works. All digital photographs shall be submitted to the SO Rep for record purposes. The Contractor shall bear all the costs and expenses incurred arising from the usage of the digital camera and the submission of the digital photographs.

76.14

EXISTING WORKS COVERED BY WARRANTY If the Contingency Works affect or disturb any works for which a pre-existing warranty had been furnished to HDB or the Town Council, the Contractor shall ensure that the terms and conditions of such warranty will continue to remain in effect for HDB or the Town Council. For this purpose, the Contractor must either: a) Engage the original contractor or specialist who had furnished the warranty to carry out the reinstatement work and provide an undertaking to uphold the terms and conditions of the warranty; or Reinstate the work himself and warrant the work on the same terms and conditions as stipulated in the warranty furnished by the original contractor/specialist.

NOTICES TO THE RESIDENTS During the execution of the repair, the Contractor is required to serve notices to the residents or display notices at the common areas.

76.16

REMOVAL OF DEBRIS AND REINSTATEMENT OF COMMON AREA The Contractor shall collect all debris in bags and remove them at the intervals decided by the SO Rep. The Contractor shall also clean and reinstate all common areas to its original condition upon completion.

TESTING OF MATERIAL FOR CONTINGENCY WORKS ORDER As and when directed by the SO Rep, material testing shall be carried out at the Site or at SAC-SINGLAS laboratories or at HDB Prefabrication Technology Centre or at other laboratories as approved or at the place of manufacture or fabrication. The Contractor shall ensure timely delivery of materials having regard to the programme for the Works submitted and the testing of materials to be carried out. The cost and expense for carrying out such material testing as directed by the SO Rep shall be borne by the Employer, provided that such tests pass the requirements stipulated under the Contract. The Contractor shall bear the cost and expense of any test that fails.

76.18

PROVISION OF STANDING SUPERVISION Depending on the nature, characteristics and the extent of the works, the SO Rep may direct the Contractor to provide standing supervision of the works on a full time basis. The Contractor shall keep proper records of the working hours of all standing supervision employed and such records must be verified by the SO Rep before payment can be effected. Where such instruction is given by the SO Rep, the cost and expense for the provision of standing supervision shall be borne by the Employer. Payment shall be in accordance with the Contract provisions. All other supervision costs shall be deemed to be included as an overhead component of the Rates used in the payment for the works.

76.19

INSURANCE FOR CONTINGENCY WORKS The Contractor shall provide insurance coverage for Contingency Works. The Contractor shall ensure that the insurance policies issued for the Contract in accordance with Clauses 27 and 28 of the Conditions and Clause 1.1.56 of the Specifications include coverage for the main Part(s) of the Contract as well as for the Contingency Works. The sum insured for the Contingency Works shall be the same as the total estimated expenditure stipulated in Clause 76.4. This amount shall be included in the total sum insured in the insurance policies for the whole Contract.

76.20

SUBMISSION TO AUTHORITY For cases where Contingency Repair which requires submission to Building and Construction Authority (BCA), Contractor has to engage a Qualified Personnel (Professional Engineer) to carry out structural assessment, repair and supervision works. The Contractor is also required to sign off as Builder under the completion certificate to BCA when requested by SO Rep.
