MEMORANDUM

Subject: Referrals to the Division of Vocational Rehabilitation Services

We have met with representatives of the Division ofVocational Rehabilitation Services (DVRS) to
establish a protocol for referrals to DVRS which is uniform throughout the State. Such referrals are
particularly useful in total disability cases where a neutral review of employability is helpful.

It was agreed that whenever a "Confidential Referral to DVRS"(by form WC-37 attached) is made,
the petitioner's attorney shall supply the Judge with all pertinent medical records either at that time or within
one cycle. Once the proper information has been received, the Judge shall sign the referral and the Head
Clerk will forward the referral form and medical records to the applicable local DVRS office, list attached.
A copy of the referral form only will be sent by the Head Clerk to Assistant Director Alexander Kirk of the
DVRS Central Office, address at top of list, for tracking purposes.

An answer from DVRS as to the status of the referral is expected to be made to the Judge of
Compensation within four weeks. Therefore, the matter is to be adjourned for no more than two cycles
following a DVRS referral.

The Judge ofCompensation and the petitioner's attorney are to direct the petitioner to cooperate with
the DVRS and any request by DVRS for records, testing, interviews or other matters.

It is expected that this new protocol will expedite appropriate assistance to injured workers and
provide expeditious review of vocational rehabilitation issues.
