Ave.,/ Kailua, HI 96734 We are glad you have reserved our vacation home to create your vacation memories. We have taken pride in preparing our home to give you a pleasant and relaxing visit. Since you will be in our home, we ask you to treat it as your own. Terms of your rental: 1. CHECK-IN TIME is AFTER 4 P.M. HST (No Early Check-ins please) 2. CHECK-OUT TIME is by 11 A.M. HST. (No Late check-outs please) 3. This is a NON SMOKING unit. 4. Pets are not permitted in rental units with exception to pets for persons with disabilities. 5. We will not rent to vacationing students or singles under 25 years of age unless accompanied by an adult guardian or parent. 6. RESERVATIONS - may be placed up to two (2) years in advance, but are subject to the rates in effect for the year said reservations are placed. 7. RESERVATION DEPOSIT - A reservation deposit of 50% of total bill will assure that we hold your dates. Once a deposit is made, your dates are blocked off on our calendar. The 50% deposit is credited toward the balance due. If no deposit is made, someone else may reserve your dates. Deposits made on stays based on a Discount or Special Rate are non-refundable. 8. SECURITY DEPOSIT/DAMAGE INSURANCE (Required for monthly rentals)- The security/damage deposit may be paid in one of the following ways: Credit Card-In lieu of a damage deposit, the tenant must provide a valid, current credit card number (Mastercard, Visa or Discover card). A hold may be placed on your credit card for up to $300. Damages, if any are incurred, will be billed to this credit card and an explanation will be emailed within (3) days of your departure. Damage Insurance- You will be billed $49 for $1500 in Accidental Rental Damage Insurance (ARDI). ARDI is an insurance plan that provides coverage for accidental damages to your vacation rental property during your stay, in place of a security deposit. ARDI covers unintentional damage to your vacation rental property during your stay, up to $1,500. Renters commonly use ARDI to cover things like carpet spills, furniture tears, broken lamps and more. Additional information will be provided upon request. Check- A $300 security deposit may be paid by check. All payments must be made in US funds. The damage deposit is NOT credited toward the balance due. Deposit checks must be received in our office within five (5) business days; you will be emailed a confirmation when your check is received in our office. Your damage deposit will be refunded after check-out once the rental is inspected and verified that all check-in/check-out procedures were followed (See below). If damages are incurred, a statement with the amount deducted from the deposit and an explanation of charges will be emailed within three (3) days of your departure date. 1. 2. 3. 4. 5. 6. 7. 8. 9. 10. 11. 12. 13. Deposits are returned to guests if the following criteria are met: Number of occupants does not exceed the maximum number of guests allowed. Check-in and Check-out according to times arranged. Owner is notified upon check-in if unit is unsatisfactory or items are missing/damaged. No damage to building, furniture or appliances. Premises are in same neat tidy condition as the Guest found upon check-in. No noise disturbances are reported. No evidence of smoking in or on the property is found. Towels and linens have not been damaged or taken out of the unit with the exception of beach towels. The refrigerator has been emptied of all food purchased during your stay. Dirty dishes have been washed and placed back in the cabinet. Garbage and recyclables have been removed and placed in proper receptacles. Garbage- gray container, Recyclables- blue container. Extra set of keys are left next to kitchen sink. All windows and doors are closed and locked. Ceiling fans may be left on but lights and TV must be turned off.

9. UNIT- The unit(s) you are renting are completely furnished with all of the appliances and utensils necessary for an enjoyable vacation. Nothing should be taken out of the unit, except the beach towels and other beach items. Your rent includes basic cleaning after you leave. If excessive cleaning is required, or if items are stained, damaged, or missing, additional charges will be billed if Accidental Rental Damage Insurance has not been purchased. You hereby agree to pay for any excessive cleaning fees, damaged, or missing items. COCONUT GROVE HALE- (3 bedroom/2 bathroom 1500sf single family residence) COCONUT GROVE COTTAGE- (1Bedroom/1 bathroom 600sf detached cottage studio apartment) 10. PAYMENT FOR NIGHTLY AND WEEKLY RENTALS - The BALANCE OF RENT is due at least thirty (30) days prior to your arrival date. Acceptable forms of payment are MasterCard, Visa or Discover credit card, or personal checks payable to Modern Homes By Design. Personal checks for final payment must be received at least 2 weeks before your arrival date. a) Returned checks will be charged a $35 insufficient funds fee. No personal checks will be accepted for stays reserved under (7) seven business days before arrival date. Last minute reservations must be paid by credit card or cash. 11. PAYMENT FOR MONTHLY RENTALS - The rent is due the 1st of the month. Acceptable forms of payment are MasterCard, Visa, Discover credit card or personal checks payable to Modern Homes By Design. a) Returned checks will be charged a $35 insufficient funds fee. LATE FEES- You must pay a late fee of $100.00 for each payment we do not receive by 12:00pm of the 5th day after payment is due. Interest at 2% per year will be charged on all rent and other sums you do not pay to us on time. 12. CANCELLATIONS - A thirty (30) day notice is required for cancellations before your arrival date. Cancellations that are made more than thirty (30) days prior to the arrival date will incur no penalty. Cancellations or changes that result in a shortened stay, that are made within thirty (30) days of the arrival date, forfeit the full reservation deposit and any payments. Early departure does not warrant refund of deposit or payments. After 30 days of renting, your agreement automatically converts to a Month-to Month agreement, you must give written notice at least twenty-eight (28) days in advance to terminate and you must pay rent for the twenty-eight (28) days. We must give you written notice at least forty-five (45) days in advance to terminate. You may move at any time during the last forty-five (45) days and shall notify us of your vacate date and pay a prorated rent for the time you occupy the unit. 13. REFUNDS- Refunds are not provided after thirty (30) days prior to arrival date. Reservations with discounts or special rates are non-refundable. 14. MAXIMUM OCCUPANCY- The maximum number of guests per unit is: COCONUT GROVE HALE: Maximum of six (6) persons COCONUT GROVE COTTAGE: Maximum of four (4) persons 15. NOISE- The unit(s) you are renting are located in a quiet, residential neighborhood, therefore no partying, smoking or drinking alcoholic beverages outdoors is allowed after 10:00pm. Quiet Time begins at 10:00pm. Please respect our neighbors. If a noise disturbance is reported, $100 will be deducted from the security deposit or billed to your credit card on file. Renters are also responsible for their guests. 16. LINENS- Rental rate includes a one time set up of one (1) towel per person and enough linens per bed. Towels or linens are not to be taken from the unit. Beach towels are provided for your use but must be returned to the unit in good condition. 17. NO DAILY MAID SERVICE - While linens and bath towels are included in the unit, daily maid service is not included in the rental rate, however it is available at an additional charge per request. We do not permit bathroom towels or linens to be taken from the cottage. Beach towels are provided for your use but must be returned to the cottage. a) INCLUSIVE FEES - Rates include a one-time linen-towel setup. 18. PARKING - Parking is limited to one (1) vehicle. Vehicle is to be parked in designated parking area only. Parking on the road is limited. Any illegally parked cars are subject to towing; applicable fines/towing fees and is the sole responsibility of the vehicle owner. COCONUT GROVE HALE- Right side of carport (when facing the house).

GARBAGE/RECYCLABLES Tenant staying in the Coconut Grove Hale (main house) is responsible for garbage and recyclables removal to the curb. Garbage is picked up by the City and County of Honolulu once a week on Saturday morning. a) Garbage is to be placed in the gray dumpster. The tenant is responsible for placing the gray dumpster at the curb by 6am for Saturday morning pickup. The dumpster may be placed at the curb the night before. b) Recyclables are to be placed in the blue dumpster. Recyclables are picked up once every other week on Wednesday morning. The tenant is responsible for placing the blue dumpster at the curb by 6am for morning pickup. The dumpster may be placed at the curb the night before. A calendar with pickup dates is in the kitchen. c) Green Waste- Green waste is placed in the green dumpster by our lawn maintenance company or property manager. The property manager or lawn maintenance personnel will stop by to put out the green waste container. 20 WRITTEN EXCEPTIONS - Any exceptions to the above mentioned policies must be approved in writing in advance. 21. HURRICANE OR STORM POLICY - No refunds will be given unless: a) The National Weather Service orders mandatory evacuation in a "Tropical Storm/Hurricane Warning area" and/or b) A "mandatory evacuation order has been given for the Tropical Storm/Hurricane Warning" area of residence of a vacationing guest. The day that the National Weather Service orders a mandatory evacuation order in a "Tropical Storm/Hurricane Warning," area, we will refund: a) Any unused portion of rent from a guest currently registered, b) Any unused portion of rent from a guest that is scheduled to arrive, and wants to shorten their stay, to come in after the Hurricane Warning is lifted; and c) Any advance rents collected or deposited for a reservation that is scheduled to arrive during the "Hurricane Warning" period. 22. EMERGENCY PREPARDENESS- These units are located in a flood zone. They are prepared with a portable emergency radio, flashlight and an emergency nightlight that comes on in the event there is a power failure. Guest(s) should listen to the radio for evacuation instructions. There is no backup generator for this property. The nearest shelter is located at Kailua Elementary School on Kailua Rd. 23. LOST KEYS - A charge of $150.00 will be incurred for lost keys. 24. The owner is not liable for personal injuries or stolen items.
