Last Will and Testament of

James S. Elder
In the name of God, I James S. Elder of the county of Perry and State of Indiana do make and publish this my last will and testament. I give and bequeath to my son George Arnold Elder the West half of the North East quarter of section (29) twenty nine Township (5) five South of Range one West. I give and bequeath my beloved wife the South East quarter of the North East quarter of Section (29) twenty nine in township (5) south of Range one west. Also the North half of the south East quarter of section twenty nine in Township five South of Range one West so long as she remains a widow. Also all the personal property belonging to me. I also give her full power to settle up all my business without being accountable for any property she may dispose of as I do not ___out any administrator on my estate. His Mark X Jas S. State of Indiana Perry County Be it remembered that on the 12th day of August 1862 Leonard Mitchell and Wm Heath the subscribing witnesses to the within and foregoing last will and testament of James S. Elder late of said county deceased personally appeared

before me W.P. Drumb Clerk of the Court of Common Pleas of Perry County in the State of Indiana and being duly sworn by the Clerk of said court upon their 100th declared and testified as follows that is to say that on the 24th day of June 1862 they saw the said James S. Elder sign his name to said instrument in writing as and for his last will and testament and that these deponents at the same time heard the said James S Elder declares the said instrument in writing to be his last will and testament and that the said instrument in writing was at the same time at the request of the said James S Elder and with his consent attested and subscribed by the said Leonard Mitchell and Wm Heath in the presence of said testator and in the presence of each other as subscribing witnesses _____ and that the said James S Elder was at the time of the signing and subscribing of the said instrument in writing as aforesaid of full age (that is more than twenty one years of age) and of sound and disposing mind and memory and not under coercion or restraint as the said deponents verily believes: and further deponents says not. Leonard Mitchell William Heath Subscribed and sworn to by the said Leonard Mitchell and Wm Heath before me W.P. Drumb Clerk of said Court at Cannelton the 12th day of August 1862. State of Indiana, Perry County, S.S. I, W.P. Drumb Clerk of the Court of Common Pleas of Perry County Indiana do hereby certify that the within annexed last Will and Testament of James S. Elder has been duly admitted to probate and duly proven by the testimony of Leonard Mitchell and William Heath the subscribing witnesses thereto that a complete record of said will and the testimony of the said Leonard Mitchell and William Heath in proof thereof has been by me duly made and recorded in Book B at pages 106 and 107 of the record of Wills of said county.
