As this RFP contains sensitive information, Walsh Construction asks that interested subcontractors sign the confidentiality agreement below in order to receive the design documents. Once we receive your signed confidentiality agreement, you will be given the link to our Private Newforma site. CONFIDENTIALITY AGREEMENT
THIS AGREEMENT is made and entered into between Walsh and the undersigned company (hereinafter Bidder); WHEREAS, Walsh is unwilling to permit Bidder the opportunity to submit a bid or proposal to furnish materials, work or services on the Design-Build W91238-13-R-0036 Satellite Earth Terminal Station Facility in Camp Roberts, CA without an agreement between Walsh and Bidder that Bidder shall maintain the confidentiality of all proprietary information received from Walsh, and shall use such proprietary information in strict accordance with the terms and conditions in this Agreement; THEREFORE, Walsh and Bidder agree as follows: 1. All drawings, specifications, design criteria, sketches, value engineering, and all other information furnished by Walsh or a member of Walshs team INCLUDING W91238-13-R-0036 Satellite Earth Terminal Station Facility in Camp Roberts, CA issued solicitation, drawings, and specifications in connection with the W91238-13-R-0036 Satellite Earth Terminal Station Facility in Camp Roberts, CA regardless of whether prepared or developed by Walsh, The USACE, or by any other person or firm, shall be considered proprietary information. 2. Except as expressly permitted in writing by a duly authorized representative of Walsh, Bidder agrees not to disclose any proprietary information, directly or indirectly, to any person or firm, other than to subcontractors and suppliers (whether actual or prospective) of Bidder for the sole purpose of providing pricing information, materials, work or services for or in connection with the W91238-13-R-0036 Satellite Earth Terminal Station Facility in Camp Roberts, CA and provided only if such subcontractors and suppliers have executed a similar Confidentiality Agreement.
