5. PUBLIC COMMENT During Public Comment, issues NOT on the agenda may be addressed. Public comments concerning items on the agenda will be allowed when that item is discussed by the Council. Anyone wishing to make a comment must fill out the provided form and present it to the City Clerk. In the interest of time comments will be limited to three (3) minutes. This privilege may be revoked by the Mayor in the case of inappropriate language or comments. Any public member shall first state his or her name and address, followed by a concise statement of the person's position or concern. All remarks shall be addressed to the Mayor or the Council as a whole, not to any particular member of the Council. No person other than the Council members and the person having the floor shall be permitted to enter into any discussions without permission of the Mayor. 6. Third Reading Ordinance 825 Requiring Approval of Specific Plans With no objections, Mayor Watson may call for the third reading of the ordinance requiring approval of specific plans by the Maumelle Planning Commission for above ground placement of any transmission facilities in industrial zoned areas. Third Reading Ordinance 826 Concerning Banners in Certain City Parks With no objections, Mayor Watson may call for the third reading of the ordinance amending the Maumelle City Code concerning banners in certain City parks. A MOTION IS IN ORDER. Mayor Watson C. Second Reading Ordinance 827 Declaring Extra Territorial Jurisdiction With no objections, Mayor Watson may call for the second reading of the ordinance declaring extra territorial jurisdiction by the City of Maumelle and adopting a map. NO ACTION IS REQUIRED.

Second Reading Ordinance 828 Waiving Competitive Bidding Procedures With no objections, Mayor Watson may call for the second reading of the ordinance waiving the competitive bidding procedures for the purchase of a weather warning siren for the fire department NO ACTION IS REQUIRED. Mayor Watson E. Resolution 2013-38 Adopting a Strategic Plan With no objections, Mayor Watson may call for the reading of the resolution approving a strategic plan for the City of Maumelle. First Reading Ordinance 829 Regarding Golf Cart Operation With no objections, Mayor Watson may call for the first reading of the ordinance regarding the operation of golf carts on City streets. MINUTES REGULAR MEETING CITY COUNCIL CITY OF MAUMELLE OCTOBER 7, 2013 6:00 PM CITY HALL

Mayor Watson called the meeting to order at 6:00 p.m. with seven members present. Alderman Anderson was absent. City Clerk Clausen gave the Invocation and led the Pledge of Allegiance. MINUTES- September 17, 2013 Alderman Johnson moved to approve the minutes of the September 17, 2013 meeting. Alderman Lewis seconded the motion and it passed unanimously by all in attendance. PUBLIC COMMENT Jim Moreno, of 7 Southland Drive, stated the City's biggest problem was traffic. He proposed having a traffic lights near the 1430 bridge to help the problem. William Page, of 12 Masters Place, presented facts regarding water usage from Lake Willastein. He gave the Council hard copies of his statement. Alderman Mosley stated that he was trying to gather information from several parties on the subject. Steve Hillis, of 6 Thomas Court and board member of Maumelle Country Club, stated he would share any information the Council would need and felt the Country Club was a partner with the City. Alderman Lewis asked what the cost of replacing the greens would be. Mr. Hillis stated in 2008 for 18 holes it cost $150,000. Alderman Lewis stated he didn't see the value in this conversation and that losing the country clubs would be catastrophic. Alderman Mosley stated there needed to be a more formal and consistent manner to handle these situations. Mayor Watson stated the situations have been handled consistently and that they were allotted 4 inches of water for each time they need it and a maximum of 18 inches in Lake level reduction. He also noted the clubs hate to call and ask for water. Alderman Hogue stated she would like to see an updated agreement. Alderman Lewis agreed with Alderman Hogue. Alderman Mosley stated he would like to talk with other golf courses on their policies. 1

Alderman Johnson noted that the water is not taken from Maumelle Water Management, but from Lake Willastein. PROCEDURAL MOTION Alderman Lewis moved to have all ordinances and resolutions read by title only. Alderman Hogue seconded the motion and it passed unanimously by all in attendance. ORDINANCE 825 REQUIRING APPROVAL OF SPECIFIC PLANS With no objections, Mayor Watson called for the second reading of the ordinance requiring approval of specific plans by the Maumelle Planning Commission for above ground placement of any transmission facilities in industrial zoned areas. The City Clerk gave the reading. ORDINANCE 826 CONCERNING BANNERS IN CERTAIN CITY PARKS With no objections, Mayor Watson called for the second reading of the ordinance amending the Maumelle City Code concerning banners in certain City parks. The City Clerk gave the reading. City Attorney JaNan Davis stated she had looked into content restriction on banners and advised against it. Mrs. Davis stated its best to work out the details in the contract and not in the code. RESOLUTION 2013-30 DISCLAIMING AND OR TRANSFERRING OWNERSHIP With no objections, Mayor Watson called for the reading of the resolution disclaiming and or transferring any ownership or interest in Tract C of the Villages of New Bedford. The City Clerk gave the reading. Mayor Watson gave a brief description of the area. Alderman Mosley asked if this would affect the property owner's association. City Attorney Davis stated New Bedford, LLC was the majority member. Alderman Johnson moved to approve the resolution. Alderman Kelley seconded the motion and it passed unanimously by all in attendance. RESOLUTION 2013-31 REGARDING SURPLUS PROPERTY With no objections, Mayor Watson called for the reading of the resolution approving the disposal of a Mack truck from the public works department. The City Clerk gave the reading. Alderman Lewis moved to approve the resolution. Alderman Johnson seconded the motion and it passed unanimously by all in attendance. RESOLUTION 2013-32 CERTIFYING RATES OF TAXATION FOR 2013 With no objections, Mayor Watson called for the reading of the resolution certifying to Pulaski County rates of taxation to be levied on Maumelle for 2013 for real and personal property. The City Clerk gave the reading.

Alderman Lewis moved to approve the resolution. Alderman Johnson seconded the motion and it passed unanimously by all in attendance. RESOLUTION 2013-33 AMENDING THE 2013 SANITATION FUND BUDGET With no objections, Mayor Watson called for the reading of the resolution amending the 2013 Sanitation Fund Budget appropriating funds for the purchase of a sanitation truck. The City Clerk gave the reading. Alderman Lewis moved to approve the resolution. Alderman Johnson seconded the motion and it passed unanimously by all in attendance. RESOLUTION 2013-34 AMENDING THE 2013 GENERAL FUND BUDGET With no objections, Mayor Watson called for the reading of the resolution amending the 2013 General Fund Budget appropriating funds for the purchase of truck for animal control. The City Clerk gave the reading. Alderman Hogue moved to approve the resolution. Alderman Lewis seconded the motion and it passed unanimously by all in attendance. RESOLUTION 2013-35 AMENDING THE 2013 STREET FUND BUDGET With no objections, Mayor Watson called for the reading of the resolution amending the 2013 Street Fund Budget appropriating funds for the purchase of a street sweeper. The City Clerk gave the reading. Alderman Norris asked for the bid tabulation. City Clerk Clausen stated one bid came in at $182,239.96 and the other came in at $211,628. He stated we would need an additional $35,000 to purchase the street sweeper. Alderman Mosley asked if the City really needed a street sweeper. Mayor Watson stated the street sweeper is used daily to collect debris on the streets of the City. City Clerk Clausen stated the City hoped to recoup the additional funds through a trade in. Alderman Lewis noted the street sweeper would also help the sewer systems and other City functions. Alderman Johnson moved to approve the resolution. Alderman Hogue seconded the motion and it passed with only Alderman Mosley voting no. RESOLUTION 2013-36 AMENDING THE 2013 GENERAL FUND BUDGET With no objections, Mayor Watson called for the reading of the resolution amending the 2013 General Fund Budget appropriating grant funds for the construction of a wetlands trail and viewing station. The City Clerk gave the reading. Mayor Watson stated this money is a grant issued by Arkansas Game and Fish and this resolution is just appropriating the funds. 3

Alderman Lewis moved to approve the resolution. Alderman Kelley seconded the motion and it passed unanimously by all in attendance. RESOLUTION 2013-37 AMENDING THE 2013 GENERAL FUND BUDGET With no objections, Mayor Watson called for the reading of the resolution amending the 2013 General Fund Budget appropriating STEP grant funds to the police department. The City Clerk gave the reading. Aldeuuan Norris asked what innovative strategies the Police Department had planned to use the grant on. Chief of Police, Sam Williams, noted sobriety checkpoints and advertising would be used. Alderman Lewis moved to approve the resolution. Alderman Kelley seconded the motion and it passed unanimously by all in attendance. ORDINANCE 827 DECLARING EXTRA TERRITORIAL JURISDICTION With no objections, Mayor Watson called for the first reading of the ordinance declaring extra territorial jurisdiction by the City of Maumelle and adopting a map. The City Clerk gave the reading. ORDINANCE 828 WAIVING COMPETITIVE BIDDING PROCEDURES With no objections, Mayor Watson called for the first reading of the ordinance waiving the competitive bidding procedures for the purchase of a weather warning siren for the fire department. The City Clerk gave the reading. Alderman Lewis asked if this was an emergency. Chief Glenn stated it was not. Alderman Mosley asked the cost of the new siren. Chief Glenn stated it is $27,000. City Clerk Clausen noted that it was approved in the budget but that state law required a bid or waiving of the bidding procedures. Alderman Hogue asked where the location of the siren would be. Chief Glenn stated the siren would be at the end of Country Club Parkway by the ball fields. RESOLUTION INTRODUCTION 2013-28 ADOPTING A STRATEGIC PLAN Crafton Tull presented the strategic plan to the Council and took questions. Alderman Mosley stated he was concerned about binding language in the resolution. City Attorney Davis stated that the Council was the only body that could amend the Maumelle City Code and that all recommended changes would come before them. MAYOR'S COMMENTS Mayor Watson gave background on the Lake Willastein water situation and stated that the Mayor represents all Maumelle residents, despite comments to the contrary. He stated that the Council had a responsibility to represent corporate citizens as well as individuals and asked the Council to consider that. 4

Alderman Mosley stated that in considering the residents, that the aldermen should be involved in the decision. He stated that we should revisit and formalize the Lake Willastein Water agreement. Alderman Lewis stated that there was no crisis here and that the agreement had worked fine for 20 years. He stated he would have a problem with the logistics of the Council having to make a case by case call. Alderman Johnson stated that the Council was chasing its tail with this subject and should move on to working on the strategic plan. He noted that the water agreement was helping an industry in Maumelle.

Mayor Watson stated the budget workshop tentative dates were October 29, November 6 and November 13. Mayor Watson stated that there was an open house for the Wetlands Management Plan on the 8th and 9th this week. Mayor Watson stated that Judge Buddy Villines would not be running for re-election at the end of his term and wished him well. Mayor Watson stated the Fire Department will be doing fire hydrant testing October 10- November 15 PLANNING COMMISSION REPORT Alderman Saunders gave a report on the Planning Commission proceedings. He stated that a variance for a storage facility was denied. He stated that two variances were approved in order to let one home rebuild a deck in disrepair. He stated that a site and landscape plan were approved for BEI. He stated that the extraterritorial jurisdiction map and strategic plan were approved. ALDERMEN'S COMMENTS Alderman Hague asked if the boat ramp was finalized. Mayor Watson stated we were just waiting on a courtesy dock and the project would be complete. Alderman Lewis asked when trick-or-treating would be. Mayor Watson stated trick-or-treating would be on Halloween night. Alderman Saunders noted a Veteran's Day ceremony November 11 at 2:00 pm at the Charter School and 4:00 pm at the Veteran's Memorial. Alderman Mosley stated he enjoyed listening to the audio recordings of meetings posted by Aldermen Lewis.

ADJOURNMENT Aldermen Lewis moved to adjourn the meeting. Alderman Kelley seconded the motion and it passed unanimously. Mayor Watson adjourned the meeting at 8:38 p.m.

CITY OF MAUMELLE Note 1: Minimum fund balance policy for the general fund

NOTES TO FINANCIAL STATEMENTS

Ordinance 438 states that the general fund shall maintain a level of fund balance equal to 20% of budgeted operating expenditures. Currently, this figure is $ 2,202,021

Note 2: Fund balance classifications Effective with the January 31, 2011 financial statements, there are new fund balance classifications for the General and Street funds. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MAUMELLE, COUNTY OF PULASKI, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: ORDINANCE NO. 825 AN ORDINANCE REQUIRING APPROVAL OF SPECIFIC PLANS BY THE MAUMELLE PLANNING COMMISSION FOR ABOVE GROUND PLACEMENT OF ANY TRASMISSION FACILITIES IN INDUSTRIAL ZONED AREAS IN THE CITY OF MAUMELLE, AND FOR OTHER PURPOSES WHEREAS, The City of Maumelle requires that all transmission lines be buried underground within the city and provides an exception to this standard only with regard to properties within industrial zoned areas, and WHEREAS, it is an unnecessary burden on local businesses, organizations, and residents to require approval from both the City Council and planning commission to place certain facilities above the surface of the ground in industrial zoned areas; WHEREAS, the City Council is committed to removing unnecessary regulatory burdens on local businesses, organizations, and residents; and WHEREAS, The City Council does wish to defer approval on this issue to the Maumelle Planning Commission finding that the Commission is better suited to consider the technical elements relevant to the approval of such overhead transmission lines in industrial zones. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MAUMELLE, ARKANSAS, THAT: SECTION I. Chapter 86 - Utilities, Article L In General, Section 86-1. - Restrictions, of the Maumelle City Code, is hereby amended to read as follows: Section 86-1. Restrictions No facilities, including poles or wires, for the transmission or distribution of electricity, telephone messages, cable television and the like shall be placed or maintained above the surface of the ground on any lot, property or right-of-way within any area zoned residential or commercial within the city. No such facility may be erected in industrial zoned areas unless specific plans are submitted to and approved by the planning commission, for review and then

SECTION 3. All provisions of this ordinance of a general and permanent nature are amendatory to the Maumelle City Code and the same shall be incorporated in the Code. SECTION 4. Repealer. All other ordinances or parts of Ordinances in conflict herewith are hereby repealed to the extent of the conflict. SECTION 5. Severability. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MAUMELLE, COUNTY OF PULASKI, STATE OF ARKANSAS ORDINANCE NO. 826 AN ORDINANCE OF THE CITY OF MAUMELLE, ARKANSAS, AMENDING THE MAUMELLE CITY CODE CONCERNING BANNERS IN CERTAIN CITY PARKS WITHIN THE CITY OF MAUMELLE AND FOR OTHER PURPOSES WHEREAS, the City Council is committed to the safety, beauty, and peace of the City of Maumelle; and WHEREAS, the Maumelle City Code provisions do not allow for the placement of banners on public property; and WHEREAS, the City Council wishes to amend these provisions concerning banners in certain public parks in the City of Maumelle to allow authorized non-profit groups to place limited banners on certain fencing in the parks identified. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MAUMELLE, ARKANSAS, THAT: SECTION I. Chapter 58 Sign Regulations, Article I. IN GENERAL. Section 58-13 Placing Signs on Public and Private Property, of the Maumelle City Code, is hereby amended to read as follows: Sec. 58-13. - Placing signs on public and private property. (a) Placing signs on public property. No signs other than signs approved by the city council or its authorized representative shall be erected on any public property. Banners on public property may be allowed according to the terms of Section 58-26. provided, dDirectional signs may be erected upon city streets under the following conditions, once approval has been obtained: I. The signs direct the reader to the location of a public facility attended principally by out-of-town patrons, to a facility operated by a nonprofit entity and attended principally by out-of-town patrons, to a facility relating to the public health, safety or welfare, to scenic or historic trails, or to general business or industrial districts; 2. The signs are fabricated, erected and maintained by the entity requesting the sign 3. The entire cost of the signs is borne by the entity requesting the signs; 4. The signs are installed at locations where they would not constitute a traffic hazard;

5. The signs conform to the manual on uniform traffic control devices; and 6. The maximum number of directional signs permitted under this section shall be five for each entity; provided, this limitation shall not apply to signs directing the reader to scenic or historic trails. (b) Placing signs on private property. No signs shall be placed on any private property without the consent of the owner. SECTION 2. Chapter 58 Sign Regulations, Article 1. IN GENERAL. Section 58-26. Banners in Certain Public Parks, of the Maumelle City Code, is hereby amended to read as follows: Sec. 58-26. Banners in Certain Public Parks. Banners shall be prohibited except when specifically allowed under the conditions stated below: a. Parks Specified. Banners may only be placed. according to the conditions below, in the following public parks: Rolling Oaks Athletic Complex 1. Dowell Naylor Aquatic Facility 2. Elizabeth Rutledge Tennis Courts 3. Diamond Center Baseball and Softball Parks 4. Placement by Authorized non-profit groups only. Only those non-profit b. groups which are using certain public parks according to an agreement with the Maumelle Department of Parks and Recreation shall be allowed to place banners in the specified parks according to this section. Prior to placement, said non-profit groups must get written approval of the Department of Parks and Recreation and provide a copy of the same to the Department responsible for enforcement of this chapter. Said groups must designate two individuals who shall be responsible for the placement and maintenance of the banners and who shall be the primary points of contact for the City of Maumelle in the event of questions or problems. Size/Material. Banners must be made of a lightweight material such as c. canvas or vinyl and may not be wood or metal. The display surface of banners shall not exceed 32 square feet; no banner shall exceed eight feet in length or height. Maintenance. Each banner shall be maintained and kept free of obvious d. wear, tears, or tatters. Any banner remaining in spite of damage will be removed and destroyed by the City. Placement/visual obstruction prohibited. No banner shall obstruct traffic, e. impede observation of events at the park from a designated location for spectators. or otherwise be in violation of the sign placement or maintenance provisions of this chapter. The maximum number of banners allowed in each park may be limited due to the size of the park or locations available for placement. Duration. No banner shall remain for longer than the season of play during which it is approved and placed upon the public property. Banners which remain for more than 48 hours beyond the final day of play for said season will be removed and destroyed by the City. Penalty for violation of terms. Any violation of the express terms of this section shall result in immediate removal of the banner(s) and revocation of any permission to place banners any public park. Exemption. This section shall not be construed to limit the authority of the City of Maumelle to place banners advertising programs endorsed or presented by the City in any public park or other approved location.

SECTION 3. Except for the changes above all the provisions of Chapter 58 remain the same. SECTION 4. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF MAUMELLE, COUNTY OF PULASKI, STATE OF ARKANSAS, AN ORDINANCE TO BE ENTITLED: ORDINANCE NO. 828 AN ORDINANCE DECLARING EXCEPTIONAL CIRCUMSTANCES MAKING A COMPETITIVE BIDDING PROCEDURE NOT FEASIBLE OR PRACTICAL; AUTHORIZING THE MAYOR TO NEGOTIATE AND EXECUTE A CONTRACT ON BEHALF OF THE CITY AND FOR OTHER PURPOSES. WHEREAS, the City of Maumelle, Arkansas (the "City") has installed weather warning sirens in various locations within the City in order to facilitate transmission of emergency warnings to the residents of the City of Maumelle; and WHEREAS, it has been determined that it was in the best interest of the City to install an additional weather warning siren; and WHEREAS, the weather siren is available from a single source provider in the state of Arkansas; and WHEREAS, the City desires to facilitate the installation of the additional weather siren in order to continue to promote safety and provide emergency warning services to the citizens and businesses of the City of Maumelle; and WHEREAS, the City wishes to promptly engage the services of and purchase equipment from Safety Corn, Inc. and to arrange for the installation of the same as soon as possible; and WHEREAS, the City has determined that due to the existence of exceptional circumstances, including the particular need for specialized equipment and the singlesource vendor of that equipment, and in accordance with Ark. Code. An. 14-58303(2)(B), that competitive bidding is not feasible or practical. NOW, THEREFORE: BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAUMELLE, ARKANSAS: SECTION I. The Mayor is authorized to negotiate and execute the relevant contract and or purchase order for the purchase and installation of an additional weather warning siren for the City of Maumelle. SECTION 2. The City Council of the City of Maumelle, Arkansas deems there to exist exceptional circumstances which justify the adoption of this ordinance and the waiving of competitive bidding, which include, but are not limited to afore-mentioned circumstances.

SECTION 3. Accordingly, the City Council of the City of Maumelle, Arkansas deems it infeasible and unpractical to submit this matter for a competitive bidding procedure and in the best interests of the citizens and residents of the City of Maumelle, Arkansas to forego such competitive bidding procedure. SECTION 4. The provisions of this ordinance are hereby declared to be severable and if any section, phrase or provision shall be declared or held invalid, such invalidity shall not affect the remainder of the sections, phrases or provisions. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MAUMELLE, COUNTY OF PULASKI COUNTY, STATE OF ARKANSAS A RESOLUTION TO BE ENTITLED RESOLUTION NO. 2013-38 A RESOLUTION ADOPTING A STRATEGIC PLAN FOR THE DEVELOPMENT OF THE CITY OF MAUMELLE AND FOR OTHER PURPOSES WHEREAS, the City of Maumelle has expended efforts to garner opinions, ideas, and expectations of citizens regarding the future development of the City of Maumelle in aspects ranging from Parks and Recreation to Planning and Zoning. The process of the creation of the strategic plan included advice and consultation from City boards and commissions, City staff, and Maumelle citizens (in various forums); consideration of existing City policies, maps, ordinances, and plans; drafting and revision of planning documents including maps or statements; and incorporation of input from Maumelle citizens and others through the use of public meetings, surveys and other sources; and WHEREAS, with the assistance of consultants and facilitators, the City has produced a document, Maumelle FORWARD: Forward Thinking, Forward Vision, Forward Progress, which identifies the plans and expectations and which shall serve as a roadmap to guide future municipal actions in the areas covered by the plans developed; and WHEREAS, The document has been reviewed by the Maumelle Planning Commission and the City Council and has been updated continuously during the process in order to present the strongest strategic plan possible; and WHEREAS, the Maumelle Planning Commission considered the proposed plan on September 26, 2013 and approved a motion recommending the Maumelle City Council adopt the proposed strategic plan, agreeing to submit individual written comments subsequently; and WHEREAS, Upon approval by the City Council, the plan will be maintained and consulted as part of municipal actions going forward. The strategic plan addresses plans and strategies to be employed in areas such as zoning, land use, annexation, public safety, population growth, community and economic development, parks and recreation, public works, infrastructure, transportation, schools, etc. The plan exemplifies a long-term vision for the growth of the City of Maumelle.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAUMELLE, ARKANSAS, AS FOLLOWS: SECTION 1. AN ORDINANCE OF THE CITY OF MAUMELLE, ARKANSAS, AMENDING THE MAUMELLE CITY CODE REGARDING OPERATION OF GOLF CARTS ON CITY STREETS AND FOR OTHER PURPOSES WHEREAS, the City Council recognizes that many Maumelle residents own golf carts and live around the two golf courses in town; and WHEREAS, the City Code allows certain usage of golf carts outside the boundaries of the golf courses but limits the same to certain persons who are going to or from the golf course to their home; and WHEREAS, the City Council wishes to expand and further clarify the allowed usage of golf carts. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MAUMELLE, ARKANSAS, THAT: SECTION 1. Chapter 82. Traffic and Vehicles, Article L In General, Section 82-5, Operation of golf Carts, of the Maumelle City Code is hereby amended as follows. Sec. 82-5. - Operation of golf carts. Operation upon city streets. Pursuant to A.C.A. 14-54-1410, golf carts may be (a) operated by the owner upon the city streets as set forth in this section. Operation without licensing authorized Any owner of a golf cart or his/her (b) immediate family members over the age of sixteen (16), may operate his golf cart upon the city streets without such cart's being registered or licensed under the applicable section of motor vehicle registration and licensing statutes and ordinances of the city. Operation limited. Operation of golf carts is not authorized on any city street (c) which is also designated as a federal or state highway or as a county road. Limited. Operation of a golf cart is authorized by the owner of such cart or his/her (d) immediate family members over the age of sixteen (16), on city streets enly-frelia-the The owner must be at least 16 years of age and have in his possession a valid operator's license.

(1) (e) Operation in accordance with law. The owner operator must conform to all ordinances, statutes and laws dealing with motorized vehicles except as permitted by this section. Necessary equipmentfor operation. Golf carts operated on city streets must be (f) equipped with working headlights and taillights. Penalty for violation. Any violator of this section shall be guilty of a (g) misdemeanor: and upon conviction, the violator will be punished by a fine of not less than $50.00 nor more than $200.00. plus court costs. SECTION 2. Codification. It is the intention of the City Council of the City of Maumelle that the provisions of this Ordinance shall become and be made a part of the Code of Ordinances of the City of Maumelle, Arkansas, and that the Sections of this ordinance may be renumbered, re-lettered and the word "Ordinance" may be changed to "Section", "Article" or such other word or phrase in order to accomplish such intention. SECTION 3. Severability If any clause, section or other part of this Ordinance shall be held by any court of competent jurisdiction to be unconstitutional or invalid, such unconstitutional or invalid part shall be considered as eliminated and in no way effecting the validity of the other provisions of this Ordinance. SECTION 4. Repealer All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions in conflict herewith, be and the same are hereby repealed to the extent of such conflict.

MWM October 8, 2013 Board Meeting Summary October 17, 2013

The MWM board discussed the following items at their regularly scheduled board meeting: Financial statement; Revenue projections were off due to a wetter than normal late summer. The water production and distribution operations are going smoothly. No serious problems in this reporting period, The new treatment processes have been successful, however the chemical treatment costs are much greater than before. The TTHM regulations from EPA and ADEQ take effect soon. MWM's efforts have substantially reduced the TTHM's in the system overall. During discussion, it was again noted that many water utilities will likely have difficulty in meeting the new testing requirements, thus violation notices. .MWM having taken a proactive approach will be beneficial to the utility in the long run, In the sewer treatment section, the system is running smoothly. Work will begin soon on updating a sewer lift station in the Osage Falls area. Sludge removal costs are still expensive, but options are limited regarding disposal. The legal paperwork regarding the Simpson's sewer issues have been successfully completed with the needed filings in the Pulaski county court to occur soon. The work to relocate the sewer line on their property has already been completed, allowing them to proceed with construction. No time lost accidents were reported for this month. With no further business, the board made a motion to adjourn.
