The respondent, a native and citizen of Polad, appeals fom te Immigration Judge's
decision dated November 29, 2011, denying her renewed adjustment of status application under
section 245(a) of the Immigration and Nationality Act ("Act"), 8 U.S.C. 1255(a). Te
respondent was granted voluntary departure under section 240B(b)(l) of the Act, 8 U.S.C.
1229c(b )(I). The Depament of Homeland Secuity fled a brief in opposition. The appeal
will be dismissed.
We review fr clear error the fndings of fct, including the deterination of credibility,
made by the Immigation Judge. 8 C.F.R. 1003.l(d)(3)(i). We review de novo all other issues,
including whether the paies have met the relevant burden of proof, and issues of discretion.
8 C.F .R. 1003 .1 ( d)(3)(ii). The applicant fr relief fom removal bears the burden of proof to
establish her statutory and discretionay eligibility fr adjustment of stats. See section
240(c)(4)(A) of the Act, 8 U.S.C. 1229a(c)(4)(A); 8 C.F.R. 1240.8(d); see also Matter of
Zamora, 25 l&N Dec. 606, 609 (BIA 2011).
The respondent raises various arguments on appeal. On review, we uphold the Immigation
Judge's determination that the respondent did not meet her burden to establish eligibility fr
adjustment of status under section 245(a) of the Act (l.J. at 5-8).

respondent, afer having been granted a change of status fom a H-2B temporay worker to a F-1
student in September 2006, engaged in unauthorized employment (1.J. at 8; Exh. 2, Exh. 3
at Tabs A, D, E; Tr. at 37-39, 41). See sections 245(c)(8) ad 245(k) of the Act; section
274A(h)(3) of the Act, 8 U.S.C. 1324a(h)(3); 8 C.F.R. 274a.12(c)(9), 1245.l(b)(lO). The
record indicates that te respondent continued her employment at "Joe and Fras Sausage"
fom September 2006 until she received her employment authorization card in August 2007, a
period that exceeded 180 days (l.J. at 8; Exh. 2, Exh. 3 at Tabs A, E; Tr. at 37-39, 41). The

respondent did not profer evidence to show tat she, as a F-1 student, had autoriztion to be
employed at "Joe and Franks Sausage" fom September 2006 to August 2007, thus filing to
demonstrate that she did not violate te ters of her F-1 student status, or that she was not bar ed
fom adjusting status because she had engaged in uauthorized employment (I.J. at 8; Exh. 2,
Exh. 3 at Tabs A, D, E; Tr. at 37-39, 41). See sections 245(c)(8) ad 245(k) of te Act; see also
8 C.F.R. 214.2(f(9), 274a.12(c)(3), 1245.l(b)(IO). The respondent has not address this issue
on appeal.
Moreover, the respondent has not demonstrated that she is currently in lawful status fr
puroses of adjustment of status. Te respondent admited that she is no longer employed by
"Joe and Franks Sausage" because it went out of business in 2010, and that she stared working
fr a new employer in 2011 (I.J. at 7; Exh. 7; Tr. at 35-37). However, the respondent did not
profer a labor cerifcation and an approved employment-based visa petition (Form 1-140) to
establish the portability of her new employment under section 204G) of the Act, 8 U.S.C.
l 154(). See, e.g., Tr. at 47-49; see generally Matter of Marca[ Neto, 25 l&N Dec. 169,
175-76 (BIA 2010) (stating that the Immigration Judge has the authorty to determine whether
the validity of a alien's approved employment-based visa petition is presered under section
204G) of the Act afer the alien has changed jobs or employers). She also did not profer
evidence to establish that she is otherwise eligible to adjust stats based on a immigant visa
that is imediately available to her (See, e.g., Tr. at 47-49). See section 245(a)(3) of the Act;
8 C.F.R. 1245.1. The respondent has not addressed tese issues on appeal.
In addition, we ae not persuaded by the respondent's aguments on appeal that any period of
unlawfl stats that occurred prior to her October 2008 paole into the United States is irelevant
to her eligibility fr adjustent of status (Respondent's Br. at 5-6).

Because the respondent is ineligible fr adjustment of status under section 245(k) of the Act,
she did not meet her burden to establish her eligibility fr adjustment of status under section
245(a) of the Act. See sections 240(c)(4)(A) ad 245(a) of te Act; 8 C.F.R. 1240.8(d). In
light of our disposition, we need not address the other aguments raised on appeal, and we fnd
no basis to remand te case fr fher proceedings. See INS v. Bagamasbad, 429 U.S. 24, 25-26
(1976); Matter ofS-H-, 23 l&N Dec. 462, 466 (BIA 2002).

Therefre, we will dismiss the respondent's appeal. However, as the Imigration Judge
granted the respondent voluntary depare, and the respondent provided the Boad with proof
that she posted the bond aount set by the Immigration Judge, we will reinstate the Immigration
Judge's gat of tat relief. See 8 C.F.R. 1240.26(c)(3); Mater of Gamero, 25 I&N Dec. 164
(BIA 2010). Accordingly, the fllowing orders will be entered.
ORER: The appeal is dismissed.
FURTHER ORDER: Pursuant to the Immigration Judge's order and conditioned upon
compliance with conditions set fr by the Immigation Judge and the statute, the respondent is
permitted to voluntarily depar the United States, without expense to the Goverent, witin 60
days fom the date of this order or any extension beyond that time a may be grated by the
Deparment of Homeland Security ("DHS"). See section 240B(b) of the Immigration and
Nationality Act, 8 U.S.C. 1229c(b); see also 8 C.F.R. 1240.26(c), (f. In the event te
respondent fails to voluntarily depar the United States, the respondent shall be removed as
provided in the Immigration Judge's order.
NOTICE: If the respondent fails to voluntarily depa the Unted States within the time
period specifed, or any extensions granted by the DHS, the respondent shall be subject to a civil
penalty as provided by the regulations and the statte and shall be ineligible fr a perod of I 0
years fr any fher relief under section 240B and sections 240A, 245, 248, ad 249 of the Act.
See section 240B(d) of the Act.
WARIG: If the respondent fles a motion to reopen or reconsider prior to the expiration of
the voluntay depare period set frh above, the grant of voluntay depare is automatically
terminated; the period allowed fr volunta deparure is not stayed, tolled, or extended. If the
grant of voluntary depaure is automatically terinated upon the fling of a motion, the penalties
fr filure to depart under section 240B(d) of te Act shall not apply. See 8 C.F.R.
1240.26(e)(l).

WARING: If, prior to deparing the Unted States, the respondent fles any judicial
challenge to this administratively fnal order, such as a petition fr review pursuant to section
242 of the Act, 8 U.S.C. 1252, the grant of volunta depare is automatically terinated, and
the alterate order of removal shall immediately take efect. However, if the respondent fles a
petition fr review ad then depars the United States within 30 days of such fling, the
respondent will not be deemed to have depared under an order of removal if te alien provides
to the DHS such evidence of his or her depaure that the Im igration and Customs Enforcement
Field Ofce Director of the DHS may require ad provides evidence DHS deems sufcient that
he or she has remained outside of the Unted States. The penalties fr filue to depa under
section 240B(d) of the Act shall not apply to an alien who fles a petition fr review,
notwitstading any period of time that he or she remains in the United States while the petition
fr review is pending. See 8 C.F.R. 1240.26(i).
