SUPPLEMENTAL TRAFFIC ENFORCEMENT AGREEMENT This Agreement entered into this ____ day of November, 2013, by and between

the Town Council of The lains !hereinafter "The lains#$, the %au&uier County 'oard of (u)ervisors !hereinafter "County#$ and the (heriff of %au&uier County !hereinafter "(heriff#$ under the following terms and conditions* +,-.-A(, all )arties to this agreement desire to )rovide for a safer environment for the residents and visitors of The lains, /irginia0 +,-.-A(, the Town of The lains Town Council resolved on 1ctober 21, 2013 to )rovide 21,300 to the %au&uier County 'oard of (u)ervisors to su))lement the (heriff4s to )rovide additional (heriff4s )resence within the Town of The lains in order to enforce s)eed limits and other traffic laws0 and +,-.-A(, the %au&uier County 'oard of (u)ervisors resolved on November 15, 2013, to acce)t, a))ro)riate and amend the ado)ted %6 2015 budget of the %au&uier County (heriff by a total of 21,300 and authori7ed the 1ffice of 8anagement and 'udget and %inance 9e)artment to )rocess the budget ad:ustments on a monthly basis as )ayment is received under this Agreement; N1+, T,-.-%1.-, in consideration of the mutual )romises contained herein, the )arties hereto agree as follows* Section I. Obligations of the Town of The Plains.

The lains agrees to* A; ay to the %au&uier County 'oard of (u)ervisors 2<=0 for the first month of su))lemental traffic enforcement under this agreement and )ay u) to 2=20 )er month for the ne>t two consecutive months; Total )ayment under this agreement shall not e>ceed 21,300;

'; The first )ayment of 2<=0 shall be )aid )rior to the initiation of su))lemental traffic enforcement or any obligations of the %au&uier County (heriff under (ection ??? of this Agreement; ?n order to begin the su))lemental traffic enforcement as soon as )ossible

after e>ecution of this Agreement and continue for consecutive months, with the e>ce)tion of a few wee@s around the Christmas ,oliday, )ayments shall be made according to the following schedule* 1; 2<=0 by November 1<, 2013 A for the enforcement )eriod beginning November 13th and concluding when the 2<=0 of funds has been e>)ended0 2; 2=20 by Banuary 3, 2015 A for the enforcement )eriod beginning Banuary =th and ending on Banuary 31st or when the funds have been e>)ended, whichever occurs first0 and 3; 2=20 by Banuary 31, 2015 A for the enforcement )eriod beginning %ebruary 3, 2015 and e>)iring when all funds have been e>)ended;

The County agrees to* A; Amend the (heriff4s ado)ted %6 2015 budget by 21,300;

The (heriff agrees to* A; As staffing allows, )rovide additional officers, cars and any additional e&ui)ment necessary to enforce traffic s)eed limits and other traffic laws; 9e)uties will issue a uniform traffic summons under (tate or County Code )rovisions as they deem a))ro)riate;

'; Consult, through the Ca)tain of the )atrol division, with the Town of The lains regarding the hours of o)eration and location of additional enforcement )rovided under this agreement and ma@e the greatest effort on wee@days between C*30 a;m; and D*30 a;m; and 3*30 );m; and <*30 );m; Assignment of 9e)uties and schedule shall be at the sole discretion of the (heriff; The lains ac@nowledges that 9e)uties assigned to su))lemental traffic enforcement duty may at any time be recalled by the (heriff to other duties as conditions in the County warrant;

rovide traffic enforcement 9e)uties scheduled before or after their regularly scheduled shift to be com)ensated at their actual overtime rate; ?n no event shall the (heriff continue to schedule or incur overtime )ay obligations for 9e)uties beyond the amounts allocated by the Town of The lains for each enforcement )eriod in (ection ?;' above;

9; 9educt only the actual overtime )ay for each 9e)uty assigned to su))lemental traffic enforcement duty )ursuant to this agreement from amounts )aid by The lains and no other miscellaneous costs shall be charged; ?f 9e)uties assigned to su))lemental traffic enforcement are recalled or otherwise directed to other duties, the (heriff shall only charge The lains for the actual time s)ent by the 9e)uty on traffic enforcement duties;
