The Commission has installed a telex with an automatic answering device which gives the conversion rates in a number of currencies. This service is available every day from 3.30 p.m. until 1 p.m. the following day. Users of the service should do as follows: call telex number Brussels 23789; give their own telex code; type the code 'cccc' which puts the automatic system into operation resulting in the transmission of the conversion rates of the EUA; the transmission should not be interrupted until the end of the message, which is marked by the code 'ffff.

RESOLUTION OF T H E CONSULTATIVE COMMITTEE O F T H E EUROPEAN COAL A N D STEEL COMMUNITY on the social consequences of the iron and steel policy (adopted unanimously but with three votes against at its session of 9 March 1979)

THE CONSULTATIVE COMMITTEE draws attention, on the one hand, to its resolution of 19 September 1978 on the social aspects of the iron and steel policy (x) and, on the other hand, to the Subcommittee for Labour Problems terms of reference, namely, to examine in detail in liaison with the Commission of the European Communities all the aspects of the measures to be taken to implement the social programme, i.e. amongst others: methods of implementing early retirement, restructuring of shift or team work, organization of a shorter working week, restrictions on overtime; has taken note of the reports of the Subcommittee for Labour Problems, which met on 3 October 1978, 11 January and 16 February 1979; draws attention, in connection with the social aspects of the iron and steel policy, to its resolution of 23 January 1979 on the ECSC's reorganization policy ( 2 ); is of the opinion that 1. the policies of restructuring and reorganization and the social consequences of the iron and steel policy are inseparably linked; 2. these three aspects must be given equal consideration by the Commission, the Council of Ministers and the Governments of the Member States, and the necessary technical, financial and administrative resources for their implementation must be made available;

3. the solutions proposed in connection with the social aspects of the iron and steel policy represent a range of possibilities from which each country can begin to select those suitable for solving the social problems occurring in its iron and steel industry, while maintaining coherence at Community level; 4. these possibilities should be taken up immediately, in view of the fact that several Member States have already made attempts to find solutions to the social problems accompanying the restructuring of the iron and steel sector; draws attention in this context to the fact that the Commission should have sufficient funds at its disposal and that it should interpret Article 56 and apply Article 95 of the ECSC Treaty in the broadest sense; fully supports the initiatives of the Commission, both in the industrial and social field and in the area of conversion, to overcome the consequences of the steel crisis, and appeals to both the competent international and national authorities to reach satisfactory agreements permitting a better solution to the economic and social problems in this sector; dismissals should as far as possible be avoided and, in so far as they are unavoidable in the context of restructuring, the consequences should be dealt with in a socially acceptable way including a dynamic policy aimed at creating alternative employment; requests the Commission to convey this resolution to the members of the European Council so that they can take it into account at their meeting of 12 and 13 March 1979.

Proposal for a Council Regulation opening, allocating and providing for the administration of a Community tariff quota for fresh or chilled tomatoes falling within subheading ex 07.01 M of the Common Customs Tariff, originating in the African, Caribbean and Pacific States and in the overseas countries and territories (1979/80) (Submitted by the Commission to the Council on 18 April 1979)

THE COUNCIL OF THE EUROPEAN COMMUNITIES, Having regard to the Treaty establishing the European Economic Community, and in particular Articles 43 and 113 thereof, Having regard to the proposal from the Commission, Having regard to the opinion of the European Parliament, Whereas Article 1 of Council Regulation (EEC) No 430/78 ( l ) provides for the opening by the Community of a Community tariff quota of 1 000 tonnes of fresh or chilled tomatoes falling within subheading ex 07.01 M I of the Common Customs Tariff, originating in the African, Caribbean and Pacific States and in the overseas countries and territories; whereas the quota period runs from 15 November to 15 April; whereas the customs duty applicable to the quota is set at 4 - 4 % , with a minimum charge of two units of account per 100 kilograms net weight; Whereas this Regulation is valid only until 29 February 1980; whereas, therefore, the pro rata temporis clause is applicable for the fixing of the quota volume for the period 15 November 1979 to 29 February 1980; whereas a Community tariff quota of 700 tonnes should therefore be opened for the period in question;

Whereas it is necessary in particular to ensure to all Community importers equal and uninterrupted access to the abovementioned quota, and uninterrupted application of the rates laid down for that quota to all imports of the products concerned into all Member States until the quota has been used up; whereas, however, since the tariff quota involved is of a relatively low volume and the period of application is very short, it seems possible to allocate the whole quota volume to the Community reserve and to provide for the possibility of those Member States in which needs might arise drawing appropriate quantities from that reserve; whereas the shares thus drawn from the reserve must be valid until the end of the quota period; whereas this method of management requires close cooperation between the Member States and the Commission and the latter must in particular be able to monitor the rate at which the quota is used up and inform the Member States thereof; Whereas, since the Kingdom of Belgium, the Kingdom of the Netherlands and the Grand Duchy of Luxembourg are united in and represented by the Benelux Economic Union, any operation relating to the administration of the shares allocated to that economic union may be carried out by any one of its members, HAS ADOPTED THIS REGULATION: Article 1 1. tonnes shall be opened in the Community for fresh or chilled tomatoes falling within subheading ex 07.01 M I of the Common Customs Tariff, originating in the African, Caribbean and Pacific States and in the overseas countries and territories. Within this tariff quota the Common Customs Tariff duty applicable to the products shall be suspended at 4-4 % with a minimum charge of two units of account per 100 kilograms net weight. 2. The volume of the tariff quota referred to in paragraph 1 shall constitute a reserve. 3. If the need should arise for the products in question in a Member State, the latter shall draw an appropriate share from the reserve, providing that the size of the reserve so permits. 4. The shares drawn pursuant to paragraph 3 shall be valid until 29 February 1980.

4. The extent to which a Member State has used up its share shall be determined on the basis of the imports charged in accordance with paragraph 3.

Article 3 At the request of the Commission, Member States shall inform it of imports actually charged against their shares. Article 4 The Member States and the Commission shall cooperate closely in order to ensure that this Regulation is complied with. Article 5 The rules of origin applicable to the products imported under this Regulation shall be, respectively, those of Protocol 1 annexed to the ACP-EEC Convention of Lome concerning the definition of the concept of 'originating products' and the methods of administrative cooperation, and those of Annex II to Council Decision 76/568/EEC of 29 June 1976 on the association of the overseas countries and territories with the European Economic Community ('). Article 6

Article 2 1. The Member States shall take all measures necessary to ensure that shares drawn pursuant to Article 1 are opened in such a way that changes may be made without interruption against their accumulated shares of the Community quota.

2. Member States shall ensure that importers of the said products established in their territory have free access to the shares allocated to them. 3. The Member States shall charge imports of the said goods against their shares as and when the goods are entered with customs authorities for home use.

This Regulation shall enter into force on the third day following its publication in the Official Journal of the European Communities. This Regulation shall be binding in its entirety and directly applicable in all Member States.
