STIPULATED CONSENT JUDGMENT
As attested to by the signatures of the parties below, this matter comes before the Court
on the parties' joint stipulation.
On February 19, 2013, Pictures, LLC filed a Complaint against the
defendant (andothers) in the Oregon District Court, Case No. 3:13-cv-00295-AA for Copyright
Infringement, 17 U.S. C. 101, et seq, for the unlicensed copying and distribution of plaintiff's
motion picture titled Maximum Conviction, registered with the United States Copyright Office,
Reg. No. Pau 3-647-070, recorded copyrights assigned to plaintiff.
After initial discovery and investigation, defendant, then only known as the "ADULT
SON" of the identified subscriber, was identified as the party initially named as Doe #145, using
the Internet Protocol ("IP") address 68.67.104.39 observed infringing plaintiff's motion picture

on Nov. 11, 2012 at 4:49:26 AM UTC. Subsequently defendant was severed from the initial
case and this separate action was filed and Donald Alen Gottbreht was specifically identified and
named.
Donald Alen Gottbreht appeared informally and sought the assistance of the Court and
Mr. Damon Petticord was appointed as counsel for the defendant. Doc. 20. The parties, after
conferral and investigation, now appear through counsel to fully and finally resolve all claims
between the parties and the matters before the Court.
Voltage and Donald Alen Gottbreht have reached a settlement that requires entry of this
Stipulated Consent Judgment to fully effect the terms of the settlement and have asked the Court
to accept and enter this Stipulated Consent Judgment and to proceed consistent with this
agreement.
WHEREFORE IT IS HEREBY STIPULATED AND ORDERED for all matters relevant to this
case between the parties as follows:
1. This court has jurisdiction over the parties and venue is proper.
2. Plaintiff has valid and enforceable copyrights in the original copyrighted work,
Maximum Conviction, registered with the United States Copyright Office, Reg. No. PAu
3-647-070.
3. Donald Alen Gottbreht is the proper named defendant in this case.
4. Plaintiff and Donald Alen Gottbreht expressly consent to have a United States Magistrate
Judge conduct any and all proceedings in this case, including entry of orders, including
this stipulation or any other final judgment or orders arising there from.
5. Donald Alen Gottbreht and his counsel have fully reviewed the Complaint and the

allegations of the Complaint and specifically admit plaintiffs investigations identifying
the IP address used by Donald Alen Gottbreht as the infringer were accurate, in particular
in accurately identifying Donald Alen Gottbreht's IP address as the IP address used to
download and distribute plaintiffs motion picture and other content identified with the
Complaint.
6. In addition to other terms in a separate settlement agreement, the parties further agree and
require pursuant to the settlement the below Money Judgment and Permanent Injunction
be entered against Donald Alen Gottbreht.
MONEY JUDGMENT
A Money Judgment in favor of plaintiff Voltage Pictures, LLC and against defendant
Donald Alen Gottbreht is awarded the sum of$35,550.00. This figure includes:
1. Statutory damages of $30,000;
2. Attorneys' fees of$5,000; and
3. Costs of$550.
PERMANENT INJUNCTION
Donald Alen Gottbreht is hereby PERMANENTLY ENJOINED from directly,
contributorily or indirectly infringing Voltage's rights in its motion pictures, including without
limitation by using the internet to reproduce or copy Voltage's motion pictures, to distribute
Voltage's motion pictures, or to make Voltage's motion pictures available for distribution to the
public, except pursuant to a lawful written license from Voltage;

Donald Alen Gottbreht is hereby directed to immediately delete all unlicensed content in
which Voltage has any rights or interest, together with any and all BitTorrent clients on any
computer(s) he owns or controls together with all other software used to obtain media through
the Internet by peer-to-peer transfer or exchange; and
Donald Alen Gottbreht is hereby PERMANENTLY ENJOINED from directly,
contributorily or indirectly participating in peer-to-peer BitTorrent file exchanges without an
express written license from all rights holders as to specific content exchanged.
