The defendant verbally agreed on two separate occasions to pay for a new dog for the plaintiff, but the defendant did not follow through with the payment.
2. Judgment may be entered against you unless you file an Appearance and Answer within 20 days of the service of the Original Notice upon you. Judgment may include the amount requested plus interest and court costs. 3. ORDER

This matter came before the court for trial pursuant to order. Both parties appeared pro se. Plaintiff testified on his own behalf and offered his exhibits A - G, all of which were received without objection. Plaintiff testified on her own behalf as did Cassandra Crum and defendant's exhibits 101 and 105 were received without objection. Based on the record the court makes the following: FINDINGS OF FACT: 1. Defendant operates a kennel in the basement of her house and plaintiff had used those services in the past, particularly when assisting his daughter in Fort Dodge. 2. During the time that the plaintiff's dog was boarded at defendant's business after being dropped of on September 15, 2013 the dog tried to escape its cage through a top door that was secured by two separate latches, after successfully opening one latch and sticking his head through the door and then hanging from that door until becoming asphyxiated. 3. During a previous stay at the defendant's kennel the dog had successfully escaped his cage and defendant was aware of that. 4. The defendant does not use the top door on her cages but rather the front door, and does not have the top door secured other than with the two latches which the dog had successfully opened in the past. Based on the foregoing the court finds the defendant at fault for the dog's untimely death. The court does not find that the plaintiff's statement that he did not want a new dog at the time of the incident to prohibit him from recovering the value of the dog. That was obviously a traumatic time for the plaintiff and he did in fact purchase a new dog for $371.00 while the deceased dog cost $321.00.

JUDGMENT: Based on the foregoing the court finds that the defendant is liable to the plaintiff for the value of the deceased dog which it is basing on purchase price and not replacement price. The court orders that judgment be entered in favor of plaintiff and against defendant for $321.00 with interest from the date of filing at the rate of 2.12% per annum and costs.
