PLACEMENT AGREEMENT This PLACEMENT AGREEMENT (the Agreement) is entered into by and between Academy of Skill Development through Ms Nafiza Shah, herein after referred to as Academy and ____________, through, _______________. Herein after referred to as The Placement Partner / Employer, for the following purposes, terms and conditions: The service to be provided by the Academy herein shall include the following: a) Academy shall be responsible for short-listing of qualified candidates according to their trade qualifications and experience in conformity with the Employers requirements. The criteria stated in this case are Basic English communication and presentable personality. b) Academy shall train people in the basics of job skills with few of the key performing metrics. c) Academy should notify and inform the Placement Partner / Employer / Employer of such short listed qualified candidates who are ready for final interview and selection by the Employer. d) Academy shall brief the candidates about the nature of business / job available with the Placement Partner / Employer / Employer; nature of job of the candidate as the employ of the Spa or such other details as may be relevant with regard to the job requirements placed by the employer before referring the candidate (s) for selection to the Employer. Such details shall be provided by the Placement Partner / Employer / Employer. e) The Academy would abide by the remuneration/salary guidelines for the prospective employees, as issued by the Placement Partner / Employer. Conditions applicable to the Placement Partner / Employer The Placement Partner / Employer shall take care of following requirements under this placement agreement. a) The Placement Partner / Employer would be completely and solely responsible for job guarantee of the selected candidate. b) The Placement Partner / Employer shall have the final/sole authority on the selection of candidate(s) for employment as per its requirements and standards, interviews to be held through Skype over the internet post completion of training. c) The Placement Partner / Employer shall communicate to the Academy within 2 days regarding the final selection of candidate(s) post interview. A copy of the employment letter of each candidate should be emailed to the Academy. d) The selection of candidate(s) by the Placement Partner / Employer shall be subject to its rules, regulations and bye-laws including but not limiting to any pre selection medical test as may be specified in selection rules and policies. The Placement Partner / Employer shall provide details of all such rules, regulations and bye-laws and all amendments / changes thereto, to the Academy, so as to assist the Academy in providing the services mentioned herein. The cost for any such request shall be borne by the Placement Partner / Employer. e) The Placement Partner / Employer or its authorized representative is specifically mandated to provide selected workers briefing to selected candidate on Employers rules, regulations, Salary package & benefits, technical peculiarities, product training and the demands of the work and its environment and other matters unique to their employment with the Employer. f) The Placement Partner / Employer would bear and arrange travel, boarding, lodging for the candidates for interviews if need be to attend interviews directly at the employers office the same needs to be paid in advance. g) The Placement Partner / Employer would provide the Academy a detailed guideline with respect the salary, perks, commission, benefits, any deductions other cost involved for prospective employees (for each position) which is essential towards execution of this agreement.

SCHEDULE- I Profile of the prospective employees- (TO BE PROVIDED BY THE Placement Partner / Employer) Commercial Terms/ Professional fees The Placement Partner / Employer hereby agrees to guarantee jobs to the candidates from the Academy with fees of Rs 10,000 towards training and recruitment charges. The candidate needs to be confirmed of employment with the employer before the final departure of the candidate within one week of training completion. The Placement Partner / Employer has to ensure the tickets for the selected candidates is made within 10 days post selection of the candidate. The replacement guarantee stands good for 4 months for any breach in discipline or insubordination. Post which the organization will be signing a contract with all candidates for a period of 24 months, a legal action can be initiated at the discretion of The Thai Spa, if there is a breach of contract.. The Placement Partner / Employer should issue appointment letter to the employees when they join the Academy with a final clause for selection through interview post training they should also get the agreement contract signed incase a contract of employment is applicable.

Specific Terms Related To This Agreement


They will all work in a location where there is no Thai therapist present. Salary will be Rs 5000 + Food + Accommodation for a month when they will be in training in Kolkata. Post that there Salary will increase to Rs 8000 per month gross + 4 percent incentive + Food + Accom + Travel. Post six months of joining the outlet ( not including one month of Training ) they will get an increment of Rs 2000 and post 12 months of being on the floor there salary will be revised to Rs 12000. other benefits remain intact. The Institute ( By Copy : Nafiza ) Has agreed for three months replacement guarantee if an employee goes absconding, resigns or is terminated due to non performance or discipline issues. The Therapist have agreed to give us guarantee chqs of Rs 10,000 each which will be returned to them on completion of a 24 months contract to working relationship with the organisation. However they have expressed their inability to produce chq now as they do not have bank accounts... so it has been agreed by Nafiza and the candidates that once they reach Kolkata, The Thai Spa will create there bank accounts and then get deposit chqs as promised by the candidates. Since another batch is joining on the 2nd of Jan i have instructed the girls to travel from sikkim on 1st... once they reach Kolkata there travelling expenses will be refunded to them immediately.

The Parties hereby expressly agree that Academy shall not be deemed either directly or indirectly to be the employer, franchiser, contractor or principal of the Placement Partner / Employer and the staff/employees of the Placement Partner / Employer and this Agreement has been executed expressly on a principal to principal arrangement SIGNED For
