Preamble LosAngelesCountyMetropolitanTransportationAuthority(Metro)providesimportant servicestothetravelingpublicinLosAngeles.SafetyistheguidingprinciplebywhichMetro operates.AsuccessfulpartnershipbetweenMetroandthepublicisdependantuponMetro employeesandthetravelingpublicbehavinginamutuallyrespectfulandcourteousmanner. ThisOrdinanceisentitledtheMetroCustomerCodeofConduct.Compliancewiththis Ordinanceisaconditionofuse,byanyindividual,ofaMetrovehicle,facilityorproperty. Sections60540(A),605100,605110,605150,605230(C)andSection605240(A)ofthis OrdinanceareenactedpursuanttotheauthoritygrantedtoMetrobytheCaliforniaPenalCode Section640(e)andtheCaliforniaPublicUtilitiesCodeSection99580etseq. Values 605010Values A.PatronsshallusetheMetrosysteminaresponsiblemannertopreserveandprotectthe aesthetics,andpromotethelongevity,ofthisessentialpublicresourceforgreatermobilityin LosAngelesCounty. B.PatronsshalltreatotherpatronsandMetrorepresentativeswithconsideration,patience, respect,andcivilitytoallowuse,operation,andenjoymentoftheMetrosysteminasafeand gratifyingmannerforallpersons. Definitions 605020Definitions
Thefollowingterms,wheneverusedinthischapter,shallbeconstruedasdefinedinthissection:

A.Abuseandharassmentmeananyextremephysicalorverbalmistreatment,including hitting,kicking,gestures,yelling,spitting,threats,intimidation,assaults,slurs,andcursing. B.Commercialactivitymeansanyforprofitactivityincludingsellinggoods,food,services,or distributingcommercialmaterials.

C.FaremeansthemonetarychargesestablishedbyMetrofortheuseofitsfacilitiesand vehicles. D.Faremediameansthemethodsbywhichfaresarepaid,issuedbyoronbehalfofMetro forthepaymentoffare,includingtokens,passes,cards,transfers,tickets,andvouchers. E.Graffitimeansanyunauthorizedinscription,word,figure,mark,ordesignthatiswritten, marked,etched,scratched,drawn,painted,oraffixedonMetrofacilitiesorvehicles. F.LoiteringmeansunnecessarylingeringinMetrofacilitiesorvehiclesorotherlocation whereitinterfereswithaMetrofacilityorvehiclesorusethereof. G.MetromeanstheLosAngelesCountyMetropolitanTransportationAuthorityandits subsidiary,thePublicTransportationServicesCorporation,andtheircontractors. H.MetrorepresentativemeansaMetrosecurityofficer,operator,fareinspector,orother authorizedMetroemployee,boardorsectorcouncilmember,orcontractor. I.Metrofacilitymeansallpropertyandequipment,includingrightsofwayandrelated trackage,rails,signals,power,fuel,communicationsystems,ventilationsystems,powerplants, cameras,signs,loudspeakers,farecollectorsorregisters,soundwalls,stations,vacantparcels, bikepaths,terminals,platforms,plazas,waitingareas,signs,artwork,storageyards,depots, repairandmaintenanceshops,yards,offices,parkingareas,andotherrealestateorpersonal propertyownedorleasedbyMetro,usedforanyMetroactivity,orauthorizedtobelocatedon Metroproperty. J.MetrovehiclemeansaMetrobus,train,car,orothervehicleowned,operated,orusedby MetrooritscontractserviceproviderstransportingMetrorepresentativesorpatrons. K.Nonpublicareasmeantrainoperatorscabs,busoperatorsseats,closedoffareas, mechanicalorequipmentrooms,Metroemployeeonlyareas,storageareas,interiorrooms, tracks,roadbeds,tunnels,shops,barns,trainorbusyards,garages,depots,areasmarkedas restrictedordangerous,andundergroundareas. L.PatronandCustomermeananypersoninoron,usingorattemptingtoaccess,aMetro facilityorvehicle,includingwithoutlimitpayingriders. M.Peakhoursmeans6:30a.m.to8:30a.m.and4:30p.m.to6:30p.m.,Mondaythrough Friday. N.Personincludesanindividual,firm,partnership,corporation,association,orcompany. O.RulesorCodeorCustomerCodeofConductmeansTitle6ofMetrosAdministrative Codeasamendedfromtimetotime. P.Sounddevicemeansaradio,receiver,communicationdevice,phonograph,television, musicalinstrument,taperecorder,cassetteplayer,CDplayer,MP3player,DVDplayer,game, speakersystem,audiosystem,soundamplifier,orotherdevicethatplaysmusicoremitsnoise. Sounddevicedoesnotincludeassistivehearingdevicesforpersonswhohaveimpairedhearing. Q.Weaponorinstrumentintendedforuseasaweaponincludesbutisnotlimitedto firearms,switchbladeknives,axes,gravityknives,boxcutters,straightrazors,unpackagedrazor blades,swords,nunchucks,explosives,dangerouschemicalsordevices,radioactivematerials, andhighlycombustiblematerials. R."Wheelchair"means,amobilityaidbelongingtoanyclassofthreeormorewheeleddevices, usableindoors,designedormodifiedforandusedbyindividualswithmobilityimpairments,

whetheroperatedmanuallyorpowered.1 S.MobilityAidDevicemeansanassistivedeviceotherthanawheelchairusedbyandprimarily intendedtoassistpersonswithdisabilitieswithlocomotion. T.Powerdrivenmobilitydevicemeansanydevicepoweredbybatteries,fuel,orothersourcethat doesnotfitthedefinitionofawheelchairregardlesswhetheritisdesignedprimarilyforuseby individualswithmobilitydisabilities.2 U.PersonalCareAttendantmeansanindividualdesignatedoremployed,byapersonwith disabilities,toaidinmeetinghis/herpersonalneeds.3 Conduct 605030Animals A.AnimalsarenotpermittedinMetrofacilitiesorvehicles,unlessoneofthefollowingapplies: 1.Theanimalisinasecurecarrier; 2.Theanimalisacertifiedpoliceorsecurityanimalandisaccompaniedbyapeace

officer; or 3.Theanimalisaserviceanimal,asdefinedbytheAmericanswithDisabilitiesAct,andis accompaniedbyapatron.AMetrorepresentativemayaskwhetherananimalisapet andwhatservicetheanimalperformsforthehandler. B.Handlersshallmaintaincontroloftheiranimals.NoanimalispermittedinaMetrofacilityor vehiclethatisnotunderthecontrolofitshandlerorposesathreattoaMetrorepresentative orpatron.Anonserviceanimalmaybeejectedifitunreasonablyannoyspatrons. C.HandlersofanimalsshallpromptlyremoveallanimalwastefromMetrofacilitiesand vehicles.LeavinganimalwasteinaMetrofacilityorvehicleisprohibited. D.Handlersmustensurethatananimalshallnotdepriveapatronofaseatorblockanaisle. 605040BicyclesandSkates A.Wheeledridingdevicesincludingbicycles,skates,skateboards,kickscooters,andotherwheeled ridingdevicesexceptWheelchairsandMobilityAidDevices,maynotberiddeninMetrofacilitiesor
vehicles,exceptforpublicbikeorroadwaysclearlyintendedforthosetypesofdevices. Aperson maycarryorwalksuchwheeledridingdevicesinasafemanneronMetrofacilitiestoparkorboard Metrovehicles.

B.Tandem,threewheeled,orfuelpoweredbicycles orotherwheeledridingdevices,arenot permittedinMetrofacilitiesorvehicles.Bicyclesorotherwheeledridingdevicesover6feetlong areprohibited.

C.AllpersonsenteringMetrofacilitieswithwheeledridingdevicesofanytypeincluding WheelchairsandMobilityAidDevicesbutexcludinghandheldskatesorskateboardsmustuse elevatorsorrampstoaccesselevatedorloweredplatformsorsubwaystations. D.Bicyclesmaybecarriedonstairswhensafetodosoifescalatorsandelevatorsarenon operational.ApersonwhoentersaMetrofacilityorvehiclewithabicyclemustdothefollowing: 1.Holdabicyclewhenitisnotintherack. 2.Useavailablebicycleracks. 3.Ifracksonabusarefull,waitforthenextbus. 4.Informthebusoperatorbeforeexitingthatyouwillberemovingabicyclefromarack infrontofthebus. 5.Notblockaisles,doorways,oroperatorsexitway. 6.Boardatbicycledesignateddoorsandkeepthebicycleinbicycledesignatedareas, suchasnonoperatingcabareas. 7.Ifanarrivingtrainiscrowdedindividualswithbicyclesmustwaitforatrainwith availableroom.Lawenforcementpersonnelmayaskindividualstravellingwithbicyclesto wait. 8.Ifevacuationisrequiredbicyclesmustbeleftonthetrainandlocatedsothattheydo notblockaislesordoors. 9.Nottakethebicycledowntrainaisles. 10.YieldspaceindesignatedareastowheelchairsorotherMobilityAidDevicesforpersons withdisabilities. 11.LoadandunloadbicyclesfromthefrontofaMetrobustothecurbsideandnotinto traffic. 12.Notattempttoaccessthebicyclerackafterthebushasleftthecurb. 13.Useelevatorsorramps,notescalators,totransportallwheeledridingdevicesotherthan handheldskatesorskateboardsinMetrofacilities. E.Foldedbicycles,handheldskatesorskateboardsmaybecarriedintoaMetrovehicleatanytime withoutusingtherackorwaitingfornonpeakhours.Theseitemsmustbestoredsothattheydo notblockpassageways,aislesorseats. F.Personsundertheageof14yearstravellingwithabicyclemustbeaccompaniedbyanadult. 605050Blocking ThefollowingactsareprohibitedinMetrofacilitiesandvehicles: A.Willfullyblockingorimpedingthefreemovementofanotherperson. B.Blockinganaisle,elevator,escalator,door,orstairwaywithonesbodyoranobject,inaway thatposesadanger,unreasonablyimpedesapatronsmovement,ordisplacesaperson. C.Operating,stopping,orparkingavehicleinalocationthatisreservedfortransitvehiclesoris otherwiserestricted.

D.ObstructingorimpedingtheflowofaMetrovehicleorinterferingwiththeoperationoruse oftransitservices. E.Preventingadoorfromclosing. F.Recliningon,placingobjectson,orblockingaseat. G.Occupyingmorethanoneseat. H.WillfullyinterferingwiththeoperatororoperationofaMetrovehicleinamannerthat affectstheoperator'scontrolofthevehicle. I.Impedingthesafeboardingorexitingofpassengers. 605060Boarding,Exiting,andSeating ThefollowingactsarerequiredinMetrofacilitiesandvehicles: A.Nevergoontoatrackexceptthroughdesignatedcrossingsandneversteporputarms,legs, orobjectsinthepathofaMetrovehicle. B.MaintaincontrolofchildrenatalltimesinoronMetrovehiclesorfacilitiesincludingwhena Metrovehicleisapproaching. C.Donotsignalinthepathoforbytouchingthebuswhenitismoving. D.Yieldpriority,reserved,Wheelchair,orsimilarlydesignatedseatingtoseniorcitizensand
passengerswithdisabilities. E.PersonalCareAttendantsmusttravelwiththepatronwhodisplaystheAccessServicesTAPcard markedwithPCAatalltimeswhenusingtheMetrobusandrailsystemincludingboardingand exitingatthesamelocationandtravelinginthesamebusorrailcar. 605070Carts,StrollersandLuggage A.Commercialorlargesizecarts,dolliesandstrollersareprohibitedonMetrovehicles,unless collapsed.Ifasmallpersonalusesizestrollerisoccupiedbyachildorsmallcartisfilled,thenit mustbesecurelyheldandnotblockpassagewaysorseats. B.Carts,dollies,strollersandlargeluggagethatcreateanunsafeconditionareprohibited. C.Duringcrowdedconditionsorpeakhours,removechildrenfromstrollersandmaterialsfrom carts,andcollapse,orwaitforthenextMetrovehiclethathasroomforthecartorstroller.This provisiondoesnotapplytoWheelchairsorotherMobilityAidDevices. D.Carts,strollers,largeluggageandWheelchairsorotherMobilityAidDevicesaretobe transportedinelevatorsorrampsinallMetrofacilitiesandnotonescalators. 605080Civility,Compliance,andCooperation A.AbuseandharassmentofMetrorepresentativesorpatronsisprohibitedinMetrofacilities

andvehicles. B.ApersonmustcomplywithalllawfulordersanddirectivesgivenbyanauthorizedMetro representativerelativetoMetrofacilitiesorvehiclesconsistentwiththeCodeincludingany instructiontoleaveaMetrovehicleorfacilityforsafetyreasons,foraviolationoftheCode,or followinganoticeofejectmentorexclusion.

C.ApersonreceivingaNoticeofViolationmustprovideaccurateandcompleteidentification andfaremediaonwhenrequestedtodosobyanauthorizedMetrorepresentative. D.ApersonmaynotfalselyrepresenthimselforherselftobeaMetrorepresentativethrough words,actions,clothes,insignia,badge,orequipment. E.Apersonmustwearashirt,pantsorskirt,andshoes,whileinaMetrofacilityorvehicle. Infantsbeingheldorinstrollersandpersonsinwheelchairsarenotrequiredtowearshoes. F.Patronsunabletocareforthemselves,whodonotexhibitanabilitytocomplywithMetros Code,orwhoposeasafetyrisk,mustbeaccompaniedbyaserviceanimaloraresponsible individualwhocancareforthePatronwheninaMetrofacilityorvehicle. 605090CommercialActivity A.PersonsmustnotengageincommercialactivityinaMetrofacilityorvehiclewithoutfirst obtainingaMetropermitandpayingallrequiredfees. B.PersonswhoengageinpermittedcommercialactivityinaMetrofacilityorvehiclemust complywithallMetroinstructions,safetyrequirements,andapplicablelaws. C.Commercialactivityisprohibitedonloadingplatformsandinanylocationwhereitinterferes withtransitservicesorthemovementofpatronsorwhereitcreatesasafetyhazard. 605100DisorderlyConduct ThefollowingactsareprohibitedinMetrofacilitiesandvehicles: A.Expectorating(spitting). B.Carryinganyexplosive,acid,flammableliquid,ortoxicorhazardousmaterial. C.Urinatingordefecating,exceptinalavatory.Thissubsectiondoesnotapplytoapersonwho cannotcomplyasaresultofdisability,age,oramedicalcondition. D.Throwinganobjectatapatron,Metrorepresentative,oraMetrofacilityorvehicle. E.Gamblingtowinmoneyoranythingofvalue. F.Hangingfrom,swingingfrom,orattachinganythingtohandrails.Thisdoesnotapplyto holdingahandrailtostabilizeonesbodyduringtransit. G.Incitingviolenceorposingaclearandpresentdangertootherpersons,includingmaking verbalorvisualgangaffiliationorprovocationsigns. H.Engaginginorsolicitinganotherpersontoengageinlewdconduct. I.Engaginginorsolicitinganotherpersontoengageinprostitution. J.Placingfeetorshoesonseatsorfurnishings. K.Defacingwithgraffiti,vandalizing,damaging,destroying,ortamperingwithMetrofacilities orvehicles. L.Litteringordumping. M.Injuringanotherpersonordamaginganotherpersonspropertyorpossessions. N.ThrowinganobjectfromaMetrovehicle.

605110Food,Alcohol,andDrugs ThefollowingactsareprohibitedinMetrofacilitiesandvehicles: A.Eating,drinking,smoking,orcarryingalitcigar,cigarette,orpipe,exceptindesignatedareas permittingthatactivity. B.PlacingchewedgumontoanysurfaceinaMetrofacilityorvehicleotherthanintoatrash receptacle. C.Drinkingorpossessinginanopencontaineranalcoholicbeverage,exceptindesignated areaswherethereisnoticethatdrinkingalcoholispermittedandallrequiredpermitshave beenobtained. D.Possessinganillegaldrugorsubstance. E.Beingundertheinfluenceofalcohol,adrug,acontrolledsubstance,toluene,orany combinationofthoseitems,andunabletocareforonesownsafetyorthesafetyofothers,or interferingwiththeuseofaMetrofacilityorvehicle. F.Creatingapublicnuisanceorahealthhazardbydroppingfoodotherthaninaproperwaste disposalreceptacle. G.Smokingisalsonotallowedwithin20feetofanyMetrofacilityentrance,exitoroperable window. 605120Loitering A.LoiteringisprohibitedinMetrofacilitiesandvehicles. B.Loiteringincludesthefollowing: 1.StoringpersonalpropertyinaMetrofacilityorvehicle. 2.CampingorsleepinginaMetrofacilityorvehiclewhennotridingfora transportationpurpose. 3.RemaininginaMetrofacilityorvehiclewithoutalawfultransportationpurposeor refusingtoprovideidentification. 605130LostandFound A.ItemsfoundinaMetrofacilityorvehicleshallbeturnedintoaMetrooperatororother authorizedMetrorepresentative,whowillforwardtheitemstotheMetroLostandFound. B.ItemscanbeclaimedinpersonattheMetroLostandFoundbyprovidingproofof ownership.Itemsthatremainunclaimedfor30dayswillbediscardedordonatedtoa charitableorganization,withoutliabilityforMetrotoanyone. C.MetroisnotresponsibleforitemslostinaMetrofacilityorvehicle. 605140Miscellaneous A.theCodeisnotintendedtoaffectlawfulactivityorfirstamendmentrightsprotectedbystate orfederallaw,includinglawsrelatedtocollectivebargaining,laborrelations,orlabordisputes.

B.Metroreservestherighttosuspend,waive,modify,limit,orrevoketheapplicationofthe Code. C.Metromayrefuseservice,oraccesstoMetrofacilitiesorvehicles,includingejectorexclude, toanypersonwhodoesnotcomplywiththeCodeorapplicablelaws. D.TheCodeincorporatesallrelevantapplicablelegislativechangesthatoccurafterthedate theCodeisadopted. E.ActsprohibitedundertheCodearepermittedifauthorizedbyagreement,permit,license,or awritingsignedbyanauthorizedMetrorepresentative. B.Creatingnoise,includingunnecessarycellphoneorotherconversation,thatissoloud, lengthy,sexuallyexplicit,threatening,violent,ordisruptive,thatitcausesanuisanceor unreasonablyinterfereswiththeuse,operation,orenjoymentoftheMetrofacilitiesorvehicles forMetrorepresentativesorpatrons,orcreatesanunsafecondition,suchasdistracting operatorsofMetrovehicles. C.Playingasounddevice,exceptwhenusingheadphonesorearphonesthatmakethesound inaudibletoothersunlessapermithasbeenissuedforusageofsuchsounddevicebyMetro. 605160Odors A.ApersonmaynotbeinaMetrofacilityorvehiclewithanunavoidablegrosslyrepulsiveodor soextremeitcausesanuisance,unreasonablyinterfereswiththeuse,operation,orenjoyment oftheMetrofacilitiesorvehiclesforMetrorepresentativesorpatrons,orcreatesanunsafe condition. B.Extremeodorsmayarisefromavarietyofsources,includingone'sbody,possessions, clothing,food,chemicals,oraccompanyinganimals. 605170ParkingandUseofMetroFacilitiesandVehicles A.ParkingavehicleataMetrofacilityshallnotexceedthepostedallowedperiodoftime. B.ParkingorstorageofitemsinMetrofacilitiesmayonlybeusedforthedesignatedMetro relatedtransportationpurposes. C.ApersonmaynotperformnonemergencymaintenanceonanonMetrovehicleataMetro facilityunlessauthorizedbyMetro. D.DrivertrainingisprohibitedatMetrofacilitiesunlessauthorizedbyMetro. E.ApersonmaynotenternonpublicareasinMetrofacilitiesorvehicles,unlessauthorizedby Metro.

F.Personswishingtoholdanevent,specialmeeting,oruseforcommercialpurposes,ina Metrofacilityorvehicle,shouldcontactMetroforinformationonitspoliciesandprocedures, andobtainitsapprovalinadvance,forsuchuse. 605180PhotographyandRecording A.Apersonmaynotphotograph,film,duplicate,record,orsketchaMetrofacilityorvehiclefor commercialpurposeswithoutfirstobtainingaMetropermitandanyotherrequiredpermits, andpayingallrequiredfees. B.Apersonwhophotographs,films,orrecordsinaMetrofacilityorvehiclemustcomplywith allMetrosafetyrequirements,instructions,licenses,andapplicablelawsincludingcopyright laws. C.Apersonmayphotograph,film,record,orsketchaMetrofacilityorvehiclefornon commercialpurposesonlyinpublicareas,unlessotherwiseauthorizedbyMetro,andina manner,atatime,andataplacethatdoesnotinterferewithMetrooperations,orcreatean unreasonablerisktothesafetyorwellbeingofMetrorepresentativesorpatrons.Prohibited activitiesshallincludeuseofatripod,orlayingofcordorcables,inawalkway;useofaflash bulbthatisblindingtopatronsorMetroRepresentatives;orcreatingcongestionduringan emergencyevacuation. 605190Safety A.ThefollowingactsareprohibitedinMetrofacilitiesandvehicles: 1.Attachingto,hangingfrom,orridingonanypartoftheoutsideofaMetrovehicle,or beinginsideanareainwhichthepublicareprohibited.Thissectiondoesnotapplytoan employeeconductingMetrobusiness. 2.InterferingwiththesafeoperationormovementofaMetrovehicle. 3.Abandoningpersonalitems. 4.Throwingorkickingaball,disc,orotherobjectwhereitisnotsafetodoso. 5.Standing,lying,orclimbingonasign,bench,passengershelter,trashcontainer,or planter. 6.ExtendinganythinginthepathoforthroughadoororwindowonaMetrovehicle. 7.EnteringorcrossingrailtracksinaMetrofacility,exceptinmarkedcrosswalksor designatedwaitingareas,oratthedirectionofaMetrorepresentative. 8.Engaginginsport,horseplay,orrecreationalactivities. 9.Creatingadangertootherpersons. 10.ExtendinganyportionofthebodythroughanywindowopeningofaMetrovehiclein anunsafemanner. 11.EngaginginanyunsafeactivityotherthanthosedescribedinSafetysubsection605 190oftheCode. B.Toavoidinjury,patronsmustusecareatalltimeswhenonorinaMetrofacilityorvehicle.

C.PatronsshouldbealertandpromptlyreporttoMetroorlawenforcementanyunsafe condition,brokenequipment,orsuspiciousactivity,odor,orpackage. D.EmergenciesshouldbereportedimmediatelytoaMetrorepresentative,lawenforcement, oremergencypersonnel.Emergenciesmaybereportedusingtelephonesorintercomsif availableintheMetrofacilitiesorvehicles. E.IfaMetrorepresentativeorotherauthorizedpersonnelevacuatesaMetrofacilityorvehicle, patronsshallpromptlyandorderlyfollowinstructionstoavoidinjurytootherpersons. F.Nopersonshallremove,tamperwith,injureordestroyaMetrovehicleorthecontents thereof,withtheintenttocausegreatbodilyinjurytoanotherperson,orplaceanobstruction infrontofaMetrovehicle,orwillfullysetaMetrovehicleinmotionwhileitisatrestand unattended. G.ElevatorsshallnotbeusedinaMetrofacilityintheeventofafire. 605200Signs A.Nopersonshallaffixorpostsigns,stickers,buttons,advertisements,circulars,orother printedmaterialsonorinMetrofacilitiesorvehicles.Writtenpermissionmustbeobtained fromMetropriortoplacing,posting,ordisplayingaposter,notice,advertisement,sign,or otherwrittenmaterialonaMetrofacilityorvehicle. B.Nopersonsshalldestroy,cover,defacewithgraffiti,remove,damage,ortamperwitha Metroposter,sign,advertisement,ornotice,unlessauthorizedbyMetro. C.Personsshallobeyanysignthatisintendedtoprovideforthesafetyandsecurityoftransit passengersorthetransitsystem. D.PersonsshallalsoobeyallothernoticesandsignspostedbyMetroinaMetrofacilityor vehicle. (2)Ifthepersonsubjecttothenoticeofviolationisnotsatisfiedwiththeresultoftheinitial review,thepersonmaynolaterthan21daysfollowingthemailingoftheinitialreview decisionrequestanadministrativehearingoftheviolation.Therequestmaybemadeby telephone,inperson,orbymail.Thepersonrequestingtheadministrativehearingshall depositwithMetrotheamountdueunderthenoticeofviolationforwhichtheadministrative reviewhearingisrequested.Apersonmayrequestadministrativereviewwithoutpaymentof theamountdueuponprovidingMetrowithsatisfactoryevidenceofaninabilitytopaythe amountdue.Anadministrativehearingshallbeheldwithin90daysofthereceiptofrequest foranadministrativehearing. (3)Theadministrativehearingshallincludeallofthefollowing: (a)Thepersonrequestingthehearingshallhavethechoiceofahearinginpersonorby mail.AninpersonhearingshallbeheldwithinthejurisdictionofMetro,andshallbe conductedaccordingtosuchwrittenproceduresasmayfromtimetotimebeapproved bytheChiefExecutiveOfficerofMetroortheChiefHearingOfficer.Thehearingshall provideanindependent,objective,fairandimpartialreviewofcontestedviolations. (b)Thehearingshallbeconductedbeforeahearingofficerdesignatedtoconductthe reviewbyMetrosChiefExecutiveOfficerorChiefHearingOfficer.Inadditiontoany otherrequirementsofemploymentthehearingofficershalldemonstratethose qualifications,training,andobjectivityasarenecessaryandconsistentwiththeduties andresponsibilitiesofthepositionasdeterminedbyMetrosChiefExecutiveOfficeror ChiefHearingOfficer.Thehearingofficerscontinuedemploymentshallnotbedirectly orindirectlylinkedtotheamountofpenaltiesimposedbythehearingofficer. (c)Thepersonwhoissuedthenoticeofviolationshallnotberequiredtoparticipatein anadministrativehearing.Metroshallnotberequiredtointroduceanyevidenceother thanthenoticeofviolation.Thenoticeofviolation,inproperformshallbeprimafacie evidenceoftheviolation. (d)Followingadeterminationbyahearingofficerthatapersondidcommitthe violation,thehearingofficermay,wherethepersonhasestablishedaninabilitytopay, permitpaymentininstallments.Whereitisdeterminedthatcircumstancesexistsuch thatthedismissalofthenoticeofviolationwouldbestservetheinterestsofjusticethe Hearingofficermaydismissthenoticeofviolationandshallprovidewrittenreasonsin supportofthatdecision.TheHearingOfficershallhavethepowerandauthorityto makerulingsintheinterestsofjusticewithinthelawandMetropoliciesconcerning noticesofviolationandtheadjudicationofhearingsincludingthegrantingofeligibility toattendMetrosTransitSchoolforthepurposeofreducinganypenaltypayment,or otherremedy. (e)Thehearingofficersdecisionfollowingtheadministrativehearingmaybedelivered personallybythehearingofficerormaybesentbyfirstclassmail. (f)Thehearingofficersdecisionatadministrativereviewisfinalexceptasotherwise providedbylaw.

C. A person who violates any provision of the Code may be ejected by order of an authorized Metro representative and may be excluded from all or a portion of Metro vehicles and facilities. This remedy is in addition to any other fine, penalty, assessment,orotherremedyavailableatlaw.Theproceduresforexclusionarethose setforthinsubsectionsBHofthisEnforcementSection. 1.ApersonwhoviolatestheCodemaybeimmediatelyejectedfromtheMetrofacility or vehicle, without refund of any fare, by an authorized Metro representative who witnessesaviolation. 2.ApersonwhoviolatestheCodeissubjecttoanadministrativefineorotherpenalty for each violation, as specified in the Metro penalty schedule approved by the Board of Directors or Chief Executive Officer up to the maximum amount provided by law. The Metro penalty schedule shall include fines, fees, administrative penalties, late payment fines, and collection recovery costs, and other such amounts. To determine the Metro penalty schedule, the costs to the agency and otherrelevantfactorsshallbeconsidered. 3. A person who violates the Code must, in addition to any fines or penalties listed in Metros penalty schedule, or as otherwise required by law, pay restitution if the violationinvolvesdamages. 4.AviolationoftheCodethatisalsoaviolationofalocal,state,orfederallawmaybe prosecuted in a court proceeding by the appropriate authority, in addition to any enforcementbyorremediesavailabletoMetro. 5. Failure to comply with a Notice of Exclusion may result in fines, a citation for criminaltrespass,andanyotherapplicablecriminalandcivilremedies. 6. Metro may establish procedures concerning the administration of any hearing provided such procedures are not in conflict with applicable law or the Code, and are approved by the Metro Board or the Chief Executive Officer or Chief Hearing Officer. 7. Metros Board of Directors or Chief Executive Officer or Chief Hearing Officer shall designate the officers, employees, consultants or contractors who shall be authorized to issue notices of violation, citation, order ejections and exclusions, or otherwise carry out the duties under the Code and any requisite training for such persons. D.Exclusion 1. A person, who violates the Code or a law in a Metro facility or vehicle, may be excluded from all or part of Metro facilities and vehicles either indefinitely or for a periodoftimespecifiedintheMetropenaltyscheduleornoticeofexclusionprovided pursuanttosubsectionEbelow. 2.Any person to whom a notice of violation or Penal Code citation pertaining to an offensewhichoccurredonorinapublictransitfacilityorvehicle,wasissued,andwho

has failed to pay any applicable fines, fees, penalties or other administrative amounts by the due date, or otherwise resolve the violation, or who has otherwise failed to payanyfine, fee,orpenaltywhensuchpaymentwasdueorwhoisthesubjectofany outstanding warrant with respect to any Penal Code offense that is alleged to have occurred on or in a public transit system facility or vehicle is subject to exclusion, and mayreceiveanoticeofexclusionpursuanttoSubsectionEbelow. 3.ApersonexcludedundertheCodemaynotenteraMetrofacilityorvehicleduring theperiodofexclusion.Metromaytakeanyreasonablestepsnecessarytoenforcean order of exclusion, including criminal arrest or such other remedies as may be availableatlaw. E.NoticeofExclusion. A notice of exclusion shall be given by Metro or its authorized representative by personal delivery, first class mail, or if the person does not provide Metro or its representative with a valid current address, to the address provided by the excluded person at the time of any underlying violation(s), or at the excluded persons last known address. A notice of exclusion is deemed received on the date of personal delivery or five (5) days after the date the notice of exclusion is mailed. The notice of exclusion shall specify the reason for exclusion, the places or transit lines from which the person is excluded, the duration of exclusion, the consequences for failing to comply with the terms of exclusion, and the right to seek review or appeal the decision. Any exclusion shall begin on the third day following receipt of the notice of exclusion unless otherwise specified in the notice of exclusion, except that exclusions issuedforaperiodofonedayorlessareeffectiveatthetimethenoticeofexclusionis received.Theexclusion,orotherremedy,shallbesuspendeduponMetrosreceiptof arequestforreviewanduntilthereviewisdecided. F.ReviewRequest. An excluded person may request an initial review of the exclusion. The exclusion shall be suspended upon Metros receipt of a request for initial review of a notice of exclusion, and until the initial review is decided and received by the excluded person. The request for review must be made in writing, and may be submitted by mail, or in person or as otherwise provided in the notice of exclusion, within five (5) days after the Notice of Exclusion is received from Metro. A request for review is deemed to be receivedonthedateitispersonallydelivered,orifmailed,five(5)daysafterthedate of the postmark. The excluded person may request that the exclusion be rescinded or waived for good cause, that the places of exclusion be altered, or that the duration of exclusion be reduced. The request must include a copy of the notice of exclusion or the number assigned to the notice, a request for review the current mailing address

and signature of the excluded person, and any written statement (and supporting documentation) to explain why the exclusion should be rescinded, waived, altered, reduced or otherwise modified. If, following the initial review Metro is satisfied that the notice of exclusion should not have been issued or should be modified in any manner, Metro shall cancel the notice of exclusion or make the necessary modifications. A Metro representative shall provide written notice to the excluded person of its decision concerning the request for initial review. The decision of the hearing officer shall be deemed in full effect upon personal service of the excluded person or five days after the mailing of the decision by Metro. All requests for review shall be submitted to: Metro, One Gateway Plaza, CA 90012, Attention: Transit Court, unlessotherwisespecifiedintheNoticeofExclusion. G.AppealHearing. Anexcludedpersonmayappealtheresultoftheinitialreviewbysubmittingarequest for appeal to Metro within five (5) days after the decision on the initial request for review is deemed received by the excluded person. The exclusion shall be suspended upon Metros receipt of a request for appeal and until the appeal is decided and received by the excluded person. If an excluded person submits a notice of appeal, Metro shall schedule a public hearing. Hearings shall be scheduled no earlier than the next day after the excluded persons receipt of the of the initial review decision. The excluded person will be notified of the date for public hearing by mail, or in person. The hearing shall be conducted by a hearing officer who is fair and impartial. The excludedpersonisnotrequiredtoattendthehearing,andshallhavethechoiceofthe hearing being conducted by mail or in person. No Metro representative shall be requiredtoattendthehearing.Metromaysubmitacopyofthenotice(s)ofviolation, any notice of exclusion, and any documentation or statement by the Metro representative(s)issuingthenotice(s)ofviolationornoticeofexclusion.Anynotice(s) of violation and/or notice of exclusion shall be received into evidence. Other relevant evidence submitted may be received into evidence at the determination of the presiding Hearing Officer. Copies of the notice(s) of violation and/or notice(s) of exclusionshallbeprimafacieevidenceofthefactsstatedthereinandshallestablisha rebuttable presumption supporting the exclusion of the individual. At the hearing, Metro and the excluded person may present evidence including witness testimony to the hearing officer and may question witnesses who are present at the hearing. The hearingofficersdecisionshallbebasedonapreponderanceoftheevidence.Hearing officers shall have the discretion to dismiss or reduce the fines, or other penalties including the time period of any exclusion order for matters in the interests of justice in accordance with any policies or procedures adopted by the Metro Hearing Unit. Continuancesoftheappealhearingaredisfavoredbutmaybeorderedbythehearing officer. The hearing officer may authorize the recording of the hearing. The decision of the hearing officer shall be made in writing, and shall be delivered to the excluded

person by first class mail. The decision of the Hearing Officer shall be final except as otherwiseprovidedbylaw. H. Schedule. Metro shall adopt a penalty schedule of administrative penalties, and any necessary additional procedures in furtherance of enforcement of this Code. The schedule and any procedures deemed necessary shall be subject to the approval of theChiefExecutiveOfficer. I. ThisordinanceshallbeoffullforceandeffectonFebruary27,2012.47
